Illegal construtions and their legal destiny

The aim of this thesis named "So called black construction and their legal fate" is to provide a complex view on issues concerning black constructions in accordance with new trends in the Czech construction law. The new trends in the Czech construction law relates especially to the concept amendment of the Building Act made by Act No. 350/2012 Coll., on amendment of Planning and Building Regulation (Building Act), as amended. The further aim of this thesis is to trace the problematic issues concerning black constructions and try to suggest the solutions of these problematic issues de lege ferenda. The principle of a protection of an ownership is being compared against the principle of a public interest in the first chapter. These principles clash against each other in the issue and disputes related to black constructions. The following second chapter is dedicated to the definition of a construction in the legal manner. In the third chapter are being presented legal titles of a construction right. The next chapter deals with the process of the discharge and dissolution of a construction right and genesis of a black construction. The fifth part is dedicated to the definition of a black construction and the differentiation of the black construction from an illegal building in the manner of civil law...
Risk analysis and evaluation of using automated systems in building construction design

This thesis in its first part deals with the complexity of the legislation, which is related to design activities and also trying to explain the basic rules for the creation of project documentation. In the main section then analyzes and evaluates the selected drawing software in defined categories. Based on the selection chooses the best drawing software and compared with the hand-crafted version of the design documentation in terms of time and cost. The final time for the creation of project documentation will be converted to a built-up area of the building and found the relationship between time constraints and the size of the built-up area of the new building. It will also be evaluating the return on investment to drawing software and assessing cost-effectiveness of various options drawing. The aim of this thesis is to analyze the risks in the use of software products for structural design and evaluate their use based on the value of work.
Construction modifications on heritage protected object including specific example

Bachelor's thesis named "Construction modifications on heritage protected object including specific example" describes problematics of state heritage care in relation with architectual heritage. Theoretical part of the thesis is dedicated to legislation of Czech Republic, particulary on heritage and construction law, specifics of heritage protected buildings and possibilities of funding of their renovation and problematics of dilapidation of heritage objects. In practical part knowledge from theoretical part will be applied on specific example, the reconstruction of Pavilion in Havlíčkovy sady, Prague 2.
Posouzení situace "Vily Anička" z hlediska zákona č. 183/2006 Sb. o územním plánování a stavebním řádu ("Stavební zákon")

I propose to assess in my Bachelor's work the influence of the Construction Law on the building of the family house that is known as "Anička" ("Annie" in English) and which I shall henceforth refer to as "Vila Anička". The house is in the Secessionist style and has Land Register No 492 in Gončárova Street, Plot No 574, in the area covered by the Hradec Králové Land Register. In the first chapters I propose to describe and characterise in general terms the procedure for demolishing a building, the process of land and construction management, and the influence of the relevant bodies and their stance towards the construction and the architectural plans. I then propose to assess the conditions and requirements for undertaking the construction and the use of the building. In the second part of my Bachelor's work, I should like to go into more detail about the Generali Hradec Králové plan, whereby Generali Pojišťovna, a.s. (Generali Insurance Company Inc) intended to build a new administrative building on the site of Vila Anička. The capital investment in the construction of the new building was interrupted when architectural specialists submitted a proposal that Vila Anička should be registered as a listed building. The declaration of Vila Anička as a cultural monument was pivotal in the licensing process pursuant to the Construction Law and had a decisive effect with respect to authorisation of demolition of the building and subsequent building control. The aim of my Bachelor's work is to assess in a wider context the impact of the Generali Hradec Králové plan from the point of view of protection of public interests, town planning and the urban values in a given areas versus the interests propagated by the investor.
