Clinical trials of pharmaceuticals

This master thesis is a description of the clinical trial, which is part of medical law un- der the law aspects. This thesis is split to topic, whose a brief outline is in the introduction. Process of the clinical trial and their institutions are discussed under the law and medical aspects. Resources of this thesis are a professional literature, knowledge of experts from pharmaceutical company and my own experience from part-time job in this type of com- panies. Aim of the thesis is to bring more resources and information about that topic to experts and other people who are interested in. This thesis is devided into five chapters. First chapter is speaking about a general insti- tute in the clinical trial. There are listed sources of the law. In the next chapter I deal with the process of the clinical trial from the begining i.e. from the development of a new sub- stance through the clinical trial to the final registration. The chapter about the european law regulation is following. In the fourth chapter I deal with the ethical aspects, which are conected with clinical trial. Sound and audiovisual recording as means of evidence in administrative proceedings

The aim of the thesis is to answer the questions regarding the subjects authorized to take a sound or audiovisual record, and to assess the legality of using such records as evidence in administrative proceedings. The thesis is formally divided into three chapters. The first one addresses the basic concepts emerging throughout the thesis, and the admissibility of other evidence not expressly mentioned by law. The second part of the thesis offers an insight to obtaining of sound and audiovisual records, and their further use as evidence pursuant to the basic human right documents. It describes and analyses the assessment of permissibility of such evidence that is applied by the European Court of Human Rights. The last chapter works with national legislation of both public and private law, and with the case law of domestic courts; from which it infers the subjects authorized to take these records, which may be used as evidence by an administrative authority. Based on the analysis of legislation and case-law, the thesis defines subjects authorized to obtain a sound or audiovisual record, and sets conditions for such obtaining. Regulation of use of tobacco products

The subject of this diploma thesis is anti-smoking legislation in the Czech republic. This diploma thesis results from contemporary legislative changes regarding health protection against using the tobacco products. I described history of smoking and smoking bans, actualy activ and prepared legislation regulating using the tobacco product, offenses and misdemeanors, definitions, conections of smoking bans and human rights and liberties, legislation of the European Union and some european states. In the introduction I explain my view on the actual anti-smoking legislation in the Czech republic. I try to delineate, which problems actual legislation brings and which defictis has. The first chapter explains attitude of the society to smoking during the time, we can see, that smoking began being "normal" quite fast, and states did not reduce it at all. The second part compares human liberty and right to health. Next chapters contain actual legislation in the Czech republic - offenses, advertising and especially current change of act editing packaging and warning. The evaluation of effectiveness of Strategic plan Local action group Krajina srdce

This thesis deals with the topic of strategic planning and rural development. The target of research was a Local Action Group Landscape of my Heart. The aim of the dissertation was to evaluate the efficiency of the Strategic plan LEADER for the period 2007-2013. The analytical section is divided into two parts. Through a qualitative research - a standardized observation of indicators of development potential of settlements - it was found, that the selected variables (especialy value of grants invested in the municipality) had a negligible effect on the aesthetic appearance of villages. The second part of the analysis was performed using a quantitative method. Analysis of the statistical indicators of development found no correlation with the above evaluation of these indicators for the chosen variables. The selected research methods didn't prove noticeable efficiency of the strategic plan LEADER.
Liability for harm caused by maladministration

This diploma thesis focuses on the topic of "Liability for damage caused by incorrect administrative procedure" under Act No. 82/1998 Coll., on liability for damage caused within the exercise of public authority by a decision or incorrect administrative procedure and on the amendment to Act No. 358/1992 Coll., on notaries and their activities (Notary Act), as amended. Formally, the thesis is divided into seven chapters, which are further split into individual subchapters. The first chapter deals with the historical development of legislation governing state liability within the exercise of public authority and with current sources of law, including the introduction of literature. The second chapter focuses on the characterization of the liability as a part of private law and on the basic definition of the term "incorrect administration procedure". This term is generally defined as any procedure of a public authority excluding decision-making activities, which is in conflict with generally applicable legal regulations. The third and fourth chapters respond to the adoption of Act No. 89/2012 Coll., Civil Code, and analyse individual impacts of its secondary application to liability obligations. MicroRNAs are noncoding RNAs inducing sequence-specific posttranscriptional inhibition of gene expression and represent the major class of small endogenous RNAs in mammalian cells. Over 2,500 of human microRNAs potentially regulating more than 60% of human protein-coding genes have been identified. MicroRNAs participate in the majority of cellular processes, and their expression changes in various diseases, including cancer. Currently, there is no efficient small chemical compound available for the modulation of microRNA pathway activity. At the same time, small chemical compounds represent excellent tools for research of processes involving RNA silencing pathways, for biotechnological applications, and would have a considerable therapeutic potential. The presented work represents a part of a broader project, whose ultimate goal is: (i) to find a set of small molecules allowing for stimulation or inhibition of RNA silencing and (ii) to identify crosstalks between RNA silencing and other cellular pathways. Service of documents in administrative proceedings

V ANGLICKÉM JAZYCE The thesis focuses on service of documents in administrative proceedings. At the beginning of the thesis, the used terminology and constitutional framework are defined. The main part deals with the two main forms of delivery, an electronic and a documentary form. Regarding the excessive use of electronic communication in today's society, the electronic form is described in detail. Afterwards, the thesis deals with the issue of the service of documents to foreign countries and defects that may occur during the delivery. Many uncertainties and questions have arisen putting an information system of data boxes and using of data boxes for communication between entities and administrative bodies into operation. The author therefore dedicated a considerable attention to this topic. Attention is also paid to the institute of electronic signature. This institute was adopted in the Czech legislation in accordance with European legislation. Elaborating this thesis, the author used primary legal sources, literature both domestic and foreign origin, and public information sources.
Problematic aspects of public tenders from the perspective of a municipality

The problematic aspects of awarding of public procurement from the perspective of the municipality. The aim of this thesis is a presentation of certain problems associated with awarding of public procurement by public authority - the municipality. This thesis is divided into three parts. The first part provides a general introduction to the topic. This part defines the basic terms and principles associated with public procurement, attention is also focused on a definition of local government units. At the beginning of the second part a legal framework of public procurement and a brief view of the future legislativ is presented. The most important section of this part describes bodies of the municipality and their competences associated with awarding of public procurement. Thereafter it deals with mistakes and shortcomings which may arise during the tender process from the part of municipalities. In this part specific situations coming from the practical experience of municipalities are described and analysed, including a list of potential impacts on municipalities. Attention is also paid to current jurisdiction and decision making practices of the Office for Protection of Competition. The final part of this thesis summarizes the conclusions drawn in the previous chapters.

Status and activities of the intelligence services in the Czech Republic (legal aspects) My master's degree thesis attempts to analyse the status and activities of the intelligence services in the Czech Republic. Nowadays the importance of the intelligence services is steadily growing worldwide because of bigger threat of terrorists' attacks and worsening security situation in certain regions in the world. Czech intelligence services must adapt to this situation and that's why I started to investigate particular Czech legislation. I started to examine whether the Czech intelligence services are given necessary powers to fulfil their lawful duties, who governs and coordinates their activities, who controls them etc. All these questions are described and answered in the thesis. The thesis is composed of five chapters, each of them deals with different aspects of the status and activities of the intelligence services. - Position and activities of the Czech Bar Chamber The topic of my thesis is "Position and activities of the Czech Bar Chamber". The purpose of the thesis is to analyze the role, importance and functioning of the professional chamber which associates over of 12 000 attorneys. I have chosen this particular topic as I think the available literature dealing with professional chambers, particularly the Czech Bar Association (hereinafter CBA) is not up-to- date and does not comprehensively cover the current status of this institution. In addition to the descriptive passages the thesis includes statistical data analysis, reflections on the current state of the CBA and its possible transformation. The thesis is composed of five chapters; the first chapter is a brief introduction to the issue of self-government. It covers what this term means, explains the dividing of self- government and focuses on describing the related terms. The second chapter provides an insight into the history of attorney self-government.
