Legal issues of payment services regulations

This work focuses on examination of legal issues of payment services including the regulation and supervision of this area, i.e. inspections and enforcement of regulation set by the state and authorized public institutions. The whole thesis is divided into five chapters, which are then partitioned into individual chapters. The first chapter is called general introduction to the topic and deals with the basic definition of payment service, its development, forms, payment instruments and participants. The second chapter focuses on the importance of regulations relating to the payment services and related regulation of international payments, including the relevant international conventions in this field. The third chapter analyzes the legislation in payment service's area in the Czech Republic from the viewpoint od de lege lata and de lege ferenda. The fourth chapter deals with supervision over payment services, i.e. possible methods and models of financial law supervision and analysis of specific supervisory authorities in payment service's area. The fifth and final chapter describes the supervision over the banking sector.
Activities of providers of financial services regarding the suppression of legalization of crime proceeds and terrorism funding

Suppressing the legalisation of the earnings of criminal activities along with the terrorism financing represent the essential aspect of terrorism and predicative crimes (from which the illegal earnings are obtained) prevention. Focusing on concealing the tracks of money transfers, the legalisation of the earnings of criminal activities and terrorism financing is being proceeded throughout a series of money transfers and with the help of other financial services. Therefore, it is crucial to mainly focus on the field of payment services providers when trying to supress these activities. For the purposes of supressing the legalisation of the earnings of criminal activities and terrorism financing the banks and other bodies on the financial market are relevant providers of the payment services. The key legal provision regulating the domain in question is the Act no. 253/2008 Coll. (regarding certain precautions against the legalisation of the earnings of criminal activities and terrorism financing) which puts the payment services providers in the role of liable subjects. Payment services and their legal regulation

The diploma thesis "The Payment services and their legal regulation" deals with payment services, their definition and description of the legislation. Furthermore it treats payment services contract and focuses further on payment transactions (transfer of funds), in particular payment orders and their requirements. The aim of the paper is analysis of various payment services and related institutions, including a short presentation of persons authorized to provide a payment service. The paper itself consists of introduction, three chapters and conclusion. The author presents the topic and his motives along with short example of literature in the introduction. First chapter deals with a theoretical introduction to the topic and explains key concepts and relations, including specific notion of payment (contact). Furthermore, the first chapter includes description of the persons authorized to provide payment services and introduces legislation dealing with payment services, including European legislation and its comparison with the preceding regulation covering payments. Analysis of Payment Services

Bachelor thesis analyzes payment services in the Czech Republic on the basis of empirical figures. It focuses on cashless payments. Thesis also presents innovations and modern options in the area of payments with aim to be a benefit not only for professionals, but for general public as well. At first it familiarizes with terms used in payments area. As next it deals with legislation, various laws, which regulate payments in Czech Republic, followed by presentation of innovative instruments. In practical part it follows up analysis of monetary means of electronic money and payment card instrument. Compares transaction volumes in our country with abroad countries and analyzes their overall utilization. In the end thesis evaluates selected products and services of banks in term of price.
Financial arbitrator of the Czech Republic and his role in consumer protection

The thesis discusses the financial arbitrator of the Czech Republic as an institute of alternative dispute resolution on financial markets and his purpose in protection of consumers of financial services. First, the legislative framework of consumer protection is described, especially new Czech law on consumer credit. Then, the financial arbitrator itself is discussed, along with proposed changes of the institute. Finally, the thesis compares the Czech financial arbitrator with similar bodies in other member states of the European Union - France, Slovakia and Ireland. The thesis also includes the author's personal reflections on the matter.
