Methodology of making municipal by-laws

The thesis focuses on the issue of generally binding municipal decree formation. I reckon that they are very contributive. Municipality is not obligated to issue decree; the regulation of municipal activities through decrees depends only on its own consideration. However, it is very necessary to follow principles for generally binding decree (hereinafter GBD) formation set by law and Constitutional Court judicature in case GBD to be legitimate and to meet its purpose. The goal of this thesis is the creation of a meaningful manual for generally binding municipal decree formation, especially how to proceed with GBD formation, what issues can be modified by GBD, GBD functions, and things that should be avoided while forming and approving decree. GBD is a very important legal instrument for regulating municipal administrative matters, residents' conduct, possibly GBD could set the duties that influence the village activities. The thesis is divided into four parts. The first part deals with basic concepts of the thesis: administration, public administration, self-administration, regional self-administration, municipality and its authorities, the right to form acts in regional self-administration and its legal regulations.
