Protection of a victim of a criminal offences

Dispute over legal impacts on victims has always been a discussion as well as protection of victims subjected to crime. Study of victims of crime (also known as "victimology"), victim typologies, terminology difference between victimhood and victimology will be mentioned in the very first paragraph in addition to introduction of protection victims of crime issue. Thereafter comes breakdown of phases to which a victim is subjected to throughout the offence. Victims of crime is main highlight of second chapter, followed by its definition and typology of victims, difference between terminology of victim according to criminal justice act and victim according to code of criminal procedure. As the topic advances, third chapter approaches with developmentments in the law within domestic jurisdiction, its subject being protection of victims of crime. Analysis of fundamental law is the main highlight of this chapter, breaking down its influence on victims' protection throughout the past up to nowadays and ongoing procedures. Last but not least, subjects providing protection for victims of crime will also be mentioned. The issue of crime victim in criminology

The topic of the presented thesis is the issue of the victim of crime in criminology and its aim is to present a certain summary of current knowledge from criminal victimology, current legal regulation of victims' rights and also practical possibilities of assistance to victims. The first chapter addresses the scientific field of victimology and clarification of its relationship with criminology. This is followed by a brief overview of the development of victimology from its origins to its modern conception and the changing view of the victim over time. The second chapter then looks in more detail at the victim as such - the definition of the term, its characteristics, or the debunking of the myth of the 'ideal victim', which still largely persists in society and can have an undesirable effect on how victims are treated. The third chapter focuses on victimisation, the process by which an individual becomes a victim. In particular, the focus is on the victim's own behaviour, victimological culpability, and the victim-offender relationship, which is a key factor in terms of victimisation. The aim of this work was to give a complete analysis of the phenomenon of domestic violence, especially from the criminal and criminological point of view. The topic of domestic violence is very wide. I considered necessary to also mention the legal regulation, which can be found in non-punitive legislation. It concerns especially the expulsion, the Act on social services and preliminary measures according to the Act on special proceedings. The introductory chapters define the definition of domestic violence, its specifics and individual types, which are physical, mental, social, sexual and economic violence. Followed by causes of domestic violence, along with the criminological description of the perpetrator, the victim, and the typical syndromes that may be manifested by the victim of domestic violence. Since the Czech Republic is a signatory to many international conventions affecting domestic violence, I have included in this work their basic analysis, with the greatest emphasis placed on the Istanbul Convention. The main part of the work is domestic violence from the perspective of substantive criminal and procedural law. This diploma thesis deals with the issue of protection of victims of crime. In the first chapter, by using the findings from the field of victimology, it describes victim as a phenomenon and also the process of victimisation while focusing on its causes and the negative impact it may have on victims. The author also summarizes the recent findings regarding the victims' needs. Lastly, some of the most common misconceptions about victims and their impact on the perception of victims are explained. The second chapter addresses the victim from the viewpoint of the law. Firstly, it examines the role which the EU plays in enhancing the standing of victims in the criminal procedure and also outside of it. Secondly, it examines the Act on victims of crime adopted in the Czech Republic. The Act on victims of crime and the particular rights of victims which are provided for in the Act are analysed in the second chapter with the use of the current findings in the field of victimology. The author also explains the main critiques of the Act such as the counter-productive wording of the right to receive information or a threat of corroding the criminal procedure as a whole.
