The subject matter of my Master's degree thesis is the issue of divorce proceedings. The main aim of this thesis is to put an interpretation on the currently effective legislation on divorce proceedings and divorce itself as it follows mainly from Act No. 292/2013 Coll., on Special Judicial Proceedings and Act No. 89/2012 Coll., the Civil Code. Divorce is the only legally permissible way in the Czech Republic how to terminate marriage within both spouses' lives. It leads to severe legal consequences affecting not just spouses themselves but alternatively their legitimate children as well. Therefore it requires a set of special rules and special proceedings so that courts may ascertain the presence of the irretrievable breakdown of marriage which only justifies allowing divorce and decide spouses' personal and property relations in connection with divorce. This thesis is divided into five parts which all bear certain relation to divorce proceedings. The first part provides an overview of divorce regulations throughout Czech history up to now. The second part firstly addresses the relation between substantive law and procedural law regarding divorce. Subsequently, it focuses on substantive legislation on divorce in the Czech Republic. Proceedings on marriage divorce This diploma thesis describes the proceedings on marriage divorce. I chose this topic because I consider it up-to-date and practical, in particular taking into account that nowadays almost every other marriage ends with divorce. The thesis aims to explain and analyze the legal regulation of this institute. The proceedings on divorce are currently regulated by provisions of the Act No. 292/2013 Coll., on Special Judicial Proceedings (and previously regulated Act No. 99/1963 Coll., the Civil Procedure Code) adopted within the process of recodification of the private law in year 2014 which also included adoption of the Act No. 89/2012 Coll., the Civil Code that stipulates legal conditions of marriage divorce with respect to the substantive law. The thesis is divided in four chapters. I believe that this structuring is important for comprehensive understanding of this institute. The introductory chapter defines the basic concepts that are fundamental to the subject of this thesis, i.e. the concept of marriage and divorce. English abstract Divorce of a marriage This thesis provides a comprehensive treatise on the institute of divorce of a marriage in Czech law order, with an emphasis on its postition in former legislation, its development and the pitfalls of legislation which are with this institute connected. The thesis analyzes particularly its conditions, consequences and proceedings for divorce of a marriage. It focuses also on the ways of termination of the community property of spouses and its settlement, duty to support of children as well as the settlement of other rights and obligations between former spouses. It also includes alternative ways of resolving divorce of s marriage and comparison with the legislation of other European countries. All work is completed with related law and current case law.

Zusammenfassung Als Thema meiner Diplomarbeit habe ich das "Ehescheidungverfahren" ausgewählt. Zur Auswahl dieses Thema haben mich viele Gründe bewegt. Vor allem möchte ich meine Diplomarbeit einem praktischen Thema widmen, das sich mit der Lösung von alltäglichen Lebenssituationen befasst, und diese Kenntnis könnte ich später in meiner Karriere als Rechtsanwältin verwerten. Angesichts der neuesten Statistiken, nach denen so ziemlich jede zweite Ehe geschieden wird, scheint dieses Thema sehr praktisch zu sein. Das Ziel meiner Diplomarbeit ist eines Ehescheidungverfahrens nach dem Gesetz Nr. 292/2013 über besondere Gerichtsverfahren, in der Fassung der späteren Vorschriften, das am 1. Januar 2014 in Kraft trat, zu analysieren. Das Gesetz über besondere Gerichtsverfahren, das in Rahmen der Änderungen des privaten Rechts aufgenommen wurde, brachte in das Scheidungverfahren eine Reihe von Neuerungen, deren Zweck es ist, die Mängels an vorherigen Prozessvorschriften zu beseitigen. Die größte Änderung im Zivilprozessrecht ist die Ausklammerung der außerstreitigen Verfahren aus dem Gesetz Nr. 99/1963 der Zivilprozessordnung, in der Fassung der späteren Vorschriften, in das Gesetz über besondere Gerichtsverfahren. Mit den außerstreitigen Verfahren wurden in das neue Gesetz auch die spezifischen streitigen Verfahren...
