Grounds for Revocation and Invalidity of the European Union Trade Mark and the Czech National Trade Mark The grounds for revocation and invalidity of the European trade mark (hereinafter as the "EUTM") and the Czech national trade mark (hereinafter as the "Czech TM") represent a specific field of the trade mark law. The Regulation (EU) 2017/1001 of the European Parliament and of the Council of 14 June 2017 on the European Union trade mark forms a legal basis in this field on the level of the law of the European Union and the Czech Act No. 441/2003 Coll., on Trade Marks, as amended, constitutes a legal basis on the Czech national law level. The practice of the relevant authorities, i.e. the European Union Intellectual Property Office and the Industrial Property Office of the Czech Republic, and especially the jurisprudence of the Court of Justice of the European Union and relevant courts of the Czech Republic play very significant role in this area. Feedback in the management and leadership of non-medical healthcare professionals and management of their work performance

In my dissertation, I discuss the problematic of feedback in a leadership of medical non- doctor personnel and in directing its working performance. My aim was to comprehend and elucidate the process of feedback between superior and subordinate personnel, specifically between bedside nurses/assistive personnel and a charge nurse. As a secondary objective, I decided to investigate potential areas for improvement in leading management and to suggest possible advancements, which could contribute to more effective directing of work performance through the use of feedback. The dissertation is divided into two parts, theoretical and empirical. In the first theoretical part, I begin with defining the meaning of feedback. Following, I introduce topics that include: feedback in social communication, feedback in the process of directing work performance and work motivation. In the second empirical part, I present research conducted with the use of qualitative methodology, where the reader can view the discussed problematic from the perspective of subordinate (bedside nurses/assistive personnel) and superior (charge nurses) personnel. Mobile Hospice Care - Adopting Australian Standards for Patient Admission

Home hospice care - applicability of Australian Standards on patient admission This master thesis inspects topic of home hospice care in the context of the Czech Republic. It aims to provide the reader with consistent overview regarding home hospice and palliative care as dealt with by particular organization, understanding of the topic in a broader context, and further information about the system and practical information. The thesis consists of a theoretical and practical section. The former introduces the general topic, mapping its history from initial thoughts up until the current day home and residential hospices while defining numerous terms applied in the latter. The empirical section then focuses on examining the process of admission of terminally ill patients into home hospice care. Firstly, the approach taken by concerned organization is examined, selecting appropriate Australian Standards for implementation. A three-month implementation period follows, which is reflected on through interviews with team members. The conclusion offers suggestions for improvements in the ways of working and hence the provided care on the whole, applicable across all home hospice teams. The text is targeted at an adult reader. The ARCLib Project: an Open-Source Solution for Long-Term Preservation

The talk informs about the Czech ARCLib project. One of the main goals of the project is the development of an open-source solution for a bit-level and logical preservation of digital documents, respecting the national and international standards as well as the needs of all types of libraries in the Czech Republic. The mission of the ARCLib project lies, among others, in creating a solution that will allow institutions to implement all of the OAIS functional modules and entities, considering institutions’ information model. The architecture is planned as open and modular and the final product will be able to ingest, validate and store data from a majority of software products used for creating, disseminating and archiving libraries’ digital and digitised data in the Czech Republic.

Legal aspects for the adoption of common European currency in the Czech Republic

Legal aspects of the single European currency adoption in the Czech Republic The Czech Republic as a member state of the European Union is obliged to adopt the single European currency as soon as possible. This commitment is connected with plenty of tasks that have to precede the euro adoption. The fulfilment of convergence and legal criteria belongs to main assignments. The purpose of my thesis is to define the main aspects connected with the adaptation process of the Czech legal environment according to demands of the European law that have to precede the euro introduction and prepare a suitable environment for its troublefree functioning. The thesis consists of five chapters, each of them dealing with different aspects of the single European currency adoption. First chapter is introductory and outlines the main questionable issues that I deal with in my thesis. Second chapter brings general aspects of the single European currency introduction, especially explains briefly a history of the constitution of the economic and monetary union, further specifies legal and economic conditions necessary for euro adoption. This bachelor thesis is going to deal with communication over the power network. Aim of this project is to clarify this issue and consequently to use the acquired knowledge for desingning own communication unit. The basic parameters of power network which influence this type of communication are being described in this thesis. The concept of universal communication unit is created. Pheripheral solutions are chosen for this concept and the given device will be made of them. The custom communication unit is created on this basis. The funkcionality of this unit is tested in the work.

Dissertation thesis Competition law limitations of intellectual property rights Abstract Tomáš Kubeša Brno 2015/2016 The topic of this dissertation thesis is Competition law limitations of intellectual property. The thesis therefore deals with the relation between two dynamic fields of law that have gained significant importance in the last decades. Intellectual property law and competition law seem to be in a deep-rooted opposition. The IP law attempts to provide a certain degree of protection and exclusivity to the right holder. Contrary to that, competition law endeavours to provide a level playing field for the competitors to allow the market forces to take full effect. The legal assessment of the mutual relation between the two fields of law has not been provided for by the jurisprudence until quite recently. Czech jurisprudence does not have a complex study on the issue at all. In this situation of uncertainty, case law regarding the interaction of IP rights and competition regulation develops, mostly on the EU level and in the US. The importance of a theoretical approach to the topic therefore increases. Resumé The field of legal protection of industrial property has gone through a turbulent period since the end of the 19th century, as it has had to react, not only to the fast development of international trade but also to the increasing importance of research and technological progress. This requested creation of international systems of protection for individual subjects of industrial property, as well as the conclusion of many multilateral international treaties, which aim to ensure minimal standards of protection and unify fundamental principles and substantive and procedural rules, has significantly helped to simplify the position of applicants seeking protection in more countries, as well as those responsible for overseeing these rights. This thesis aims to provide a complex view of the field of industrial property rights and their protection, which will also be reflected in the individual breakdown of the chapters. Involving users of social services in the community planning process in Karlovy Vary Region

This Master's thesis deals with the description of the current state of community planning of social services and the mid-term planning of development of social services in the Karlovy Vary region. At the same time, the thesis reflects the historical content which led to the use of the community planning method in The Czech Republic. In the thesis, the author uses examples from abroad and from The Czech Republic that show specific problems especially encountered by organizers planning social services. The author bases his research on his analysis of interviews held with planning coordinators in the Karlovy Vary region. From the coordinators viewpoint, they describe structure and course of social service planning processes in the region. The author also examines the role of users invited into the planning of social services, how planning organizers communicate with those users, and how all representatives evaluate the plan's results. An additional information source regading social services planning dealt with publicly available resources, particularly websites of individual cities and their regions. Submitted master thesis discusses patent law legislation in the Czech Republic. The purpose of this thesis is to examine current legislation in particular with the focus on gaining the patent protection as well as following proceedings and to point out possible uncertainties and particularities of such proceedings given by special nature of patent proceedings in relation to administrative proceedings in general. Considering the mutual bond between the substantive and procedure patent law, this thesis also deals with selected substantive issues. Except for the introduction and the conclusion the work is divided into six chapters. These chapters are notionally split in two main parts. First part consists of first three chapters and is considered to be the introduction to the issue of patent law; second part, consisting of last remaining chapters, represents the core of the thesis on its own. First chapter deals with defining the main terms in the field of patent law and intellectual property law as such.
