RESIDENTIAL LEASE ABSTRACT This thesis aims to provide complex analysis of a legal institute of residential lease based on current legal framework (in particular Act No. 89/2012 Sb.) in comparison with the previous legal framework (in particular Act No. 40/1964 Sb., in the version effective on 31 December 2013) while considering the historical context of older legal frameworks of residential lease and the milestones in the development of civil law on our territory. The thesis is structured into 3 chapters which are further divided into subchapters, sections and subsections. The first chapter is devoted to the development of legal framework of residential lease on our territory (except for Roman law framework) until 1989. The beginning of the first chapter outlines the Roman law together with the medieval Koldín's Code. Subsequently are described general characteristics within the historical context of the key Civil Codes which were in force in the specific period on our territory including the General Civil Code (Imperial Patent No. 946/1811 Sb. z. s.), the Civil Code of 1950 (Act No. 141/1950 Sb.) and the Civil Code of 1964 (Act No. 40/1964 Sb.). Protection of property rights in the decision-making practise of courts in the Czech Republic

The dissertation titled "Protection of property rights in the decision-making practice of courts in the Czech Republic" gives a holistic view of the decisions of courts of general judicial system and the Constitutional Court of the Czech Republic in matters relating to the conditions, manner, and limits of the property rights protection. The topic is understood as an interpretation of various institutes in which the courts' decisions claims the most, and as a summary of judgments reflecting every single institute. The dissertation captures the judicial decision-making practice, taking into account the state of the legislation in force until 31 December 2013. The empirical part of the dissertation which corresponds to the selected assignment is preceded by a necessary interpretation of theoretical, doctrinal and historical bases of the topic. The dissertation also reminds the in time-varying insight into the nature, meaning and object of property rights and on the level and ways of protection in the Roman law jurisprudence and civil codes that directly affected the courts application practice in the territory of the present-day Czech Republic. Acquisition, Protection and Limitation of Ownership

The objective of my thesis was to provide a comprehensive survey on ownership as a legal institute and one of man's important values. It should be presented in the historical context and its development should be drawn up both over the course of several centuries and through various communities of people, whether under a totalitarian regime or free. My thesis consists of 4 major parts. Part 1 is dedicated to Roman law and includes chapters on the subject of ownership, acquisition of property, protection of ownership and limitations of ownership. Part 2 describes the development of ownership in our country. Specifically it analyses the General Civic Code - ABGB, Civic Code - 141/1950 Coll. and Civic Code - 40/1964 Coll. My objective was also to give at least a partial insight into the legal regulations regarding ownership in other states. Given the fact that this is an extensive matter, it appeared to be most effective to do a survey of ownership at the constitutional level in EU countries, namely Spain, Germany, Luxembourg, France, Greece, Portugal, Lithuania and Hungary, see Part 3 hereof. I assumed a more detailed treatment of ownership at the constitutional level would be applied in western countries. The legal comparison of alternative care of children in the Czech Republic and the Slovak Republic

The legal comparison of alternative care of children in the Czech Republic and the Slovak Republic There is always present a group of children who cannot for various reasons grow up in their biological family. Obligation of the state in such cases is to ensure that children alternative care. The purpose of alternative care is to protect and nurture children in a safe healthy environment and provide suitable conditions for their healthy physical, intellectual, emotional and moral development. The objective of the thesis is to analyze and compare alternative care of children institute in the Czech and the Slovak Republic from the substantive and procedural point of view with intention to evaluate effectiveness of legal regulation, identify basic problems in the practical realization, outline the principles significant for the further development of alternative care and make proposals de lege ferenda. Focus is put on the analysis of differences in national regulations and their critical evaluation. The study takes into account relevant judicature with an emphasis on the reflection of the best interest of the child principle, right of the child to be heard and right to respect for private and family life in the decision-making practice of the courts.
