INSTITUTIONAL CARE
PAPÁČKOVÁ, Lucie
The aim of this bachelor thesis is to acquaint the reader with institutional care in the Czech Republic, performed in facilities belonging to the Ministry of Health, the Ministry of Labor and Social Affairs, and the Ministry of Education, Youth and Sports. Institutional care is one of the most important measures in which the State may intervene in family relationships. Minors have the legal right to secure a proper education and overall development. If the parents or family are unable to fulfill this legal claim, then the State is obliged to provide the child with an alternative rearing environment, either by assigning the child to the care of individuals or a facility for children requiring immediate assistance, and in the event of a necessity, also the most important measure: imposing institutional care. Priority is always given to individual care before institutional care, either with another individual, guardian, or foster parent. The Act also defines exactly where it's possible to proceed to extreme measures and impose institutional care. Given the severity of this measure, this decision only appertains to courts. No other governmental or non-governmental institution has such authority. This paper is aimed at introducing institutional care and the protection of children in the Czech Republic, especially highlighting the fragmentation of institutional care. The fundamental part of this paper describes the process of imposing institutional care, and especially its implementation in individual institutional facilities, differentiated according to the children's age, their physical and mental abilities, and the reasons why institutional care was decided on. The priority should always be the child's interest and welfare. This work also highlights the shortcomings of institutional care, particularly the lack of cooperation between the socio-legal protection of children and institutional facilities, the limited cooperation between government departments, the lack of suitable family recovery, and the small number of social workers and judges in the field. Finally, I also mention the achievements that brought about the transformation of institutional care, particularly the conversion to small family type facilities, surrounded by a network of services for the families of allocated children, the children themselves, and also other families who find themselves in a difficult situation. Not all children can be placed in foster care, not all families can be recovered. Especially for some older children and those who have gone through a specific life experience (abuse, repeated return from foster families), an institutional facility is an environment where they feel more secure and where they can fulfill their need to belong in a group of peers. In my work, I also want to draw attention to the current system of child care for children and youth, which does not address the period following the departure of young people from institutional care, although the stage of becoming independent is the most important for their future life.
Colaboration of Curator for Youth with Educational Institutions.

The author of this diploma thesis focuses on the issues of cooperation of the curator for children and youngsters with school institutions (especially schools). The aim of this cooperation and its subsequent description is to elaborate a multiple case study of selected students whose issues were so serious that the help of a curator was needed. The theoretical part of the thesis is focused on the behaviour of students that is so serious that it goes beyond the scope of regular pedagogical approaches conducted by the school. The system of institutional help, often at hand to schools in such situations, is described with respect to the function of the curator for youngsters. The practical part of the thesis provides the reader with a multiple case study of several selected students whose issues were so severe that the cooperation of a curator was required. A qualitative research was used to elaborate the study and the results were obtained by semi-structured interviews with the students' parents, teachers, specialized pedagogical centre workers as well as the students themselves.
Failure of a family as a factor for imposing educational measure

The aim of this work is to describe a family environment of children and of parents who took educational measures or were enjoined of an institutional upbringing, particularly from the point of their function. Another target is to ascertain weather the reason of misbehaviour of the children with educational problems is not a failure of some functions of the family or a dismal family situation. This work is devided into two parts, theoretical and empirical. Theoretical part is dedicated to a family, functions of a family, educational styles, problematic bahaviour of children, syndrom CAN and social and legal protection of children. Within the empirical part files of children evidenced at the Departement of social and legal protection in Český Krumlov are analysed. Subject matter analysis of this documentation was used and within in major reasons of ordering educational maesures or an institutional education were ascertained. It also inquires into a family environment of children and their parents.
Ethical aspects of substitute care in the context of legislation changes in the Czech Republic.

My work analyses the legislation changes in the area of social and legal protection of children in the Czech Republic that have been introduced over the last two years. This work focuses on impacts of these changes in the practice of transferring children to substitute care as well as ethical aspects directly connected with this process. Laws impacting the social and legal protection of children are being compared in order to understand the legal rights of children. The consequences of the legislative changes have a direct effect on the processes of handing children to substitute care. The work is not only concerned with the practical impacts, but also with the ethical side of the problem which was identified as the most important in my thesis. Case reports from my own practice provide a complementary evidence to the reader to better understand the process of placement of children into substitute care both at professional and ethical levels.
Ethical aspects of operation workers in socially-juridical children protection.

First two captures of the dissertation´s theoretical part deals with socially- juridical children protection in Czech Republic. Closer look into the history, legislative moorage and scheduler task safeguard. The separated area is devoted to operational workers in socially-juridical children protection of the Civil Service system. Third chapter offers brief look into ethical subject in social - work. Attention is especially devoted to ethical propositions and ethical dilemmas. Practical part contains presentation of a questionnaire survey from Council of the Pilsner region, where socially-jurisprudent workers took part in. Its target was to discover what role plays ethical aspects in activities of these social workers. Investigation should bring an answer for the question if ethical aspects are consider to be important for socially-juridical operational workers and if operational workers uses them and are methodically dedicated to them and if not, what it could be the cause.
Multidisciplinary cooperation of the body for social and legal protection of children seated in Tachov with other selected authorities in the field of children at risk

The thesis focuses on the multidisciplinary cooperation in the area of the social and legal protection of children at risk. At the beginning, the theoretical notion of the child and the child at risk are defined as the concepts essentials in terms of the focus group of this thesis. The next chapter describes the existing social and legal protection of children, including its legislative definition, who is being protected, which subjects can provide these welfare services as well as the application of social work in social and legal protection of children. The second part examines three forms of multidisciplinary collaboration: a project of system early intervention, rehabilitation of families and case conferences. Individual types are primarily defined in theory, followed by a description of their functionality on the example of the Tachov town. The Annex section presents nine case reports, including their evaluation, that describe multidisciplinary collaboration through case conferences implemented by the authority for social and legal protection of children in Tachov.
Foster care of relatives in the Strakonice district.

Abstract Foster care of relatives in the Strakonice district. This seminar paper is focused on an alternative family care with a special focus on grandparents to whom a child was consigned under the authority of §45 of family law or on the grounds of relational foster-care. These forms of care are the most suitable ones for a child in a difficult life situation. That is because the child remains in his/her own family where his/her own identity is preserved. The goal of this paper is to map the quantity of children who have been consigned into relational foster-care in the Strakonice area in the period from 2005 to 2010. This goal is supplemented by two fractional goals. The first one is focused on the fact who is the first one to take care of the child in need and the second one tries to find out the most common reasons that lead to the take away of a child from its biological parents. This research was realized at the departmentats of social-legal protection in the Strakonice area. It was performed by method of analyses and comparison of documents. This work mainly points out the actual situation in relational alternative parenting in the Strakonice area.
Possibilities for NGOs to participate in implementation of projects on socio-legal protection of children.

In recent years, the social and legal protection of children has been much discussed and talked over by the general public. To a considerable extent that is definitely a result of the upcoming amendment to the Children?s Social and Legal Protection Act No. 359/1999 Coll., which is going to bring numerous changes regarding individuals taking part in the social and legal protection of children. The opening focuses on governmental and non-governmental organisations that cooperate with families. The social and legal protection of children, its structure and historical course are analysed and the issue of child neglect as well as the procedures of the children?s social and legal protection authorities and further cooperating subjects are specified. Family redevelopment is another point which is aimed at. Important constitutional and international documents related to the social and legal protection of children are described. Last but not least, the ethical code of a social worker is mentioned, which represents one of the fundamental documents in social work. The objective of the research lay in monitoring the circumstances of the cooperation between the Children?s Social and Legal Protection Authority (OSPOD) and the non-governmental non-profit organisations (NNO) in the Regions of South Bohemia and Pilsen. The thesis analyses the effects of the cooperation between the OSPOD and NNO and compares the attained experience of the subjects taking part in family redevelopment. The research questions of the thesis focused on cooperation negotiation between the children?s social and legal protection authorities and non-governmental non-profit organisations, determining strengths and weaknesses of such cooperations. Having processed the obtained data it was found out that the form of cooperation negotiation between the OSPOD and NNO is not cohesive. It takes place upon an individual agreement between individual OSPODs and NNOs. Additionally, the strengths and weaknesses of the cooperation between the OSPOD and NNO were further specified based upon the carried out research. To complete the task, a questioning method of dialogue was selected for the research. Half-standard discussions with the workers of the children?s social and legal protection authorities as well as non-governmental non-profit organisations took place in the Regions of South Bohemia and Pilsen.
Overview of facilities for children who need immediate assistance in the Czech republic and specification of the Fund for children in need facilities.

The thesis is focused on facilities for children who require immediate help (ZPDVOP) as an instrument of a socio-legal protection of children in the Czech Republic. The introduction describes the importance of a family, family disorders, fundamental legal instruments on children?s rights and socio-legal protection of children, including the legal framework of facilities for children who require immediate help. The objective of this work was to present basic information on facilities for children who require immediate help in the Czech Republic and to describe the specifics of these facilities that are run by the Fund for Children in Need. Quantitative research, the method of document analysis and the technique of secondary data analysis were applied to prove the hypotheses. The data obtained in the research were processed and diagrammatized. To describe the Children?s Centre of South Bohemia and another facility called Klokánek, in Hostivice, qualitative research, document analysis and secondary data analysis were applied. The method of a questionnaire and the technique of a half standardized interview were used during the visits to these facilities. Two hypotheses were being checked. The first hypothesis, claiming that the number of facilities in particular regions is not equal to the number of citizens, was proved. The other hypothesis, claiming that the organizational structure of the Fund for Children in Need differs from the structure of facilities run by other institutors, was also proved. Two hypotheses arose from the qualitative research: children who stayed in Klokánek were more satisfied than children who stayed in any other facility for children who require immediate help, the work in Klokanek is more demanding than in other facilities, the number of children who return back to their families is higher in facilities that are run as children?s centres than in Klokanek facilities. This thesis can serve as an outline file on facilities for children who require immediate help in the Czech Republic and also as a background for further research in this field.
