The *.eu domain and the protection of third persons' rights

Rozvoj internetu, jako fenoménu konce 20. století, sebou přináší mnohé otazníky a výzvy, jak technické, tak právní, na které je mnohdy třeba odpovídat a řešit je bezprostředně poté, kdy vyvstanou. Postupem času toto "kybernetické" prostředí přestalo být ryze vědeckou záležitostí a začalo se, čím dál více, komercionalizovat. Právě spolu se zvyšujícím se využíváním internetu jako virtuálního tržiště, se začaly objevovat problémy, na které bylo potřeba adekvátně reagovat. S velikým zjednodušením lze pojmenovat dva stěžejní okruhy problémů, se kterými se "provozovatelé" internetu v současnosti především potýkají, a těmi jsou zabezpečení dostatečného počtu "internetových adres" a vypořádání se s neduhy, které registraci těchto "adres" provázejí. Těmito jsou především spekulativní registrace doménových jmen, když tyto zcela oprávněně vyvolávají reakce subjektů, které se takovou registrací cítí poškozeny. Životní cyklus doménových jmen, tedy proces počínající jejich registrací a případně končící zrušením takové registrace, popř. diskvalifikace doménového jména z možnosti jeho další registrace, je upraven zejména tzv. soft law - tedy pravidly vydávanými jednotlivými správci TLD. 69 Software Piracy As this thesis suggests, it is possible to only speculate about further development in the sphere of software piracy. While in the past households were proud of Internet access whose connectivity hardly exceeded 56kbps, information technology now develops at an incredible pace and organisations such as BSA can hardly measure up with it. Nowadays, downloading files via the Internet is quite an easy job for any average user and in my opinion it is beyond the capacity of any organisation to call on all these Internet users and frighten them, or to conduct with them expensive legal proceedings with uncertain and vague results. In my thesis I try to explain that the result of efforts in this respect should be, above all, co-operation amongst the relevant organisations, the government, software piracy specialists and software producers and that all these stakeholders should in particular focus on public education, trying to explain the basics of this problem, and on psychological prevention. As the use of the Internet expands, so does software piracy. It is better to change this situation by precise legislative provisions, on which the authors will be able to rely firmly, rather than by repression. The issue of exceptions from the transmission and operation of radio and television broadcasting in the Copyright Act

In 2005 the Parliament of the Czech Republic adopted an amendment of Act No. 121/2000 on Copyright Law and Rights Related to Copyright [hereinafter Copyright Act]. The Copyright Act amendment set up three new exceptions to the author's exclusive right to exploit his or her work. The author deals with harmony of these three exceptions with international copyright law system and European copyright law. In the broad context the author discusses problems related to the changing scope of the exceptions and limitations under international treaties and then considers how to balance the interest of proprietors and the public. In order to achieve objectives, he tried to analyze two basic rules of international and European law. First of them is the well known rule which is the three-step test. The author examines the wording of the restriction found in the original Berne Convention for the Protection of Literary and Artistic Works 1886 and its subsequent revision to include the three-step test. He describes in detail the subsequent changes to the test's application following its inclusion in the Agreement on Trade-Related Aspects of Intellectual Property Rights, the Internet Treaties and European Parliament and Council Directive 2001/29 [hereinafter Information Society Directive]. - English The topic of my thesis is limitations and exceptions to copyright. It describes the ways of use of copyright without author's consent. Specifically, I talk about the free work, free use and statutory licences. The provisions must always be interpreted in accordance with the three-step test described in a separate chapter. I focus especially on issue of orphan works. Of course, I also deal with an issue of copyright in general and its sources.
Licence agreement in the legal systems of the Czech Republic and England and Wales

The objective of this diploma thesis is to render a comprehensive analysis of licence contracts in two countries - the Czech Republic and England and Wales. The effort to highlight differences between the two scrutinized jurisdictions and related criticism are the most important methods applied in this work and, hopefully, the most recognizable benefits of it. The thesis consists of a short introduction, followed by four descriptive chapters and author's subjective conclusions. The introductory part presents methods of research used throughout the work and implicitly hints what can the reader except when studying this diploma thesis. The first chapter splits into two mutually linked subchapters. The first one defines the very term licence, its etymology and classification. The following subchapter describes general characteristics of intellectual property, a crucial topic to licence contracts and thus indirectly to this thesis. This thesis promises a comparison of two legal systems and the second chapter fulfils this aim. Legal protection of domains in relation to the right of indication The aim of this master thesis is to provide information about the relation between domain names and law, with particular attention paid to rights of indication. The reader will become acquainted with the classification of domain names within the Czech legal system, their possible conflicts with different rights, and procedures which can be used for their protection. The thesis reflects changes caused by the new conception of private law and recent judicial decisions, mainly regarding alternative dispute resolutions. In order to understand this issue, it is also necessary to be familiar with the technical aspects of domain names and the Internet, and therefore this subtopic is included in the thesis as well. The thesis consists of four topical parts. The first one, which is made up of the second and the third chapter, deals with the functioning of the Internet and IP addresses, the registration process of domain names, and their composition, management and main functions. (EN) Primary focus of this thesis is the copyright protection of databases. This thesis introduce the copyright protection of databases as an essential element of two pillar system of European Union database protection law that is based on the directive no. 69/9/ES on the legal protection of databases. First five chapters of this thesis are concerned with general questions related to the copyright protection of databases. Purpose of these chapters is to introduce roots of legal and other nature from which the copyright protection of databases arises. This part of the thesis thus defines the phenomenon of databases in relation to information society, available means of protection, the purpose of legal protection of databases, the legal framework and relevant legal traditions. Subject of sixth chapter is the definition of database as a specific category of work and compares it with other kinds of works with the emphasis on common and distinctive characteristics.
