TAKING OF EVIDENCE ABSTRACT This dissertation deals with the process of taking of evidence in the civil proceeding, while focusing primarily on the contradictory procedure. The differences between the contradictory and non-contradictory procedure are also being highlighted. The taking of evidence is considered a fundamental part of the civil proceeding, upon whose course and outcomes the judicial decision is being based. In the contradictory procedure, the activity of the party to the proceeding plays a pivotal role in the taking of evidence, which follows primarily from the underlying adversarial principle. However, the importance of the activity of the party to the proceeding in the taking of evidence shall not be entirely dismissed in the non-contradictory procedure either. Nonetheless, the non-contradictory procedure is governed by the investigation principle, with the sole responsibility for the taking of evidence vested in the court. Taking these fundamental differences into account, I analyze the specifics of the contradictory and non-contradictory procedure, which manifest themselves within the sphere of procedural rights and obligations of the parties to the civil proceeding as well as in the distinct powers of the court in the process of taking of evidence. Payment order proceedings Abstract This thesis aims to analyze in detail and subject to critical legal analysis the various types of payment order proceedings, compare domestic payment order proceedings proceedings with analogous legal institutes abroad and submit proposals de lege ferenda. The work is divided into six chapters. The first chapter is focused on a short historical excursion and an introduction to some foreign legal regulations of payment order proceedings. The second chapter is devoted to simple payment order proceedings. First, the very concept of payment order proceedings and payment orders is defined as a court decision in payment order proceedings. The discussion of jurisdiction has not gone unnoticed. Subsequently, the preconditions for issuing a payment order and the application for issuing a payment order are analyzed in detail. The following considerations are focused on the fee obligations in the payment order proceedings. The following talk focuses on the content of the payment order and its individual statements. The possibility of including a call in the sense of the provisions of § 118a OSŘ in the payment order will not be left without attention. Závěr Oblast lidských práv se neustále vyvíjí a s ní se vyvíjejí i mechanizmy, které by měly zajistit jejich dodržování. Lidská práva hrají ve společnostech vyspělých zemí tak významnou úlohu, že jejich prosazování je někdy dovedeno ad absurdum. Příkladem toho mohou být některé kauzy ve Spojených státech, o kterých se čas od času dovídáme z tisku. Pozor je třeba si dát i na zneužívání lidských práv k jiným, než právem aprobovaným účelům. Největšími problémy, se kterými se v právní praxi setkáváme, jsou případy střetu dvou či více lidských práv či svobod, kdy nelze najít jiné řešení, než že se omezí jedno subjektivní právo, aby byl učiněn volný průchod jinému. V takovém případě je na zvážení příslušného orgánu, kterému ze dvou kolidujících práv dá v daném případě přednost. Že se nejedná o úlohu nikterak snadnou, dokládají i některé případy řešené Ústavním soudem, které jsem se snažil blíže rozebrat v této práci. Institut ústavní stížnosti považuji v demokratickém právním státě za nezbytný doplňující prostředek ochrany práv dotčených orgánem veřejné moci. The following diploma thesis is called "The writ of execution and authorization of a licensed executor". I have chosen this theme because this execution and execution procedure is a dynamically developing part of the civil law and has been changed substantially in recent years. I deal mainly with the legislation in regards to the petition for an execution order, an execution order as well as a termination of authorization of an licensed executor to carry out the execution. The aim of the thesis is to acquaint the reader with current legislation, compare current legislation with previous legislation and identify ambiguities and issues encountered in practice. The thesis is divided into five chapters. The first one is a preface and the last a conclusion. The second chapter deals with the petition for an execution order, especially requirements, defects and their remedies. Further, I pay attention to execution title and its particular types. In the end I outline the possibility of the proposed limitations on the territorial scope of an licensed executor de lege ferenda. Types of actions in The Civil Process

1 Summary The purpose of my thesis is not only to summarize the list of actions which we can find in The Czech civil process, but describe them and make focus on some of the main problems in applications and interpretation of actions. The thesis is composed of fifteen chapters, each of them dealing with different aspects of actions. I have looked into the issues by method of research in literature and judicature and analyzes of main problems in comparing with judicature. First chapter is simply introductory to the area. Second chapter introduce actions generally and define basic terminology used in the thesis. In the first part of second chapter we can find short entrance to the history of actions. The term of action in the civil remedial law represents a universal procedural means of the protection of rights which is not directly linked with material law directed at its protection. All the more this frequently applied institute is important since it provides prevention although indirectly for the rights which are threatened by legal insecurity and so it serves to fulfill the fundamental principles of a democratic state guaranteed by the Constitution and the Bill of Rights, particularly the principle of peace (legal security) and the right of just suit: "Everybody can sue for his/her right using a defined...
