Inspirational Force of the General Austrian Civil Code in the Proposal of the Civil Code for the Czech Republic

The contribution indicates that the author is one of the key persons participating in the preparation of recodification of the Czech Civil Code. The author pays attention to the development of the proposal of the Code from the preliminaries and laying down the conceptual basis to passing the proposal by the government in May 2011. He points out that the main postulates adopted by the modern codification are ideas which were already expressed in the General Austrian Civil Code, such as respecting a person as a free individual and acceptance of the role of a judge as an authority which both applies and makes law.

What Can Tell us the History of Bills of Rights?

In his text, the author focused mainly on historical bills of rights, particularly on English Magna Carta of 1215 and the Bill of Rights of 1689, American Bill of Rights of 1791 and French Declaration of the Rights of Man and the Citizen of 1789. The author paid attention to a remarkable feature of these bills, i.e. the fact that they had not been applied in practice for a long time.

The focal point of the contribution are considerations on various types of legal relations that have animals as an object either in public or private law, with reference to different aims of respective legal regulation.

Police Admission on the Grounds of Abused Animals

The Act on the Police of the Czech Republic empowers policemen to enter certain types of premises of the keeper even without his or her consent if there is a reasonable suspicion of animal abuse. The article deals with the description of relevant legal provisions and gives some remarks of their practical implementation.

Metamorphoses of Czech Private Law Recodification

The author reflects on the metamorphoses of codifications of Private Law from the end of the 20th century. She evaluates the advantages and disadvantages of the given proposals of the Civil Code and she deals with the issue of enactment of the third proposal which is ready for consideration by the Chamber of Deputies of the Parliament of the Czech Republic.
