Ješina, R. Protection of Privacy and Personal data in the practice of a business company. Diploma thesis. Brno: Mendel University in Brno, 2020. The thesis is focused on the issues of protection of privacy and personal data in business companies. The literary research defines basic concepts, legisla-tive base of the protection of privacy and personal data, rights and obligations of involved parties and the consequences of violations. The research deals with the analysis of adhering the protection of privacy and personal data in the selected business companies. The result of comparison of performed analysis with the valid laws of Czech Republic and European Union are proposals for specific corrective measures leading to remedy of the unsatis-factory situation including the economic aspect.

The master thesis is focused on the protection of privacy and personal data in labour-law relations. The literature review is devoted to defining the terminology, the legal base of the protection of privacy and personal data, the rights and obligations of the parties and also the legal consequences arising from a breach of the obligations imposed. The original research part analyses issue of protection of privacy and personal data in a specific enterprise. Attention is given to monitored processes prior to labour-law relation and during that, including processes taking place after the end of the labour-law relationship. The attention is paid to all types of monitoring ongoing in workplace. Comparison of identified facts with the current legislation of the Czech Republic in some cases need recommendations, which are mentioned in this thesis, too.

The diploma thesis is focused on the protection of privacy and personal data in labour relations. The literature research is devoted to the definition of basic terms, the legal base of the protection of personal data and privacy, the rights and obligations of the parties, the supervisory authority and the sanctions related to the non-compliance of obligations imposed by the law. The research focuses on the conflict of interest of the employer and the right to privacy of the employee and the degree of legitimacy of workplace monitoring. The original research part deals with the analysis of personal data protection and privacy measures in the chosen business organization during the whole process from the beginning of the selection process, during the duration of the employment relationship to its termination. Subsequently, the ways of monitoring employees and their legitimacy are evaluated. Based on analysed facts, corrective recommendations, including the economic aspect, are proposed in conclusion of the thesis.

The diploma thesis is focused on the protection of privacy and personal data in labor-law relations. The literary research is defined the basic terminology, the legislative base of the protection of privacy and personal data, the rights and obligations of the parties and, last but not least, the sanctions related to the non-compliance of the obligations imposed by the law. The original research part deals with the analysis of the procedures for the protection and processing of personal data of employees and privacy at the workplace of the chosen company. The attention is focused on the processes from the beginning of the selection process, during the employment relationship and after the end of labor-law relationship. Further, the ways of monitoring employees and their legitimacy are evaluated. Based on analysed and identified shortcomings and errors, corrective recommendations are proposed in conclusion of the thesis, which will ensure compliance with valid legislation of the Czech Republic and the European Union.

The diploma thesis is focused on the protection of privacy and personal data in the labour-law relations. The first part focuses on defining terminology, which is very important for understanding this issue and the legal base including the description of the General regulation on the protection of personal data. Conclusion of the diploma thesis is devoted to subjects involved in the processing of personal data and their rights and obligations. The original research part is focused on the issue of protection of privacy and personal data at the specific Regional Authority. It describes the processing of personal data before the conclusion of the labour-law relations, throughout its duration and after its termination. Another part of the thesis is devoted to the descriptions of individual types of monitoring employees at the Regional Authority and the description of implementation process and changes which the General regulation on the protection of personal data brings. In conclusion there have been suggested corrective recommendations based on detected information, which were compared with the legislation of the Czech Republic.

Monitoring of employees Abstract The theme of this diploma thesis is, as the title suggests, the monitoring of employees. With the continuous development and progress of technologies and their increasing availability, the privacy of citizens is becoming increasingly more endangered. Even more concerning is the privacy of employees in the workplace, where an employer has inexhaustible possibilities to monitor activity at work - and sometimes outside of the workplace as well. On the other hand, the intention of the employer to protect its assets and the financial means invested in the operation of its business is appreciable and in some ways necessary to align with the employer's obligations to their shareholders. Therefore, the chosen subject brings to the surface the conflict of two equal rights, as the right to protection of privacy collides with the right of protection of property. For this reason, the whole thesis takes into account both the labour law regulations and the regulations on the protection of personal data - since personal data of employees can be threatened by monitoring. With regard to the fact, that Regulation (EU) 2016/679 comes into effect soon, it is briefly mentioned in the relevant parts, especially when assessing whether it will impact the legal interpretation in the future or not....
Monitoring of Employees and its Methods

This thesis intends to offer a balanced legal standpoint on monitoring of employees from the point of view of employer's rights and interests protected by law as well as from the point of view of employees' right to privacy. The surveillance of employees is governed especially by Section 316 (1) through (3) of the Labour Code1 . However, in case personal data of employees are processed within such monitoring, the personal data protection regulation must be applied as well. This thesis distinguishes between a so-called one-time or random inspection of employees performed within the meaning of Section 316 (1) of the Labour Code for the purpose of checking their observance of ban on using the employer's production and working tools for personal purposes and between continuous monitoring performed under Section 316 (2) of the Labour Code. At the same time, it is necessary to assess whether the employees' personal data are processed as well. Therefore, in practice, four different types of inspections/surveillance of employees have to be distinguished, each of them being governed by slightly different regulation.
