118 8. Záver o doda na záver? Myslím, že z mojej práce vyplýva nieko ko poznatkov, ktoré sú uvedené na príslušných miestach práce. Ich zhrnutie prinášam v nasledujúcich odstavcoch. Predovšetkým je nesporné, že dizajn a jeho ochrana v dnešnej spolo nosti naberajú neustále na význame a ekonomickej dôležitosti. Dizajn je významným prvkom pri odlíšení výrobkov jedného výrobcu od výrobkov iných výrobcov, dizajn má evokova v zákazníkoch pozitívne skúsenosti, ktoré majú s jeho subjektom z minulosti, a preto nepochybne stojí za to ho chráni . Ako základný prostriedok ochrany vidím predovšetkým ZOPV, ktorý poskytuje ochranu plne zlú ite nú s dnešnými potrebami, a o je dôležité, je takisto konformný s komunitárnymi predpismi, predovšetkým so Smernicou. Aj ke na niektorých miestach sa javí terminologicky nevyhraneným a nejednotným, najmä pokia ide o otázku vlastníctva, i nevlastníctva vzoru, myslím si, že jeho interpretácia a aplikácia v praxi nebudú spôsobova vážnejšie ažkosti. Taktiež úprava vymáhania týchto práv je riešená jednotne, pre všetky práva priemyselného vlastníctva, o možno hodnoti pozitívne, najmä z dôvodu preh adnosti a jednotnosti ich vymáhania. Ochrana poskytovaná inými právnymi prostriedkami, i už je to autorské právo alebo ochrana prostredníctvom úpravy nekalej sú aže, je samozrejme možná, no...

Trade mark law and the issue of parallel imports in Czech, EU and US law

100 Parallel importation and trademark law in the Czech Republic, EU and USA Parallel imports are a non-counterfeit (genuine) goods, bearing a trademark, intended for sale in one country, but instead put on market without the consent of the trademark owner in another country. The price of parallelly imported good is actually lower than the price of the authorized good, due to several factors: currency exchange rates, laws, taxes, logistical expenditures etc. It is not only the price, but also other features of the merchandise, such as the appearance, required characteristics and customer safety measures that differ from the ones of the authorized goods. Such differences may damage the goodwill consumers associate with the trademark. Trademarks are protected dependently on national laws, therefore different countries address the issue differently. There is no international treaty that would solve the problem of parallel importation on international level. No consent has ever been unanimously reached. The issue of parallel importation is closely connected to the doctrine of exhaustion. Various countries apply national exhaustion whereas others apply international/global one. The *.eu domain and the protection of third persons' rights

Rozvoj internetu, jako fenoménu konce 20. století, sebou přináší mnohé otazníky a výzvy, jak technické, tak právní, na které je mnohdy třeba odpovídat a řešit je bezprostředně poté, kdy vyvstanou. Postupem času toto "kybernetické" prostředí přestalo být ryze vědeckou záležitostí a začalo se, čím dál více, komercionalizovat. Právě spolu se zvyšujícím se využíváním internetu jako virtuálního tržiště, se začaly objevovat problémy, na které bylo potřeba adekvátně reagovat. S velikým zjednodušením lze pojmenovat dva stěžejní okruhy problémů, se kterými se "provozovatelé" internetu v současnosti především potýkají, a těmi jsou zabezpečení dostatečného počtu "internetových adres" a vypořádání se s neduhy, které registraci těchto "adres" provázejí. Těmito jsou především spekulativní registrace doménových jmen, když tyto zcela oprávněně vyvolávají reakce subjektů, které se takovou registrací cítí poškozeny. Životní cyklus doménových jmen, tedy proces počínající jejich registrací a případně končící zrušením takové registrace, popř. diskvalifikace doménového jména z možnosti jeho další registrace, je upraven zejména tzv. soft law - tedy pravidly vydávanými jednotlivými správci TLD. 69 Software Piracy As this thesis suggests, it is possible to only speculate about further development in the sphere of software piracy. While in the past households were proud of Internet access whose connectivity hardly exceeded 56kbps, information technology now develops at an incredible pace and organisations such as BSA can hardly measure up with it. Nowadays, downloading files via the Internet is quite an easy job for any average user and in my opinion it is beyond the capacity of any organisation to call on all these Internet users and frighten them, or to conduct with them expensive legal proceedings with uncertain and vague results. In my thesis I try to explain that the result of efforts in this respect should be, above all, co-operation amongst the relevant organisations, the government, software piracy specialists and software producers and that all these stakeholders should in particular focus on public education, trying to explain the basics of this problem, and on psychological prevention. As the use of the Internet expands, so does software piracy. It is better to change this situation by precise legislative provisions, on which the authors will be able to rely firmly, rather than by repression. The issue of exceptions from the transmission and operation of radio and television broadcasting in the Copyright Act

In 2005 the Parliament of the Czech Republic adopted an amendment of Act No. 121/2000 on Copyright Law and Rights Related to Copyright [hereinafter Copyright Act]. The Copyright Act amendment set up three new exceptions to the author's exclusive right to exploit his or her work. The author deals with harmony of these three exceptions with international copyright law system and European copyright law. In the broad context the author discusses problems related to the changing scope of the exceptions and limitations under international treaties and then considers how to balance the interest of proprietors and the public. In order to achieve objectives, he tried to analyze two basic rules of international and European law. First of them is the well known rule which is the three-step test. The author examines the wording of the restriction found in the original Berne Convention for the Protection of Literary and Artistic Works 1886 and its subsequent revision to include the three-step test. He describes in detail the subsequent changes to the test's application following its inclusion in the Agreement on Trade-Related Aspects of Intellectual Property Rights, the Internet Treaties and European Parliament and Council Directive 2001/29 [hereinafter Information Society Directive].
