Fundraising possibilities of Non-Governmental Organizations in the Czech Republic focused on Clubs residing in Prague

The subject of the thesis is a review of funding process of non-governmental organization Spolek II. TURNUS. This topic is very crucial as many NGOs would hardly operate without the support of various funds. The theoretical part of the thesis introduces the meaning of NGOs and fundraisings. It monitors the development of NGOs and describes changes that have taken occurred since the new Civil Code has taken effect. Furthermore it summarizes the analysis of multiple financing sources in domestic public budgets but also EU budgets. The practical part analyzes the expenses of a NGO from domestic public budgets in 2013 and systematically monitors financing of Spolek II. TURNUS. The efforts to obtain funds from public domestic budgets of Spolek II. TURNUS in 2014 are described along with comparison to the level of difficulty to process individual projects. This part also introduces plans of Spolek II. TURNUS for fundraising in 2015, whether it was already successful or what are the expectations while getting a financial support. The conclusion depicts changes that Spolek II. TURNUS could perform in order to maximize the support from domestic public budgets. The thesis highlights the difficulty of processing and lack of transparency of the projects for obtaining grants and funds.
Information duty of entrepreneur in connection to consumer protection

Consumer protection is one of the recent trends in the private law and goes nowadays through very dynamic development. Its driving force is especially the European law through directives of the European Parliament and the Council. The necessity of their transposition greatly influences our national law. The last change was an adoption of the Law no. 89/2012 Sb., the Civil Code. The aim of this thesis is to analyze the information duties of entrepreneurs which have been adopted to protect consumers. The thesis evaluates whether the given regulation does not burden disproportionately entrepreneurs on the one hand and provides an adequate protection for the consumers on the other hand. The thesis also deals with the consequences that may arise in particular cases for failure to comply with the information duties.
Steering gear of inheritance in Czech Republic

The theme of dissertation is "Inheritance and steering gear of inheritance in Czech Republic" because I widen the original theme of procedural law to material law - inheritance, according to New Civil Code (NOZ) which brought to Czech legal order many changes, also in the area of inheritance in Czech legislation. The thesis also analyses the changes which brought Zákon o zvláštních řízeních soudních. Dissertation then compares the new and the old legislation, highlights its pluses and minuses and also resolves if the new legislation is better the the old legislation and where are these changes obvious. This thesis should be general knowledge of changes in area of inheritance and steering gear according to NOZ, not at all detailed processing of institutes of inheritance law. Practical part of the thesis analyses judicature and three concrete testaments.
The impacts of the new Civil Code on taxation of immovable property VAT

Number of areas, including the VAT one, were hit by recodification of private law since 2014. Number of areas, including the VAT, were hit by recodification of private law since 2014. This thesis focuses on analysis of the taxation progress of selected immovable property in years 2013 to 2015 and also on description of changes, that have occured - mainly due to the introduction of the new Civil Code. The reader finds a detailed comparison of selectedimmovable property and its supply according to the new Civil Code, the VAT Act and the Council Directive 2006/112/EC. The emphasis is placed on factual application of the theoretical findings (on the selected set of transactions) and the quantification of the impacts on the amount of the output tax in each year in the practical part of the thesis.
The legal status of a board of directors’ member in a joint stock company after the recodification

New legal regulation of the private law contained in the New Civil Code and the Business Corporations Act has brought plenty of changes also in the status of a board of directors' member in a joint stock company. Both codes have brought new terminology, new institutes and clarification of the rules known from the legal regulation before the recodification. On one hand there is certain loosening in the decision making of statutory bodies of business corporations, on the other hand there is tightening of sanctions for cases of failure. This diploma thesis introduces major institutes of legal regulation related to the status of a board of directors' member and provides a basic comparison with the legal regulation before the recodification.
Rights related to the real estate property acquisitions in international comparison

Diploma thesis concerns about legal regulations of real estate by new civil codex with reflection to the previous and international legal regulation.The aim of the thesis is to assess the functionality of new civil code and its benefits in the real estate investment transactions in Czech Republic. This analysis is supported with overview of transfrontier real estate acquisitions made by foreign investors in Czech Republic and additionally also real estate investments of Czech investors abroad. This thesis therefore tries to provide answers to multiple questions ranging from analysis of new civil codex regulation, its impacts, risks and functionality then secondly its similarities in comparison to foreign law regulation (of Germany, Austria, Great Britain, Italy and France). From the perspective of transfrontier real estate acquisitions this thesis concerns about law acknowledgement for foreigner parties in real estate transactions in Czech Republic and counterbalance of the similar rights on the side of Czech residents in reciprocal acquisition process. The analysis is supported by the debate of accuracy of either liberal or protectionist attitude to foreign real estate investors' regulation with a reflection to current international political, sociological and economical course of events.

This thesis carried out an analysis of various aspects of liability for defects in the contract of sale under the New Civil Code. The text discusses general liability and displays special treatment contracts. The thesis includes a division of defects, deals with a liability for defects focused on the sale contract and a contract for work. Further specification party beneficiary rights of defective performance and other rights to the settlement of total loss. There are given rights principles and procedures of the defects of the complaint procedure. The text contains rules on liability for defects in international trade. The thesis is the comparison of new and old legislation, the most significant changes and an overview of the consequences of changes to the consumer.
The impact of the new Civil Code on liability insurance

On 1 January 2014 the new Civil Code, the most important piece of legislation, has come into effect. It is a part of large recodification of the Czech civil law. This thesis, "The impact of the new Civil Code on liability insurance", points out the most significant changes and the implications which effects, among others, the insurance sector. The first part of the thesis addresses mostly the theoretical concept of liability, the elemental preconditions of liability and methods of compensation for material and immaterial damage, including comparison of claim rights under former legal norm and the current legal norm. It also mentions the ambiguity in law in case of compensation for work-related injuries and occupational diseases. The second part of the thesis is dedicated to describing the process of implementation of the new Civil Code to operation of insurance companies from both legal and financial point of view. This includes evaluation of the impact of the changes on settlement of compensation claims for immaterial damage from the first available data. The third part is focused on the characteristics of liability insurance and its construction. It includes basic breakdown by legal bindings and a description of types of liability insurances. The conclusion contains overall assessment of liability insurance on the Czech insurance market.
The impact of recodification of the civil and commercial code on the Czech accounting standards

The Czech accounting standards have been amended many times yet. They were nevertheless adjusted in connection with the recodification of the private law on January 1st, 2014. Main output of this recodification was "The new civil code" and "The law about commercial corporations". The diploma thesis examines the impact of these legal standards on the Czech accounting standards. Apart from that, the new civil law brings also new terminology, what has consequently an impact on legislative and technical changes of the Czech accounting standards. Moreover the thesis talks about selected recodification areas, which significantly interfere in accounting. It is mainly the new concept of properties, trust, earnest payment and paying of prepayments on share on profit. Last but not least, the thesis tries to explain the new definition of technical improvement.

This thesis examines changes in new Civil code, considering contract of purchase and contract for work. Primary aim of this paper is to compare changes in contract of purchase and contract for work legislation, which are both parts of new Civil code and Commercial code. Secondary goal is to discuss new Civil code in general, describe contract of purchase and contract for work, as they are both most common types of contract, then compare business-legal legislation of those contracts in comparison to legislation of new Civil code. At the end changes in both contract types legislation will be analysed.
