Protection of domain names Life nowadays is much more dependent on information and the most common source of them right now is Internet. One of the main aspects, that users of Internet have to deal with, is a domain names, as a website address. Nevertheless it's common, that users do not differentiate between internet, browser, search engine or web page, nor are familiar with the legal and technical concept of domain names. Domains are allocated according to a first come first serve basis and that makes them valuable article and thus subject of common legal disputes. The purpose of my thesis is to analyze ways of legal protection of domain names and the absence of its legal regulation, which is not unique for Czech legal system. First chapter of my thesis deals briefly with internet and its basic infrastructure, including internet protocol, with deeper focus on domain names, their technical aspects, hierarchical structure and typology. Next chapter mentions the main organizations involved in creating rules and policies for cooperation among institutions authorized to oversee internet and managing the registration of internet number resources and domain name system. Protection of Domain Names (master's degree thesis) The purpose of my thesis is to analyse a legal interpretation of the domain name. The thesis analyzes the theoretical base of this term, authorities competent to constitute rules on the market of domain names and to decide how to judge corelated disputes, attention is also drawn to the conflict of protected names and domain names. The important question to be answered is the eventual social significance of a juridical framework of domain name. The question of domain names (and also other institutes connected with internet) is a widely discussed and disputed topic. The last three decades the rules and the execution of them were constantly developing and underwent major changes. Therefore it's very interesting to watch this progress and to compare the many different points of view on the whole issue. Those were the main reasons for my research. The thesis consists of seven chapters. Chapter One, Two and Three are introductory, they define the term 'domain name', its function and structure. Legal protection of domains in relation to the right of indication The subject of this thesis is a legal protection of domain names. Domain names are used as humanly memorable names for Internet and serve as simple address to access websites. Each domain name has to be unique, it is not possible to register two or more identical names. This makes them very valuable and worth of protecting. The registration process of domain names is very simple and cheap, mostly based on the principle "first come, first served". No one has an automatic right to a particular name. This cause many conflicts, because the principles of registration are often abused by domain speculators. However, the domain names are not subject of special legal regulation in the most countries (Czech republic included). The thesis is composed of two parts. The first part is divided in five chapters. Initiative chapters are focused on defining the concept of domain names, their technical aspects, hierarchical structure and types. Traditional and new legal concepts in the environment of internet network

The internet has become the biggest phenomenon of last two decades. In a significant manner it affects our society and changes its behaviour in private, commercial and public life. Through an easy connection with almost any part of the world our current society has become global indeed. Facilitation and significant acceleration of communication and transfer of relatively large amount of data bears many difficulties and risks. Therefore this thesis is focused on some aspects and corresponding legal concepts, including those, which are of entirely new nature because of the internet evolvement. The work is divided into four main parts according to areas they are related to. First one introduces general matters of the internet, its formation and fundamental issues of its structure, operation and legal consequences. Next part describes the internet from the scope of copyright and impacts on this legal concept. This thesis addresses the question of legal institutions of intellectual property rights to protection against unfair competition. In particular, discusses the right to mark, its individual subjects and disputes arising from them. Through case law, administrative decisions and decisions of special established bodies points to the fundamental aspects of unfair competition from the perspective of industrial rights. Above all, it deals with trade marks, domain names and trade names.

In the diploma work, there are examined domain names, which have become, due to a mass development of the Internet, an economically very valuable estate. Domain names lack, although being a generally known notion, any legal anchoring in the Czech system of law. The absence of legal regulation of domain names is not an anomaly of the Czech legal environment, but it can also be seen in the states with advanced legal culture. Domain names fulfill, in addition to being a very valuable commercial article, identification and/or promotional functions. Just for those reasons, the domain names need to be provided a corresponding legal protection. The introductory part of the diploma work, containing an introduction into the issues of domain names, addresses technical aspects of domain names and the method of their hierarchical structuring. Further, the diploma work contains a list of institutions which play, in the area of domain names, an important role for various reasons. Diploma thesis focuses on the analysis of the functions of domain names by the methods of website monetization. The individual types of domain names are associated with the effects resulting from the domain operation and other intangible assets that usually cooperate with the domain as a whole. Conclusions of the thesis are demonstrated in the analysis of intangible assets of the company ADSL s.r.o.
Qualitative factors affecting the value of a domain name

Domain names are much discussed issue these days yet not that well understood by Internet users. Diploma thesis Qualitative factors affecting the value of a domain name, as the title suggests, focuses on technical and marketing elements of the domain together with the content of websites and their influence on the value of domain names. In the first part there are different factors and their influence described in theory, the practical part then applies to a specific case for domain Nemovitosti.cz. This domain was compared in terms of market, competition and their technical and marketing site. To support factors related to website content, statistics put inside the website were used as well as freely available online tools. After evaluation of all factors Nemovitosti.cz domain, the author concludes that the domain is valuable in its field and its value in the future due to investigated factors will increase.
Legal means against violation of intellectual property rights

This thesis is dealing with legal means for enforcement of intellectual property rights. It is focused on rights to marking, namely trademarks, indication of source, apellations of origin and domain names. The work analyses and characterizes individual legal means and shows possibilities of their use. There are presented procedures of enforcement of rights to marking, definitions of terms and practical examples. The works concentrate not only on Czech legal regulations but also on legal regulations of the European Union and legal regulations of international institutions such as for example agreement TRIPS.

Diplomová práce vytváří přehled o mezinárodní ochraně práv na označení. Náplní je mezinárodní právní úprava obsažená v nejpodstatnějších mezinárodních smlouvách, jakými jsou například Pařížská unijní úmluva a Dohoda TRIPS. Je zde uveden popis možností získávání právní ochrany, postupů vynucování práv na označení, definice pojmů i praktické příklady. Práce podává rozbor činností mezinárodních organizací působících v oblasti mezinárodních práv na označení. Tématem jsou zejména ochranné známky, zeměpisná označení, označení původu a doménová jména. Práce se může stát průvodcem pro subjekty, které se potřebují orientovat v oblasti mezinárodních práv na označení.
