Post-Petition Financing in Corporate Insolvency Proceedings

The thesis examines the topic of debtor-in-possession financing, also called post-petition financing, in insolvency law. After a brief characteristic of law and economics methodology, ground theoretical requirements for legal rules of debtor-in-possession financing, as a mean of loan financing of businesses of a debtor in bankruptcy, are formulated in the first place. Next, the Czech Law of post-petition financing, above all regulated under the no. 182/2006 Coll., Insolvency Act, as amended, is analysed, considering its economic effectiveness in respect to transaction costs from the point of view of the subjects. Next part of the thesis focuses on comparison between the Czech Law of debtor-in-possession financing and the same law in the United States of America, where the post-petition financing is regulated under the Title 11 of the Code of Laws of the United States of America. Implications are made from the American Law for the possible future progress of the Law in the Czech Republic. In the end, a possible linear model for testing of expediency of accepting debtor-in-possession financing for the pre-petition creditors of the bankrupt debtor is designed.

This work is focused on rural regions, their definitions, functions, transformations and time development. The emphases is put on relationship of countryside and agriculture. The cooperation of rural municipalities with regards to drawing the grands is also mentioned. The suburbanization consequences toward rural regions is being discussed. The main scope of this test suggests that the countryside has got own trends and it is not possible to apply city trends for. The rural development is important in sense of permanently continuing development principles. Theoretical findings are converted into practice by analyzing area of Brno´s voluntary near by municipality union and also by area evaluation through SWOT analyses and then by suggesting a self-development strategy.
Negotiated procedure

The master's thesis focuses on one aspect of public procurement law in the Czech Republic. Specifically, it provides with thorough interpretation of the Czech legal regulation of conditions allowing for using negotiated procedure with prior notice or negotiated procedure without prior notice to award a public tender. In order to achieve such purpose, the thesis uses information from the 137/2006 Coll., Public Procurement Act, as amended, available doctrinal literature and case law of the Office for the Protection of Competition, Czech courts and the European Court of Justice. The interpretation is performed to compare the Czech regulation with the one contained in relevant European directives (2004/17/EC, 2004/18/EC and 2009/81/EC). After interpretation of these directives focused majorly on differences from the Czech law, the thesis provides conclusions about correctness of transposition of the directives into Czech legal system, which is the core of its focus.

Landscape cultivation and the Agricultural Land Fund management are important fundaments of sustainable development. Therefore I have dealt with the issue of the analysis of conditions of the exemption of land from the Agricultural Land Fund. I tried to create a complex view on this problematic. I dealt with the common introduction, analysis of the contemporary legislation and also practical analysis of specific examples in comparison with the preceding legislation. I suggested some possible adjustments and changes to improve the contemporary situation. I pointed out the bad condition of the environment and legal changes. I suggested changes to protect the nature and preserve the natural values.

The thesis deals with usage of additional services as a marketing technique of utility companies after the liberalization of natural gas and electricity markets. Aim of the thesis is to design a portfolio of additional services that will provide a utility company with a loyal customer base. The portfolio is based on analysis of theoretical background as well as analysis of current supply of additional services on Czech and foreign utility markets.
Restructurization of manufacturing corporation, options for bankruptcy solution

This bachelor thesis deals mainly with the insolvency law and options that this law provides for dealing with bankruptcy. Special attention is paid to proceedings of reorganization. The goal of this work is to revise reorganization in the Czech Republic and its loss and coins as an option for bankruptcy solution. Thesis is divided to theoretical part, which describes crucial aspects of insolvency proceedings and dealing with bankruptcy, practical part contains analyses the course of the reorganization of company Kordárna, which successfully went through reorganization in last year.
