Digital media and the administration of copyright

English summary Digital media and the protection of authors' rights Law is not a panacea. Although it lays down rules of human conduct, it cannot guarantee they will be observed also in practice. The decision whether we will conform to these rules depends only upon our choice. For example, the law stipulates the speed limit for motor vehicles. However, this measure it-self does not hinder driving faster and it is obvious this is happening frequently on our roads. In the situation when the law alone is not able to prevent the interference with the protected interest, it is appropriate to employ additional non-legal instruments to supplement this protection. In the mentioned example, it can be a media campaign notifying of the possible consequences of fast driving. Another eligible solution is the exercise of technical measures which would exclude the breach of legal norms or at least make it substantially difficult. The car would, for example, receive a signal designating the speed limit at a particular place which could not exceed. Such measures are not limited only to the protection of public law rules but can be used by private persons to protect their own property. Radim Gelner Overview of specific modes of authorial work protection including the comparison with the general mode of protection - Diploma Thesis Summary In this thesis we analyze specific modes of protection of authorial works provided by the Czech Copyright Act 121/2000 Sb. as amended. These specific modes of protection are invoked either by the type of authorial work (for example computer programs) or by legal circumstances at the time the authorial work is created (for example existing employment relationship). In the first part of the thesis we discuss the parties of intellectual property relationships. Although the author is the primary party of such relationships there are other subjects as well such as heirs, employers, licensees, movie producers etc. We briefly describe the natural rights and the property rights of the author relating to the authorial work and modes of their transferral to other subjects of the intellectual property relationships. Then we follow up with the description of authorial work as a subject of intellectual property relationships. This thesis focuses on European copyright legislation and its impact on national laws. The aim is analysis and description of EU legislation and relevant case of the CJEU as well as comparative study of Czech Republic, UK and Ireland. The structure of this thesis is composed by five chapters. The introductory chapter concentrates on the concept copyright and its international aspects. There is brief description of copyright and its main features with regard to the relevant international treaties. Moreover, there is analysis of differences between copyright law and authors right system. Consequential chapter deals with a development of digital technologies. It considers an influence of such technologies as the WWW on the copyright protection. This chapter closely describes an international legal instrument, which were amended in the course to respond the challenges posed by such technologies on copyright law. The third chapter covers the European Union legislation and it splits into 6 Sections. The explanation is focused on secondary law of the EU, upcoming EU legislation in field of copyright law as well as liability of the ISSP under existing EU law. Závěr Na závěr této práce lze vzhledem k výše uvedeným zjištěním konstatovat, že Česká republika má moderní autorskoprávní kodex, který flexibilně reaguje na nové rozvíjející se technologie a v souladu s příslušnými mezinárodními smlouvami a komunitární úpravou poskytuje ochranu osobám, jejichž autorská práva byla na internetu zneužita. Vzhledem k tomu, že česká právní úprava týkající se zejména odpovědnosti providerů je poměrně mladá, chybí zde významná judikatura, která by (byť nezávazně) umožnila orientaci v příslušných zákonech tam, kde lze výkladem dojít k více řešením. Dle mého názoru je třeba do budoucna v rámci autorského zákona vyřešit problematiku osiřelých děl, aby bylo možné buď co nejefektivněji zjistit autora díla nebo dílo prohlásit za osiřelé a tím umožnit jeho zákonné šíření v digitální podobě na internetu. Touto problematikou se již, jak bylo uvedeno v této práci, zabývají orgány Evropské unie. Vzhledem k potřebě sjednocování legislativy členských států EU i v této souvislosti pravděpodobně Česká republika převezme "evropské" řešení. S tímto tématem je spojena i problematika správy autorských práv. Synopsis This thesis is focused on the rights, which accompany the performer. Does not aim to focus on the details of individual institutions, but rather to organize informations about the rights attaching to the performer and artistic performance. In four chapters the author tries to depict these rights since their inception, since the creation of an artistic performance to the moment when the performance become a part of public domain, as well as the right to the these free artistic performances. The first chapter is an introduction to the subject, defines the legal concepts - an author, performer, author's work, artistic performance etc. and also covers the concept non- legal - art, in spite of its abstractness, to author of this thesis seems to be crucial in the legal definition of a performer. The second chapter deals with the own performer's rights, property and personality rights and their duration. In the third chapter the autor drala with legal representation of performers by common agent, who represents performers when dealing with the rights to jointly created performance. The rigorous work in the first part deals with theoretical grounds of license agreements issue, the second special part contains interpretation of individual provisions of a license agreement, attention is paid to related issues, such as specifics of contracts with international element, effectiveness of a license agreement to third parties, competition aspects related to license agreement to trademarks and related contractual types. Vergütungspflicht bei der Vervielfältigung von Urheberwerken - die tschechische und deutsche Regelung im europäischen Kontext Abstrakt Die Vervielfältigung zu privaten Zwecken ist eine der Schranken vom Recht des Urhebers, das Werk zu nutzen. Auf der Grundlage eines Konzepts, das in den 1960er Jahren in Deutschland entstanden ist, ist eine solche Vervielfältigung nur dann möglich, wenn dem Urheber für einen solchen Eingriff in seine wirtschaftlichen Interessen Vergütung gewährt wird. Wie auch in anderen Bereichen des Urheberrechts ist es auch im Falle des Systems der Vergütungen notwendig, ein Gleichgewicht zwischen den Interessen des Urhebers und der gesamten Gesellschaft zu finden. Ein weiteres typisches Zeichen im Zusammenahng mit dem Institut der Vergütungen ist die technologische Entwicklung, die auch der Motor bei der Einführung des Systems der Vergütungen in den 1960er Jahren war. Die Arbeit widmet sich im ersten Kapitel den Gründen für die Einführung des Systems der Vergütungen und den Möglichkeiten seiner Ausgestaltung.
