Summary: International Terrorism and Human Rights Key words: international terrorism, antiterrorist measures, human rights First part of the thesis is centered on characteristics of international terrorism, concept of human rights and three aspects of their mutual relationship: the immediate impact of terrorist attacks on human rights of their direct victims and the society as a whole and aspects linked to the states' response consisting of human rights breaches of suspects during repressive measures and curtailing the rights and freedoms of us all during preventive measures. Many states have tighten their current antiterrorist measures, introduced new ones and strengthened the powers of military and law enforcement at the expense of internationally guaranteed human rights and fundamental freedoms, argumenting with the need of neccessary trade-off between personal rights and freedoms and national security. Nevertheless, there are flexible institutes imbedded into international law that allow for realization of represive and preventive measures whithout compromising the guaranteed human rights. Maritime Piracy, its Suppression and Punishment

The text Maritime Piracy, Its Suppression and Punishment, analyses piracy as a classical threat to international maritime traffic, which has reappeared after being considered obsolete in a majority of the world for several decades. The text first discusses general questions connected with piracy - a definition of piracy according to public international law is presented. Consequently, the factual side of piracy is presented, since piracy still is a topic not very well-known in the Western world. In the following part of the text, the tools provided by public international law for suppression of piracy are analyzed, as well as possible ways of prosecution of persons accused of piracy. The final part of the text discusses the case study of Somalia. In Somalia, piracy has become a threat to international peace as well as a severe hindrance to international maritime trade. Despite the effort of the international community, the public international law has yet to find adequate solutions for the problem of piracy in Somalia.

The definition of terrorism in international law The subject of this graduation thesis is to explore problem of defining terrorism in international law. Although it is very broad topic, the thesis has attempted to explore most of the questions this issue has offered. First of all, it examines reasones why define terrorism in international law. Further this study provides information about perception of the term terrorism in the past depending on the political and social conditions and about how the terrorist attacks influenced the effort to find the definition of terrorism. The thesis pays big attention to regional treaty in which terrorism is defined and uses it as a comparison basis for finding the elements of the definition, since regional international treaty law has achieved the biggest success in this area. However, in the last two decades successes have achieved on universal level, especially by the adoption of the International Convention for the Suppression of Financing of Terrorism, which is the first universal agreement binding defines terrorism. Collective Actions of the UN Security Council for Protection of Human Rights

This thesis Collective Actions of the UN Security Council for the Protection of Human Rights deals with, as the title suggests, collective actions for the protection of human rights with the mandate of the UN Security Council. The thesis is divided into an introduction, conclusion, and four chapters. In the first chapter, the system of human rights protection is described, as it was set up within the newly-formed United Nations after World War II. This chapter also deals with collective actions of the UN Security Council, with or without the use of force, on a theoretical level, e.g. their authorization and possibility of measures that can be taken within the UN system against the perpetrator. Second chapter deals with examples of collective actions of the UN Security Council during the Cold War period. In this era, collective actions of the UN Security Council were authorized only twice, in case of South Africa as a reaction to their policy of apartheid, and in case of South Rhodesia as a reaction to the unilateral declaration of independence by the white minority government. The Legal Status of a Resistance Movement and the Analysis of its Acts Within the Israeli-Palestinian Conflict

The Israeli-Palestinian conflict brings up many questions considering and reaching into several different spheres, including the spheres of law. This thesis focuses on the question of the organized resistance movement against occupation and on its legal status. It is known that the inhabitants of every occupied territory are allowed to protect themselves and their territory from the occupier, thus they are allowed to resist the occupation and to claim a recognition of their resistance movement and of its acts as legal acts. Although the resistance movement is a well known term, there is no official definition of this movement and its legal framework is quite narrow; it only establishes the characteristics needed in order for its members to gain a status and a legal protection similar to the regular combatants. It is limited from its name that the resistance movement against occupation may only exists in the territory where an actual occupation takes place. Death penalty and the waiver of the right to life by committing an extremely serious crime

The aim of this thesis is to define, what is the position of right to life in the system of protection of human rights and whether is the death penalty a justifiable institute in international human rights law. The thesis focuses on the death penalty and its history in connection with the right to life as an inherent human right. It explores the conventions, protocols and resolutions that are related to the matter. The thesis is divided into seven chapters, whereas first of them is introduction, where the author asks questions about vindicability of the capital punishment. That is followed by a brief history of the death penalty and explanation of the purpose of the punishment. Following chapter looks into a view of international society on the death penalty, summing up views of international governmental organizations, as well as non- governmental. Fundamental part of the thesis is a chapter disserting on the right to life, its history, where we can find right to life in international law, interpretation of right to life and case law. Last chapter deals with an issue of a crime as an act of forfeiting the right to life. The analysis consists of criticizing the conclusions made in the course of the thesis and propositions of further possibilities.

An impact of case law of the European Court of Human Rights upon the legal system of the Russian Federation

One of the key issues discussed over the last few years in connection with the ECHR is a large number of individual applications lodged to the court although the court does not have sufficient capacity to resolve them. The majority of the cases falls into category of so- called repetitive cases. This thesis aims to identify the tools, ECHR disposes of, and to what extent those tools may affect national legislation and case law of national courts. Reforms of problematic institutes at the national level implemented as a result of the ECHR decisions are able to exclude the future influx of repetitive cases to this transnational judicial authority. The process of the influence of ECHR case law on national legal systems is analyzed on the example of Russian Federation, which currently holds the first place regarding the number of individual applications that have been filed with the ECHR.

The bachelor thesis introduces the role of medical-social worker/social worker during the process of planned release of geriatric senior from medical department. It results from demographic prognosis that the number of seniors in higher age will grow up constantly. Therefore the connection between social and medical area is important to ensure a quality and dignified style of life. The subject of geriatrics specialized in ill senior as a person with biological, psychological and social peculiarities. Health and social worker, who is a member of geriatric team, assists in ensuring this style of life by planning the process of release from medical department to senior's natural environment. The worker involves in this process senior's family and he applies his knowledge of social services, attitudes and methods of social work. Summary: Responsibility for the United Nations peacekeeping operations The purpose of this thesis is to analyze an issue whether the United Nations (UN) or troop contributing countries are responsible for the conduct of military contingents in the UN peacekeeping operations. The thesis focuses solely on UN-led operations and on peacekeeping forces - military troops contributed by member states in whole contingents, rather than as individuals. The reason for focusing on peacekeeping forces is their unique hybrid legal status. While they remain in the service of their states, they become for the period of their assignment international personnel under the authority of the UN. This thesis is composed of four chapters. Chapter one describes the meaning and the legal basis of peacekeeping operations and defines which types of operation are subject of the thesis. Second chapter deals with general rules governing international responsibility of states. Chapter three examines legal personality and responsibility of international organizations, in particular the UN. These two issues are closely related because for an entity to bear international obligations, it must first be established that the entity is a legal person.
