Summary: Software Licensing The thesis deals with different practical aspects of commercial software licensing from the perspective of the Czech legal system. The focus is put on software license agreement as the most important legal instrument granting rights of use for computer programs. The thesis opens with a summary of Czech legislation in force in this area in the context of European community law and international law. The legislation in effect is largely governed by the Copyright Act. Coming into effect from 1st January 2014, the software licensing agreement legislation moves into the New Civil Code. The thesis deals with the changes arising from this transition. The fifth chapter considers the regulation of pre-contractual liability in the New Civil Code as it is especially important in protecting confidential infor- mation in pre-contract negotiation. In summarising the issue of software licensing, the thesis builds on the elements of legal relationship. It examines the roles of licensee and licensor, the two parties of software license. The text also deals with cases where a licensor of creative work is a different from the creator of the work. Copyright protection of software, software as a servis

This diploma thesis describes Czech legislation on copyright protection of computer programs in European and international law context. The commentary is mostly focused on current, practical issues, which often aren't clearly and satisfactorily solved, or issues which are subjects of current or recent litigations before European courts. First chapter introduces special characteristics of computer programs in copyright law, shortly mentions other possibilities of their legal protection and outlines some problems connected with massive technology development and international dimension of these questions, which are enlarged in following chapters. It also defines basic terminology used in the thesis. Chapter two, called "Sources of international and European law" mainly focuses on international treaties and EU directives, on which current Czech copyright protection of computer programs is based. Following chapter describes Czech copyright protection of computer programs, respecting, in general, structure of Czech Copyright Act and simultaneously gives deeper look into selected up to date problems. It compares computer programs with traditional copyrighted works, explains i.a. concept of "employee's work" and closely focuses on author's moral and, mainly, economic rights. Diploma Thesis Abstract The aim of this thesis is to summarize the relevant means of protection of a computer program. My intention was to think and consequently write about the past and present of legal protection of computer programs of all sorts, aiming especially on czech status quo of this protection. The main source of rules was and still is the czech Author Act, but I've also tried to analyze other, mainly european, laws. Together with history of a computer program my goal was to put before-mentioned into a broader context. At the beginning of the thesis, after the explanatory and historical part, in the chapter about the subject matter of author law, the computer program, I'm trying to delimitate the differences between source and object code. In the process of writing this thesis, I've tried to summarize the relevant means of use, especially the action of installing a program, legal means and connotations of this process. Also I wrote about distribution of a computer program regarding author rights. Consequently I'm briefly analyzing the relatively fresh decision of Court of Justice of the European Union, which is about protection of a graphical user interface of a computer program. PREDICTION SOUND INSULATION PROPERTIES DIVIDER BUILDING STRUCTURES AND SECURITY ACOUSTIC COMFORT INSIDE BUILDINGS

This thesis deals with the properties of soundproof partition structures in the low-frequency sound at impact sound insulation and security of acoustic comfort inside buildings. The prediction of impact sound is a simulation laboratory measurements of impact sound. The work is based on the occurrence of frequent complaints of inhabitants of residential homes for subjectively poor impact sound insulation of horizontal dividing structures, whose top layer is formed laminate. Although these structures conform in terms of impact sound insulation in accordance with the requirements of CSN 73 0532: 2010, residents complain about the subjective perception of the sounds of lower frequencies. A noise with a distinctive character of sound at low frequencies has been proved by measuring the spectral analysis and evaluation of sound pressure levels caused by the movement of persons roof construction to the floor. On the measurement and evaluation carried out in accordance with the measurement and evaluation of noise in non-working environment can be related requirement under the Regulation No. 272/2011 Coll. "On the protection of health from the adverse effects of noise and vibration." Occupational noise limits for protected buildings interior space do not apply to noise from ordinary use of the apartment. Under current legislation, the problem is in the Czech Republic at present insoluble. Therefore, this work explores ways evaluation of impact sound and delivery is determined conclusions. With the low-frequency impact sound insulation is also related to the latter part of this dissertation, where the computing program ANSYS (version 14.0) is simulated laboratory measurements of impact sound insulation of the real structure. The paper presents the results of simulation, and the sound pressure level in the receiving room to třetinooktávového band 630 Hz. These results are compared with measured values modeled in the laboratory.
Program for design of CATV

The main task of this master’s thesis is to create an interactive computer programme for the design of small and medium television cable circuits. The first part of this document describes main conceptions of a modification and a distribution of television signals. There are also introduced basic topologies of small and medium sized distribution networks, some passive and active elements in the circuit including their usage. There is also described an algorithm for calculation of circuit’s values. The second part contains a detailed description of created programme with all of its functions. A part of this document is made by a sample calculation of the four variants of circuit and its comparison with computer calculation. In suplement are included selected parts of source code.
Digital controlled resistor

This master´s thesis deals with the design of the control circuits for digital potentiometers and their application in analog systems. Digital potentiometers are three-terminal resistors with an adjustable center connection. The digital potentiomneters enable to drive logic gates, LED drivers, LCD drivers, analog switches etc. Controlling of these mentioned devices is possible by the I2C 2- wire serial bus (invented by Philips). The digital potentiometers are used to control of the primary parameters like cut-off frequency and quality factor in the state variable filter and cut-off frequency in a passive filter. Both filters are simulated in PSpice and then compared with the measured results. Next parts of this master's thesis are a computer program and a exemplary protocol.
Open licenses and their compliance with the new private law (new civil code)

Computer programs are widely licensed under open (public, open source, free) licenses. This thesis examines whether the open license (especially GNU GPL) is in compliance with the Czech law and which business models are used to generate profit distributing open computer programs. On the basis of analysis of legislation, case law and doctrinal literature the author assesses whether open licenses are admissible under the new Civil Code. The thesis also provides an overview of commonly used business models for capitalizing open computer programs.

Possible means of legal protection for computer programs and perspectives of future development

This theses focuses on the possible legal protection of a computer program as well as on the legal nature of computer program as an intangible asset. Both copyright protection (as a standard and worldwide accepted means of protection) and also the other possibilities, i.e. patent protection and protection based on provisions regulating an unfair competition are discussed. Each means of protection is assessed based on its usability in relation with the computer program taking the overall impact on the information technology branch as such into account. Furthermore, this theses involves critical evaluation regarding the capability of traditional model of distribution and protection of computer programs to face the rapid technological development in the digital era. With respect to this fact some alternative models (SaaS, Free Software) are cited and an analysis of their practical applicability and perspectives of the future development is conducted
Intellectual Property - Case of Information Technology

This theses analyses necessity and legitimacy of existence of intellectual property rights, especially patents and copyrights. There is shown the true essence of these instruments as monopoly privilege. On case of information technology I demonstrate that these privileges are unreasonable and counterproductive in many cases. Analysis of ?free software? alternative model proves that use of patents and copyrights is not a necessary condition of creation of intangible goods. The last part of this work shows, that existence of any special instruments for intangible goods protection is not needed as well as it is not reasonable.
