The European standard of the protection of a child's rights

The European standard of protection of the rights of the child - resumé In my thesis I decided to focus on the child and his rights as how they are recognized in nowadays society crosswise the countries, mainly those of the european continent. In the first chapters I deal with the evolution of the international human rights legal instruments since the beginning of the twentieth century and I discover how the legal status of the child in the society had started to develop and how it has changed during the century stages. The child was at first only a mere object and was not entitled with possesion of the full rights, even on the contrary, it was the child who was in possession of his parents. The first international human rights documents adopted, began to guarantee the protection to the children in certain ways such as against a hard labour and they put forth the first protective rights such as the access to medical treatment and the access to education. Later on, after the second world war the major international human rights treaties were adopted and since then the child was accorded full enjoyment of his rights as a citizen. Resumé The theme of my diploma thesis is The International Regulations of Trafficking in Women. Trafficking in people, especially with women is very old and unfortunately still actual phenomenon. Nowadays it is a fastest-growing form of criminal industry in the world. People are in the position of commodity that is trafficked. Universal human rights of victims and fundamental principles of democratic societies are breached, particularly the principle of protection of life, human integrity and dignity, personal freedom or the prohibition of slavery or forced labour. Trafficking in people is a complex process involving recruitment of victims, usually their transport (across the border or within the country) and finally exploitation (for the purpose of prostitution, forced labour, debt bondage, involuntary servitude, children adoption and so on). In the state of origin trafficking in people is caused by poverty, lack of political, social or economic stability, lack of reasonable prospects, situations of armed conflict, gender discrimination, lack of access to education and information, and in the state/region of destination it is caused by increasing demand for the cheap labourers or demand for sex workers. The role of international non-governmental organisations in protection of human rights Summary The aim of this master thesis is to provide a systematic insight into the legal status and the role of international non-governmental organisations (INGOs) in protection and promotion of human rights in international law. By means of that, the thesis seeks to answer the question whether the current legal status of INGOs is favourable both for the INGOs themselves and their counterparts at the international level, mainly the states and international governmental organisations. Divided into three parts, the thesis is focused first on the legal definition of INGOs and their legal status in international relations, together with a depiction of their main functions. The illustration of the legal status of INGOs is oriented mainly on the legal regulation within the United Nations and the Council of Europe, two international bodies with the most developped cooperation strategy with INGOs. The theoretic part serves to demonstrate the contrast between a weak formal position and rather informal role of INGOs in international law, which is yet getting more and more important, mainly in the area of protection and promotion of internationally recognised human rights. Záv r Hlavním cílem práce bylo prozkoumat stávající mezinárodní úpravu související s ochranou práv žen, zhodnotit její dostate nost a p ípadn též poukázat na její mezery. Na záv r lze konstatovat, že hlavní cíl práce, tak jak byl definován v úvodu, byl spln n. Poda ilo se celistv uchopit sou asnou mezinárodní úpravu poskytující ženám ochranu v r zných odv tvích života. V úvodu práce byla provedena deskripce historického vývoje ochrany ženských práv, která je d ležitá pro pochopení sou asného stavu, a následn byla popsána specifická situace v jednotlivých obdobích našich d jin. Poukázáno bylo zejména na rozli né postavení ženy v r zných spole nostech, které však až na výjimky bylo vždy nižší než postavení muže. Pro znázorn ní jsem uvedla n která konkrétní práva žen ve vybraných spole nostech a naopak poukázala na práva, která byla ženám odpírána. Zajímavými jsou také samotný pojem a problematika ženských práv i d vody pot eby speciální ochrany, jež jsou rozebrány v druhé kapitole téže ásti. Následn práce poukázuje na jednotlivé mezinárodní dokumenty týkající se ženských práv, a to jak universální dokumenty o lidských právech a dokumenty evropské, tak dokumenty ur ené specificky ženám, jež jsou uvedeny v jejich historickém kontextu a rozd leny podle jednotlivých aspekt ochrany. 81 The status of third country nationals in the EU - Abstract The thesis deals with the status of third country nationals (further referred to as TCN) in the EU. Its purpose rests in the analysis of the current immigration policy of the EU and the comparison of the different groups of immigrants coming to the Member States from third countries. The objective thesis consists of 6 chapters. Chapter 1 is introductory. It defines the concept of migration and it determines the subject-matter of the thesis, which is the legal migration. Chapter 2 is focused on the historical development of the common asylum and immigration policy in the EU. It is divided into four subchapters, each subchapter describes certain historical period. The heart of the thesis is contained in Chapter 3. It is divided into six subchapters, each of them deals with the specific aspect of the TCN's status (first admission and entrance on the territory of EU, freedom of movement in the EU and right to reside on the territory of Member States, the access to employment and right to equal treatment, the expulsion and withdrawal of the residence right and finally procedural guarantees).
