Public procurement practise in the Czech republic

The thesis is focused on the procurement process in the Czech Republic from the perspective of the contracting authority and analyzes legislation in the field of public procurement, understandable definition of certain institutes in the field and evaluation of individual species and tender procedures. The aim is to bring the very essence of a procurement process at the local government level. The theoretical part explains the most important legal concepts and basic principles of contracting procedures. Furthermore chronologically describes the whole procurement process, including analysis of partial processes for selected types of procurement procedures. Results of the work is devoted to the questionnaire survey and controlled interview.
The Public Procurement for the Supplies

The thesis deals with the theme of procurement of supplies in the Czech Republic from its beginnings to the present in the context of legal and economic developments. The current situation is analyzed on the basis of the Public Procurement Act, in connection with monitoring the preparation and adoption of new legislation. Legal issues will be extended by an overview of relevant laws and evaluate the problems in the formation of tender documents for the conclusion of framework agreements for the supply and reviewing compliance with the principles of the Act on financial control in public administration. Theme in the application of profiling on public procurement, focusing on a framework agreement designed to capture recurring delivery. The study is supplemented with practical experience in the field of public procurement for the conclusion of framework agreements, provides an analysis of the positive and negative aspects of this method of procurement, including proposed solutions. The practical part is elaborated on the basis of a comparison of the specific tender documents with the statutory legislation, qualitative research and secondary data analysis of tender documents for contracts to supply a valid framework contracts signed by the selected organization in the years 2012-2016.

Administration of public procurement

The thesis is focused on proposing changes in methodological procedures relating to the public tendering administration in the selected institution and consequently also changes in the relevant legislation, especially in the terms of principles, which a public tendering authority must implement under the Act no. 137/2006, on public tendering. The work contains a theoretical and practical summarization of legal steps according the current legislation and a proposal of changes in the form of amendment of the public tendering act. Since dealing with this issue for many years, it was my attempt to incorporate my own practical experience and knowledge into the proposal of these changes. The thesis is divided into three thematic parts. In the first part there is an introduction of a summary of basic rules and procedures in public tendering since 1990 till present, i.e. the act no. 137/2006, on public tendering. The second part focuses on a practical example of the public tendering procedure. The third part contains the proposal of changes in rules and procedures leading to the promotion of equal treatment, transparency and non-discrimination in public tendering, as well as of their practical application.

Cílem práce je praktická aplikace změn vedoucích k posílení zásad rovného zacházení, transparentnosti a zákazu diskriminace při zadávání veřejných zakázek; mezi tyto řadíme mj. požadavky na prokázání splnění kvalifikace dodavatele, návrh nových hodnotících kritérií, stanovení % u mimořádně nízké nabídkové ceny a sjednocení a zjednodušení úkonů zadavatele (jejich vzájemná návaznost). Dále je cílem snaha o zmapování úkonů veřejného zadavatele, které musí administrátor veřejné zakázky v souladu s platnou právní legislativou v České republice, tj. zákonem č. 137/2006 Sb., o veřejných zakázkách (dále jen zákon) realizovat v rámci jednotlivých zadávacích řízení veřejných zakázek, a následný návrh změn, vedoucích k posílení zásad rovného zacházení, transparentnosti a zákazu diskriminace při zadávání veřejných zakázek a návrhu postupů, které by umožnily "sblížení" zákonných postupů a praktické stránky.
Outsourcované (externí) evaluace veřejných výdajových programů

The dissertation thesis deals with evaluation of non-investment public expenditure programs. The main aim of the thesis is to draw a set of relevant recommendations for proper construc-tion of public tender specifications, which are used to tender external evaluations. The author performed a research with the usage of empirical and statistical methods on a sample of tender documentations and evaluation reports, which were carried out for ESF operational programs 2004--6 and 2007--13 in the Czech Republic. Author also used a case study of an evaluation performed on Objective 3 Single Programming Document (Prague), co-financed by the ESF in the period 2004--6. In addition to the main objective stated above, the thesis includes data on real public tender documentations and evaluation reports. The output is represented by data on estimated prices of external evaluation, tender documentation contents and also on methods and techniques, which were used in the evaluations examined. Such set of empirical data has been scarcely found in recent studies, which adds to usability of this thesis for expert audience. External evaluation is an expert project financed with public resources, carried out through public procurement. Based on the model process of such evaluation, the author searches for preconditions of realizing an efficient external evaluation. Efficiency and its factors then become main subject of research. As a key factor of performing an efficient evaluation through public procurement, the author identifies the tender documentation and its qualities. This thesis contains a research performed on a sample of evaluations of five programs co-financed by the ESF in the Czech Republic. Examined tender documentations contained serious drawbacks, namely incomplete and inexact definitions of expected outputs, missing list of required methods for the evaluation and also missing scale of statistical samples for the research. Quantitative tests also did not prove any dependence of estimated price of the evaluation stated by the tenderers on pre-defined cost-effective factor. The thesis ends with summative conclusions of the drawbacks and, in accordance with research findings, brings a set of methodical recommendations for proper construction of public tender specifications of an evaluation, which may lead to increase in efficiency of tendering external evaluations.

The diploma thesis describes a process of public tender for building contracts from a construction company’s perspective. The theoretical part introduces the basic concepts and procedures encountered during issuance, awarding and completion of public tenders. The necessary procurement rules and guidelines are also included. The practical part defines an actual tender offer from a particular contractor. The tender in question is a construction of leisure centre in Ratiskovice.

Planning and implementation of construction project by the contractor

This thesis deals with the planning and implementation of construction project by the contractor. In the theoretical part, I wrote the basic concepts of project management, construction participants and temporal models of construction. Furthermore, I focused on the public procurement and its by tendering documentation. In the practical part I focused on a specific project, where I proposed an alternative course of the contract and the contract followed from its very beginning to evaluation.
