European judicial space: Brussels I Regulation

The theme of my diploma thesis is one of the most important judicial acts of European private international law of civil procedure - Brussels I Regulation. The aim of my thesis was to analyse the Regulation from many views with an emphasis on the jurisprudence of European Court of Justice and of domestic national courts. First part of the thesis aims to describe the whole legal branch of european private international law of civil procedure and therefore place the Regulation in the context of the whole legal branch. second part of the thesis deals with the Regulation in its entirety and desribes every single article of the Regulation and tries to determine the boundaries of its application and interpretation. The last, third part, states othre relevant legal acts related to Regulation which are considered to be its alternative, and sums up the pros and cons of their application.
Analysis of the Lisbon treaty made by Czech and German Constitutional Court

In this thesis I deal with constitutional review of the Treaty of Lisbon with constitutional orders in the Czech Republic and in the Federal Republic of Germany. In the first part of the thesis I analyze constitutional framework of the effect of International and European Law in the Czech Republic. Subsequently I focus on the main points of two reviews of the Czech Constitutional Court published within the bounds of the preliminary constitutional review of the international treaty proceedings. Secondly, I explain the difference between arrangement and ratification of the international treaty and eventually I analyze main issues of the constitutional review of the Lisbon treaty in Germany.
Consumer Protection in New Czech Civil Codex

As a member of the European Union, the Czech Republc is obliged to implement European directives and regulations, also in consumer protection policy. The revision of European consumer acquis has begun in the same time as the long awaited recodification of Czech civil law -- new Civil Codex. The thesis focuses on how the new Civil Codex reflect the most important recent European regulations and directives. A few were chosen to be analysed more thoroughly -- directive 2011/83/EU, Draft Common Frame of Reference, draft of common European purchase contract, draft of directive 2011/793 and regulation 2011/794. Moreover, it focuses on a few selected issues included in the new Civil Codex, notable from the view of European legislation transposition -- e. g. the definition of consumer, distance and off-premises contracts, unordered supplies and unfair contract terms
European Economic Interest Grouping

The thesis contains a description and a legal analysis of the European Economic Interest Grouping. The goal is achieved through the method of description, analysis and comparison. The first chapters of the thesis are devoted to incorporation of the Grouping, development of legislation relating to the Grouping, applicable system of law and the topic of legal nature of the Goruping. The way of how to incorporate a Grouping is described in the following chapter. Furthermore, the rights and obligations deriving from the membership in a Grouping are explained. The final chapters are devoted to the process of dissolution of the Grouping and to popularity of the Grouping throughout the EU countries.
European private company

The diploma thesis evaluates the possible status of the European private company (SPE),once becomes valid. It describes the legislative procedure and evaluates the impact of the SPE once it exists. At the end, differences between Czech legal form of "Spolecnost s rucenim omezenym" and SPE are discribed.
Transfer of registered office in EU law

This final thesis deals with the issue of transfer of registered office within the EU law. The thesis follows three lines of legal regulations: harmonization of company law, rule-making in the field of European companies and case-law dealing with primary freedom of establishment. The goal of the thesis is to sum up possibilities of the transfer of registered office assured by current legal situation to both companies established according to intrastate legislation and European forms of companies. The thesis also deals with prospects of possible future development.
Comparison of legal regulations of the private limited company in Czech republic and Spain

The thesis is aimed at the comparison of legal regulations of the private limited company in spanish and czech law, especially because this type of company belongs currently to one of the most wide-spreaded forms of business associations and as such creates the legal framework for the development of small and medium enterpreneurship. The thesis is divided into several thematic parts describing particular features of private limited company. This way I tried to find the most important differences between these two systems of law with the intention of clearing their advantages and also disadvantages.
Comparison of Limited Lability Company in Czech and Spanish law

In my diploma theses I am comparing legal regulations of limited liability company in Czech and Spanish law. The comparison of characteristic features takes place in four different areas: basic provision, constitution of the company, company organs and dissolution of a company. In the last section I describe specil form of Limited Liability Company called Nueva Empresa.
European Union's Food Safety Policy and the European Food Safety Authority (EFSA)

This thesis deals with the current food safety policy and the general principles of food law. The first and second parts describe a progress and current legal regulations in the field of food safety. The aim of the third part is to analyse three judgements of the European Court of Justice, related to the food safety. Next section is focused to the European Food Safety Authority and its work - providing assistance and independent scientific advices. The last part describes a present situation of the food safety system in the Czech Republic.
European Ombudsman

The paper complexly deals with ombudsman function. It describes its origin, historical developement and powers of ombudsman. In second part, focuses on European Ombudsman. It describes law connected with EO and describes his work and his results for years 2008-2010. The purpose of this paper is to get the reader familiar with work and responsibilities of EO.
