Methods of investigation of drug-related crime

The methodology for investigation of drug-related crime is the topic of this thesis. There are a few reasons why I have chosen this topic. The issue of drugs, drug-related crime, drug addiction and also illegal drug traffic has become recently the worldwide problem which intervenes into many areas of human life and therefore we must constantly pay attention to it. Especially this fact, together with other reasons as my personal connection with drug issue (few-year-long involvement in the program focused on the primary prevention from drugs at secondary schools) made me to choose this topic. My thesis is divided into 6 parts. In the first two chapters I define the general notions related to the drug issue and I provide with the division of drugs into groups under chosen criteria. For the better orientation in this issue I have listed the most common types of drugs with the description of their effect on the organism of humans. In the third part of my thesis I focus on the criminal prosecution of drug offences and the historical development of the legal regulation of this issue. Methods of investigation of murders (selected issues)

Resumé The topic of this diploma work are the chosen problematic methods of investigating the murders. At the beginning, the dynamics of the murder's development in the Czech Republic in the last eight years is emphasized. This diploma work mentions the legal regulation of the murder and infanticide. Typical investigation situations, specific characteristics of subjects and inducements for investigating and peculiarities of the starting operations are being described quite briefly. Prevailing part of the work is focused on the site inspection and the coroner's inquest. The site inspection chapter drala especially with subjects that are prezent at the site inspecton, its purpose rules and negative circumstances, further, with the proceeding of operations at the site inspection, and the coroner's inquest documentation. The coroner's inquest chapter deals particulary with the autopsy proceedings, stating the time of decease and autopsy procedure. The diploma works enriched with opinions, perceptions, considerations and criticism by some authors, who are focusing on this topic in thein speciál texts, text-books and publications. Besides, it draws even from causuistics in criminology magazines.

Methods of investigation of crimes committed by juvenile (abstract) The purpose of my thesis is to describe and analyse juvenile delinquency and its methods of investigation. The reason why I chose this theme is that the juvenile delinquency is an up-to- date subject. Causes of a crime, ways of its commission and its prevention are frequent issues of general and expert public as well. The thesis is composed of eight chapters, each of them dealing with different aspects of methods of investigation of crimes committed by juvenile. Chapter One is introductory and defines the term methods of investigation itself and its components. Chapter Two is subdivided into four parts. The first part defines the term juvenile. Part Two deals with main kinds of crimes committed by juvenile and compares statistical data. The following part of Chapter Two describes ways of committing crimes. The last part of Chapter One focuses on causes of crime and illustrates them. Chapter Three is concerned with specific clues and specific investigative situations. 72 The Methodics of Investigation of the Sexual Crime Acts (chosen issues) Key words: rape, sexual abuse, investigation Summary This submitted diploma thesis deals with procedures of investigation of crimes rape and sexual abuse, which are two most serious offences within sexual criminal acts. In this work I analyze only some of the most essential moments of investigation, because the theme as a whole exceeds the required extent of the diploma thesis. Most attention is paid to contacts of the prosecuting and adjudicating bodies with the victim and to the acts in which the victim is involved. The introductory part analyzes basic contemporary and prospective legal regulation of all sexual criminal acts given in the present and new criminal codes. Offences of rape and sexual abuse are explicated in more detail. Then the work brings a criminalistic characteristics of these offences with basic statistical data. It points out the decreasing detection rate of these crimes over the last few years. Within the criminalistic characteristics, the thesis shows typical ways of committing these crimes, typical offenders, victims and typical traces. 68 English résumé: Crime scene examination The diploma paper considers analysis of criminology method called crime scene examination. The introduction of the thesis shortly deals with progress of proofs during criminal proceedings. Author presents the crime scene examination as a creative and a systematic activity of the bodies in charge of criminal proceedings, which targets the detection of criminality and criminals. The second chapter treats conceptual signs of crime scene examination. There is accomplished the analysis of examination as a criminology method, whereat the bodies in charge of criminal proceedings discover, by the help of direct observation, all the matters, which are useful for clearing the perpetrated criminal activity. Sequentially the focus is paid to criminal scene. At this moment the author of the diploma paper compares the ideas of character of criminal scene. He mentions two opinions. The crime scene can be the area, where the crime is perpetrated or according to the second opinion the crime scene can subsume also other areas, which are connected with the crime scene somehow. Hate crimes My final thesis is dealing with the phenomenon of hate crimes. The purpose of the study is not only to provide a general theoretical knowledge of biased - motivated incidents, but also to present real criminal cases and show on them how dangerous pure hate can be. The thesis is composed of three main chapters, each of them concerns aspects of hate crimes. Chapter One is more or less introductory. The chapter is subdivided into three parts. The first of them describes and interprets the basic term "hate crime" from the view of various authors. Moreover, it also conciders the necessary elemens (like prejudice against sex, race, skin colour, nationallity, ethnicity and religion), which should be involved in the hate crime definition. The second part deals with the possible causes of hate crimes - such as migration, globalization, economic problems and mainly stereotypes and preoccupation. The last part of the Chapter One examines relevant Czech legislation - compares and contrasts the previous and the current Czech Criminal Code. Chapter Two consists of seven parts. 57 5. Závěr Toto téma pro svoji diplomovou práci jsem si vybrala zejména proto, že kriminalitu mladistvých považuji za zvlášť závažný problém. Samozřejmě některé faktory již předurčují budoucí kriminalitu mladistvých. V tomto případě se musí včas zasáhnout a zabránit mladistvému v překračování hranice zákona. Na základě informací ze statistik je možno konstatovat, že kriminalita mladistvých má spíše klesající tendenci. Mladiství se pak nejvíce dopouštějí majetkové kriminality. V každé fázi vyšetřování je třeba zohlednit výchovné působení na mladistvého, neboť smyslem trestního stíhání je nejen potrestat mladistvého pachatele za jeho trestnou činnost, ale rovněž i zabránit mu v pokračování jeho kriminální dráhy. Mladistvý si v této etapě svého života vytváří model svého budoucího chování. Jestliže včas pozná, že si zvolil špatnou cestu, v další části svého života se již vyvaruje takového jednání. Význam spatřuji také v tom, že s mladistvými mají jednat osoby, které mají zvláštní průpravu pro zacházení s mládeží. Takové osoby jsou schopné zajistit správné působení na mladistvého, poznat jeho osobnost a příčiny, které jej vedly k trestné činnosti. Z toho, co jsem měla možnost poznat během mé praxe na státním zastupitelství i během studia této problematiky, mohu konstatovat, že s mladistvými skutečně jednají...

55 Závěr Ve své diplomové práci jsem se pokusila alespoň v základech pojednat o některých vybraných problémech metodiky vyšetřování trestného činu vraždy. Mým cílem bylo zdokumentovat tuto problematiku, co se týče právní úpravy, teoretických koncepcí a následně i některých příkladů z praxe. Již v úvodu jsem zmínila, že vyšetřování vražd je jedním ze způsobů boje společnosti s patologickými kriminálními jevy. Jedná se o činnost nutnou, která musí být vykonávána v každé společnosti. Je zárukou její stability. Pouze stěží si lze představit fungování společenského systému, který by neměl vybudovány obranné mechanismy pro potlačování negativních společenských projevů jeho členů. Po stručném úvodním pojednání o fenoménu násilí ve společnosti jsem se zaměřila na právní úpravu trestných činů vraždy a vraždy novorozeného dítěte matkou, tak jak je stanovena právním řádem České republiky. Uvedené trestné činy jsem charakterizovala pomocí jejich základních znaků. Při zpracování této diplomové práce jsem čerpala z platné a účinné právní úpravy. Pouze jsem se velmi stručně zmínila o existenci nového trestního zákoníku, jenž nabude účinnosti 1. 1. 2010, kdy jsem pro srovnání uvedla některé základní odlišnosti od stávajícího TZ, které se týkají tématu mé diplomové práce.
