Kinds of punishments according to the Criminal Code

The theme of this bachelor thesis is incorporated into the field of criminal law. The main goal is to describe the issue of punishments or the kinds of punishments under the Criminal Code. There is an explanation of basic concepts of this area, namely crime, facts of the crime and its signs in the first part. The next part of thesis deals with the basic provisions relating to punishments and the general principles for imposition of punishments. Subsequently, the work contains a list of punishments. The most important part of the work is determined especially for selected kinds of punishments which are discussed more detailed. The methodology of this thesis is mainly descriptive.
Crimes Related to Business

The target of this Bachelor thesis is to provide the main information about the economic crime and about the crimes related to business. The first part deals with the term "economic crime", clarifies some of the basic principles of criminal law and analyses the merits of the offense in general terms. The second part is engaged in the characteristics of chosen crimes related to business, adduces examples from practice mediated by jurisprudence of the High Court and offers the basic statistic reviews of committed crimes in the years 2010 - 2012.
Types of sentences under the Criminal Code

This thesis deals with sentencing for criminals. The first two chapters deal with crime and the offender, the third chapter focuses on the principles of sentencing, and the fourth one characterizes the penalties and highlights problems that appear while some of them are sentenced. The fifth chapter gives basic statistics of punishment and the last one occasionally works on protective measures.
Property crimes-theft and embezzlement

The bachelor thesis deals with property crimes, specifically with theft and embezzlement/misappropriation. The main goal is to thoroughly analyze and describe both criminal offences and also highlight the differences between them. A substantial part of the thesis consists of case law that is relevant to the topic. The first chapter engages in the general definition of property crimes, the specific protection of property included in head V. and futher in other heads of the Criminal Code. The second chapter is directly concerned with the crime of theft (§ 205), ie. its definition and the provisions of individual paragraphs. The last chapter addresses the characteristics of the crime of embezzlement (§ 206) and again describes the single paragraphs.
Insolvency Crimes

This thesis deals with the special category of crimes related to the bankruptcy of the debtor and to the insolvency proceedings. The first and second parts of the thesis are devoted to the general introduction into the both law branches, i. e. into the insolvency law and criminal law. The third part of the thesis focuses on interconnection of the mentioned law branches reflected in the category designed as insolvency crimes. The thesis analyses particular crimes utilizing the legal acts, technical literature and judicature. The fourth part handles the available statistical data regarding the insolvency criminality provided by the Czech Police. At last the thesis evaluates the social harmfulness of the insolvency crimes, its legal regulation and the protection against it.
The probation and mediation service, alternative punishments in the Tábor region.

The submitted bachelor degree essay deals with activities of the Probation and Mediation Service and alternative sentences in the region of Tábor. The main purpose and question at the same time was to find out the most frequent types of alternative sentences served at liberty and places where convicts could serve their sentence. The theoretical section describes the activities of the Probation and Mediation Service and terms related to this Service. It also comprises types of punishments, mostly the alternative ones, listed in the Criminal Code no. 40/2009 Coll. as amended. This section also contains a summary of Act no. 257/2000 Coll. on the Probation and Mediation Service. The practical section comprises two parts. The first part deals with the quantitative research; the questionnaire technique was applied whereas questionnaires were submitted to members of the Czech Police and to employees of the Probation and Mediation Service. 31 respondents participated in this research. In the second part a qualitative research by means of the non-standardized semi-controlled dialogue technique was performed. Four respondents who employ convicts serving a sentence at liberty participated in this research.
Criminal activity of the juvenile offenders

The theoretical part of my thesis focuses on explaining the concepts, including definition of responsibilities, and on development of work with offenders from retributive to restorative justice. It deals with the characteristics of youth crime, in particular by biological factors, age, gender, family and education. The practical part of my thesis utilises the methods of quantitative and qualitative combined research. The techniques included semi-standardised interviews completed with a non-aligned observation and secondary and content analysis of data from the files. The research sample consisted of clients of the Probation and Mediation Service in České Budějovice, who committed a criminal act in teen age. The research mostly focused on theft, quiet, whole and functional family background and students of the Secondary Technology and Automobile School in České Budějovice. The research has shown that young offenders are happy not to be in prison, and that they do not have sufficient legal awareness. All the set objectives have been achieved. Two of initial three hypotheses were confirmed, one was not. Hypotheses specified on the basis of research are: 1.) the most frequent motive of juvenile offenders to commit a criminal act is a sudden ?straying?, 2.) students of the Secondary Technology and Automobile School in České Budějovice, Skuherského Street 3, are the most common perpetrators of criminal acts in the district of České Budějovice, 3.) actively cooperating clients of the Probation and Mediation Service in České Budějovice are the most likely that the court would conditionally stop their prosecutions, and 4.) adolescents have low legal awareness. The thesis can be utilised for processing in professional magazines and publications or for the needs of further research, bachelor, diploma and other scientific works. Another possible use I see for the needs of practical application within the prevention of crime and for teaching purposes.
Comunnity Service Odere in South Bohemia Region

This work deal with the Community service order, its enactment given by the law no. 140/1961 Sb. (Criminal code) and 141/1961 Sb. (Code of criminal procedure) and by the changes concerning this punishment under the rule of law no. 40/2009 Sb. (Criminal code) with validity from 1.1.2010. Furthermore, the work deal with role of Probation and mediation service in verification of Community service orders with regard to routine in Southern Bohemia. In the end of the work are used a statistical data concerning the number of Community service orders in Sothern Bohemia in the years 2001-2009.
The Seal of Lantescien in the Context of Criminal Law

The thesis provides a concise explanation of the notions of confession and the seal of confession and observance of the same by Czech Republic criminal law. The seal of confession is especially provided for by Act No. 3/2002 Coll. on churches and religious societies. In my thesis, I also address the issue of protecting other types of non-disclosure recognized by the Czech Republic. The main topic covers respecting the seal of confession in the context of criminal law. I particularly concentrate on respecting the seal of confession in relation to Sections 167 and 168 of the Criminal Code concerning failure to prevent an offence and failure to report an offence. I also take note of the duty to testify and exceptions to the same. Whereas one of the exceptions{--}prohibition of interrogation{--}does indicate protection of the seal of confession, the other{--}the right to refuse testimony{--}includes no such unequivocal protection. Generally, Czech laws do recognize the seal of confession, and it is impossible to punish observance by priests of the seal of confession.
