Method of resolving insolvency with emphasis on reorganization

This thesis describes the problematic of the individual ways of dealing with bankruptcy. The first part is concretely dealing with all method of resolving insolvency with emphasis on reorganization. The concept of reorganization was introduced by the new Insolvency Act. I focus also on comparison of the reorganization and the bankruptcy. The second part of my work includes analysis of reorganization in practice. I chose the company Kordárna, a.s. for describing reorganization process. I found the reorganization more advantageous to the creditors. Nevertheless the reorganization is less used than the bankruptcy. The reasons are the high costs, the shortcomings of insolvency law, necessity of consensus and some non-confidences to reorganization.
Restructuring and rescuing Odevni podnik Prostejov, a.s.

The topic of the bachelor's thesis is application of the new Insolvency Act No. 182/2006 Coll, as subsequently amended, which is a crucial contribution to the Czech insolvency law offering new ways of settling debtor's bankruptcy. I point out the differences between the currently effective Insolvency Act and the preceding Act No. 328/1991 Coll, about bankrupcy and liquidation, as subsequently amended. In the theoretical part I describe the most important features of a insolvency proceeding and also the process and the possible ways of setlling bankruptcy. The aim of the empirical part is then to describe and evaluate the solving of the situation during the insolvency proceeding of the Odevni podnik Prostejov, a.s. in 2010 up to the present day, with the use of the new Insolvency Act.
Reorganization in Czech bankrupcy law

In tried to describe a rescue principle in Czech bankrupcy law in this work. I mean reorganization as a solution of the bankrupcy. I describe economic motivations of the single participants of the insolvent process in this work. I also describe priciples of this process. I try to ilustrate these principles on the instant case of bankrupcy. I picked up Sazka a.s. purposes. I made financial analysis of this company. I define key problem which went this company bankrupt. I focused on the biggest financial aces in this process and their moves. I tried to foreshow further development at the end.
Comparison of corporate bankruptcy solutions

The aim of this bachelor thesis is to compare solutions of corporate bankruptcy in the Czech republic and Poland. The content of this thesis are described insolvency proceedings in both countries and their following comparison based on international statistics. A benefit of this thesis is a different view on insolvency environment by help of comparison with Poland. The comparison criterions are the main indicators for evaluation of effectiveness of insolvency proceedings in both countries. The reasons for values of the criterions of time, cost and recovery rate of insolvency proceedings are stated with most imported causes for those values.

Insolvency law is a progressive and dynamic legal discipline closely interrelated with economics and business. A quality legal framework of insolvency is indispensable for modern market economies: it helps to identify companies or individuals in financial distress and to restructure their debts, or liquidate their assets in an efficient and transparent way. The main purpose of the insolvency law is to provide creditors and debtors with a ground for negotiations and to help them reach qualified decisions based on the available information. In the Czech Republic, the insolvency law had long been criticized for its insufficient protection of creditors and for the loopholes that made extensive property frauds possible without having the wrongdoers punished. The current Czech Insolvency Act which took effect in 2008 was broadly inspired by the U.S. Bankruptcy Code Chapter 11 and eliminated most of the weaknesses of the earlier law. This thesis shows that valuable inspiration can be found not only in texts of statutes but also in the real life. On the example of reorganizations of Kordárna and GM described here, main principles of insolvency law are being discussed.
Bankruptcy solution of ČBPS s.r.o.

The main goal of this Bachelor's thesis is describing possibilities of bankruptcy solutions in Czech Republic on the example of a czech company ČBPS s.r.o. Theoretical part deals with the insolvent management process accordning to the up to date version of the law about bankruptcy and its solution methods #182/2006. Practical part is engaged in description and evaluation of the ČBPS s.r.o. reorganization process.
Position and role of rescue battalions of Army the Czech Republic, their potentials and utilization at reaction planning to an emergency.

The military rescue divisions existed in different organizational structures in whole after-war history of the Czech Republic. The divisions operated on the military base and were intended for the performance of the tasks of the civil defence during state of war. In the peaceful conditions were the divisions used for the implementation of the rescue operations in the natural disasters and industry breakdowns or eventually for the help of the national economy. The military rescue divisions arose from the reason that there was built no Integrated rescue system in term of the history by the name of the army of the Czech Republic. Though the rise of the large armed conflict in the territory of the Czech Republic is not likely in the closest time horizon but there is the possibility of the attacking by the mass destruction weapons in the long term perspective can not be excluded. Safety situation has been getting worse from the global point of view and the recency of the threat of the asymmetric character is also increasing. These threats are mainly connected to the subjects organizing terrorist attacks whose objects are largely civil targets. These subjects exert more effort to gain the mass destruction weapons. The cold war was abandoned at the end oh the last century but the activity of the safety threats of the non-military character has been rising in the last years which is connected to natural and industrial disasters, organized crime, legal and illegal person migration, spread of the drugs, dangerous contagious diseases, disturbance of the information and control systems and exposure of the public order. It has gradually been happening to the transformation of the army of the Czech Republic which is dramatically connected to military rescue battalions that are individual part of the army of the Czech Republic. Owing to the possibility of the exploitation of these forces and means in peace or in the war conflict for the people´s protection or for the support of Integrated rescue system and sappers troop support I have decided to pay attention to the problem of the reorganization military rescue battalions in my bachelor´s work and to rectify if it has essential influence on ensuring emergency and crisis awareness on unexpected events in the south region of the Czech Republic.

It deals concretely with a situation when it was already decided by a court about an existence of a debtor's bankruptcy. It describes individual ways of dealing with bankruptcy. This bachelor thesis deals mainly with the insolvency law and options that this law provides for dealing with bankruptcy. Special attention is paid to proceedings of reorganization. The goal of this work is to revise reorganization in the Czech Republic and its loss and coins as an option for bankruptcy solution. Thesis is divided to theoretical part, which describes crucial aspects of insolvency proceedings and dealing with bankruptcy, practical part contains analyses the course of the reorganization of company Kordárna, which successfully went through reorganization in last year.
