Measures administered against juveniles in criminal proceedings

Act no. 218/2003 Coll. on liability of juveniles for illegal acts and on juvenile justice established new rules in criminal proceedings with juveniles and introduced brand new methods of sanctioning juvenile delinquents in criminal processes, specifically it introduced a number of new measures which can be administered as punishments for wrongdoings including the possibility of alternative solutions to committed wrongful acts. The degree work is divided into two parts. The theoretical portion provides information about potential solutions and approaches when measures are administered in criminal proceedings with juvenile offenders including the theoretical background. The empirical portion maps out the ratio of measures administered by prosecuting and adjudicating bodies in pre-trial proceedings and measures administered by juvenile courts; the degree work also summarizes all solutions to criminal matters related to juveniles; the quantitative research focused on the District Court in Strakonice during the period of 2004 and 2008. The objectives of the research correlated with hypotheses which the author based on her experience gained in her job as a juvenile social probation officer. The research showed that during the monitored period 64% of juvenile criminal issues were resolved directly by the juvenile court and only 36% of acts committed by juvenile delinquents were closed by prosecuting and adjudicating bodies during pre-trial proceedings. The second portion of the research proved that the most frequently utilized measures {--} 54% - were criminal sanctions; 44% of juvenile criminal cases were solved by means of alternative measures, while reformatory measures were administered only to 2% of juvenile delinquents and protective measures were not utilized at all. The degree work was intended to briefly demonstrate whether the purpose of the Act on juvenile justice is fulfilled. Its onclusions are intended for professional public and for all people who are interested in criminal law, criminal proceedings and juvenile delinquency.
System of the prevention of social-pathological illnesses and implementation of the system at primary schools

Our diploma thesis entitled ?The system of prevention of social and pathological phenomena and its implementation at elementary schools? engages in the analysis of possibilities and conditions for and approaches to the implementation of primary pre-vention at elementary schools. The objective of the present diploma is to describe how systems of primary prevention work on the regional and school levels; accordingly, we have performed a comparison of different approaches to this issue at selected schools in the regions of South Bohemia and Pardubice. We have analyzed programmes of the aforesaid regions on the conceptual level, observing the implementation of preventive programmes at particular schools (such as elementary or special). Furthermore, we have examined the assistance as actually pro-vided to schools during the formation of school preventive programmes and their influ-ence on pupils or students as such. We are also interested in how the possibilities that are on offer for the cooperation among schools are utilized and how schools make use of grant programmes provided by regional authorities. The present thesis is divided into two parts, theoretical and practical. The theo-retical part first characterizes and defines basic terms, explaining the most common so-cial and pathological phenomena with the largest impact on the young. Second, a men-tion is made of the system of prevention at both the school and regional levels. Accord-ingly, the practical part focuses on the analysis of school activities in the area of preven-tion, particularly the methodology of prevention, the support of the formation of preven-tive programmes and the influence such programmes have on children. The conclusion summarizes presuppositions and hypotheses which are men-tioned in the introduction. A sociological survey has been conducted at selected schools by means of questionnaires, which will be evaluated at the end of our thesis.
Positions and prejudices of publicity to criminality commiting by extremists

The major subject of this graduation thesis is political extremism in its basic forms. In the theoretical part the author focuses in particular on division of political extremism and description of individual extremists groups. He also addresses criminal activities committed by extremists. Large attention is paid mainly to racially motivated criminality. The main objective of this graduation thesis is to ascertain the opinions of two different target groups on the extremist movements and the forms of criminal activities committed by them. The first group of informants consists of people who were brought up in the time of totalitarian regime. The second group of informants is made up of people who were brought up after the revolution in 1989. The output should be the comparison of the opinions, positions and prejudices of these two groups of informants in respect of extremists and their activities. In the practical part the qualitative research method is used. In order to collect the information, the author used the method of phenomenological interviews that were structured and prepared beforehand. The informants were people living in České Budějovice or its close surroundings. Their number and selection was purposeful to secure equal representation of men and women so that the data contain the opinions of both these groups.
Current issues of judicature in juvenile matters

This thesis addresses the issues of judicature in juvenile matters, focusing on the criminality of children below 15 years of age and the specifics of judicial proceedings in cases concerning an offence punishable differently. The theoretical part outlines development of judicature in juvenile matters in the Czech Republic and the relating laws, the specifics of judicature in cases involving children below 15 years of age, cooperation of organizations acting within the given issues, and the currently discussed topics, such as lowering of the criminal liability age, development of juvenile criminality in the Czech Republic and evaluation of the act regulating judicature in juvenile matters after the several-year operation in practice. Due to their age and psychical immaturity, work with children as offenders committing offences punishable differently requires specific procedures aimed at correction of the offender and prevention of occurrence of further problems. The objective is also a fast solution of the situation, the lowest possible traumatizing of the child and protection of his/her rights. A large number of institutions, such as bodies of social-legal protection of children, the police, juvenile courts and the Probation and Mediation Service, are involved in the process. The objectives of the thesis were ascertainment of opinions of juvenile guardians on the issues, in particular on the operation of the act in practice and on its benefits and contingent drawbacks. A further objective was development of suggestions for amendment of the valid legal regulation on the basis of the respondents{\crq} answers. In connection with the set objectives, the research was conducted in the form of a structured interview with open questions. The respondents were workers of departments of social-legal protection of children under municipal authorities, and juvenile guardians. The questions were focused on the operation of the act in practice from the view of guardians, on benefits and drawbacks of the act and on the opinions of the guardians on some specifics of judicial proceedings involving children below 15 years of age. Juvenile offenders´motivation for crime

My thesis deals with juvenile offenders´ motivation for crime. In the theoretical part the basic terminology relating to this issued and considered essential for the issue description is introduced. Futhermore, the criminal activity of juveniles is characterized and the current state of the issue is described. The criminogenous factors leading to criminal activity are defined. These are divided into endogenous and exogenous. The final part of the theoretical part deals with motivation for criminal activity. The main goal/topic of my thesis was to illustrate motivation of juvenile offenders for criminal activity. To a thorough understanding and determination of the issue, sub-objectives were set {--} to identify endogenous causes of crime commiting by juvenile offenders, and comparison of individual offenders and evaluation of their readiness to commit crime. The research questions corresponded with the goals stated. The research was conducted by a qualitative method. The respondents were received through a purpose selection by the PMS institution. To obtain the data, the moderated semi-structured interview technique was chosen. The interviews were recorded using a dictaphone to make the most accurate analysis, and then retyped to a verbatim transcript. To analyze the data the anchored theory method was applied. Coding is based on the principles of the theory. I have used open coding. There were ten juvenile crime offenders who took part in this research as respondents. The research has shown the existence of a few problematic areas that provide grounds for criminal activities. As the fundamental areas have proved to be an inadequate family background and inappropriately spent free time in connection with members of a gang. The research outcomes revealed that the main (dominant) motif was fun and entertainment. Secondary (not frequent) motif was financial profit. The research results have also shown that these offenders tend to commit crime under the influence of alcohol and friends. I believe that my work has revealed new evidence surprising for many people. And that is that criminal activity of juveniles has been declining, being rather a marginal phenomenon (juvenile crime makes up only 2% of the total crime rate), and brutality and severity of offences commited by juveniles does not reach such a gravity as it is presented by the media. I would like to recommend the results of the thesis to be used as a basis for a preventive action in the field of juvenile delinquency. Due to the findings, more efficient and effective preventive programs could be set up to eliminate this socio-pathological phenomenon so that a favourable social climate could be established.
The Criminality of Romany Ethnicity in the Czech Republic and the Project of the System of Mentoring in the Criminal Justice

The introduction part is about the history and criminality of the ethnicity. This part contains statistical data and possible causes for the criminality. The main part is dedicated to the most common illegal ways of earn living. This part is connected with part which describes the System of mentoring in the criminal justice. The practical part is aimed at check on the hypothesis of the effect and function of the project. This part is supplemented by statistical data and outcomes of the research.
Criminal activity releated to the use of illegal drugs

In my thesis I deal with illegal drug use leading to criminality. Drug abuse has been a debated issue recently because drugs are omnipresent in our society. Illegal drug use has been a serious problem worldwide. Due to its geographical location, shortly after 1989 and after the fall of the Iron Curtain the Czech Republic has become both a transit and a destination country for all sorts of drugs within a short time. The objective of my thesis is to examine, describe and analyse the overall criminality in the Prague area in 2005 {--} 2007. The other concern of my research was to determine the drug addicts´ contribution in proportion to the overall criminality. I set three hypotheses: H I : The most common drug addicts´criminal activity is theft. H II : Most drug addicted criminal offenders are male. H III : The most common drug being abused is pervitin. The thesis is divided into two parts {--} theoretical and practical. In the theoretical part the development of the drug scene in the Czech Republic and crimes committed by drug addicts are described. I also give information on detection, investigation and criminal sanctions in criminality caused by drug addicts. I gathered the data from specialist literature. In the practical part I used the technique of the secondary statistical data analysis. I analysed the statistical data from 2005 {--} 2007 obtained from the Police of the Czech Republic Headquarters. The research was conducted by the quantitative questionnaire method and the data obtained were analysed. The data were put into charts and diagrams. All the hypotheses suggested were confirmed. The objective of my thesis was accomplished.
Problematics of factors influencing juvenile delinquency

The degree paper deals with the issues of juvenile delinquency and the factors which have impact on the origination of the juvenile delinquency. I have chosen this topic since it is a very serious problem and this phenomenon has been proliferating significantly. The crime in general, especially the juvenile delinquency, is a serious social-pathological phenomenon. Minors who do not reach the limit of criminal liability often became the offenders. In addition, the probability of threatening a young man by social pathological phenomena and his subsequent ``criminal career{\crqq} is currently much higher than ever before. To recognize the occurrence of risk factors among the youth in time it is necessary for the families, teachers, educators and all professionals working with the juveniles to acquire sufficient knowledge, information and experience and be able to work with the factors and fight against them in time. The theoretical part deals with the definition of the term ``youth{\crqq}, the personality of a young delinquent, structure of the juvenile delinquency, analyses of the risk factors which most frequently participate in the occurrence of juvenile delinquency, and outlines the possibilities of intervention against the juvenile delinquency and various kinds of prevention. The research is focused on the occurrence of risk factors among the young respondents and on protective factors and attitudes of the respondents in respect of the juvenile delinquency and the crime at all. Structured interviews were held with the youth which are placed in the reformatory or special correctional institutions in the territory of the Regional of Plzeň. The main objective of the degree paper is to describe the factors which significantly affect the occurrence of the juvenile delinquency and to map the occurrence and impact of such factors on the juveniles placed in the correctional and reformatory social retraining institutions in the Region of Plzeň. Hypothesis No. 1 is: The youth commit property crimes at the most. Hypothesis No. 2: The youth behave improperly namely when in groups. Hypothesis No. 3: The decisive factor affecting the juvenile delinquency is the family. I think that the objectives of the degree paper were fulfilled. Hypothesis No. 1 was confirmed. The respondents mostly stated that they were adjudicated treatment in special reformatory institution due to property crimes. Hypothesis No. 2 was also confirmed. The replies of the respondents mostly contained the possibility that they committed crime within a gang. Hypothesis No. 3 was confirmed, too: Analyses of the research proves that all factors participating in the occurrence of the juvenile delinquency are penetrated with the impact of the family and family environment on the juveniles. Results of the performed research will be used for further education of the students at the University of South Bohemia in České Budějovice, as well as for the students of other auxiliary professions at other universities. The results will be further used as the source of information for parents and pedagogical professionals working with the youth and as source materials for seminars about the given topic.

Practical part inquire into student´s and the pedagogical personnel´s ideas of problems of social pathology and leisure time. The research deals with prevention and leisure time activity analysis and realization of these acivities into various types of institutions working with the children and juvenils.
