Mediation and its use in labor disputes Abstract This diploma thesis deals with the topic of mediation, which is one of the alternative ways of resolving disputes. Mediation is currently a very current issue, as it has been incorporated into the Czech legal system relatively recently and also because of its great potential due to the benefits it brings primarily to litigants. Such benefits include, for example, the voluntary nature of the whole process, non-publicity of the mediation or the placing of responsibility in the hands of the disputing parties themselves. The thesis in the first chapter defines the concept of mediation, introduces the history of mediation, current legislation at the European level and within the Czech legal system, further deals with conflict theory, the mediator, his education, techniques, participants in mediation and mediation directions. The second chapter focuses on labor law and the relationships arising within labor law. It also explains what types of labor law disputes may arise and does not omit the ways in which such disputes can be resolved. It then focuses in more detail on the benefits of using mediation in labor disputes. Atypical Forms of Labour Law Relationships

This paper deals with the set of labour law relationships, which is collectively called atypical labour law relationships. At first, for the reasons of providing sufficient inside view regarding this problematic, which is connected to these relationships, the position of these relationships within the field of labour law itself is defined and necessary basic terms, which are essential for atypical labour law relationships, are presented and explained. Among these basic terms there is primarily listed definition of the term "dependent work", but the term "flexicurity" is described thereto as well. Given the fact that it is possible to apply different approaches to the definition of atypical labour law relationships, the explanation of ways how to define the set of atypical labour law relationships follows the explanation of basic terms. In the paper, there is applied the demarcation using the definition of typical labour law relationship in the way that all the labour law relationships that differ from the typical labour law relationship are labelled as atypical. In the following-up part of the paper there can be found the characterization of some of the atypical forms of labour law relationships, which make part of the defined set of relationships. Project Risk Management

The thesis deals with project management with a closer focus on risk management in the selected company. First it was necessary to establish cooperation with the company. The work is divided into two parts: theoretical and practical. First I describe the approaches of existing methodologies using common professional literature in the theoretical part. Then in the practical part I start with characterizing the company. I study current state of project management that I determine on the basis of internal corporate methodology, my own observation, and interviews with the Head of Strategic Projects Unit. I also study the status of project risk management that I determine on the basis of my own observation, structured collection of information, and follow-up interviews with employees. After that I design Project Risk Maturity model in the company. At the end of my work I evaluate existing information and propose improvements: risk management methodology for the company.
