Abstract The main topic of this Bachelor´s thesis is the capital punishment. The aim of this thesis is to chart public opinion on this very controversial topic. The thesis also includes a research in which I examined public opinions on this metters. The aim of the theoretical part is to summarise and to explain the main terminology concerning this issue. It also provides a historical overview of the usage of capital punishment both in the Czech Republic and abroad. It shows the pluses and minuses of the topic and evaluates this issue from the philosophical and historical point of view. The practical part points at the public opinion on the re-establishment of the capital punishment in the Czech Republic. In this research has been employed a quantitative survey using questionnaires. My hypothesis states: People agree with the re-establishment of the capital punishment. The questionnaire has been originated through the website www.survio.cz and has been sent to social departments of various offices. It has also been displayed at the social media within the university where many students could express their opinions. I have gained 355 responces, six of which were discarded due to the incorrect completion. Out of these questionnaires I have created some diagrams featuring public opinion on the given issue. More details are included in the practical part.
A History of Criminal Law in the Czech Lands in 1848-1989

1 Summary Dissertation builds an objective, transparent, systematic and yet concise interpretation of the history of criminal law in the Czech lands in 1848-1989. The aim of this work is, however, not only to chronologically present the most important criminal codes, but also to tell a parallel story of criminal law science and criminology, which to a bigger or lesser degree substantially influenced the development of criminal law and criminal legislation. Therefore, this work also includes biographical and bibliographical profiles of leading Czech educators, criminal law scientists and criminologists - the founders and pioneers of Czech and Czechoslovak criminal law science, whose lives have been closely linked with the complicated socio-political events of the given historical period. History of criminal law shows a strong interconnection of criminal law and policy, which consequently causes the criminal law without proper criminal law science and criminology to be the most politically affected branch of law. For this dissertation is symptomatic the search for critical causes and factors that lead to progress or, on the contrary, to the decline of criminal law. The Issues of Exceptional Punishment - Abstract The aim of this thesis is to provide a comprehensive overview about a criminal law's legal institute of the exceptional punishment, comprising of its historical development in our territory, most of the matters regarding its applicable legal regulation in the Czech republic, analysis of a specific case in which this punishment had been imposed, comparison with selected foreign legal regulations also including a disputation on death penalty as its possible alternative. The first chapter is focused on defining the term of punishment and its function in general. It compares two basic theories that differ from each other in terms of distinct approaches to the punishment's purpose. While the absolute theory considers punishment a retribution, the relative theory regards it as a mean of resocialization of the perpetrator. However, the current concept of punishment is based on the mixed theory that constitutes a link between those two above-mentioned. The aim of this chapter is to define the specific purpose of the exceptional punishment that proceeds from the general purpose of punishment based on the mixed theory. This thesis deals with one of the instruments of criminal law, specifically with the death penalty. The death penalty is already for many years a controversial topic and discussed it around the world. Even if this penalty many states have several years or decades canceled or not applied it, greatly debating whether they should be re-imposed. After an introductory explanation of why I chose the death penalty as a topic of my thesis, followed by a treatise about punishment, its kinds, purpose together with theories that look at this, and more specifically about what exactly is meant by the term death penalty and how the purpose of already listed, relates specifically to it. In the next part of my work we find general historical development of this institute, development of capital punishment in the Czech Republic and international documents concerning human rights and also my theme. In the context of the general historical development we look at how the death penalty looked like in antiquity, the Middle Ages, the period of absolutism gradually until we get to the present. Crime and Punishment in the Eyes of Cesare Beccaria An Analysis of an Enlightenment Penal Law Reform The Ph.D. dissertation is centred around a relatively concise, but extremely influential book: Cesare Beccaria's treatise On Crimes and Punishments (Dei delitti e delle pene). This work, first published in 1764, sums up in a clear, yet intellectually penetrating way all the main Enlightenment principles of a complex penal law reform. In its time, the book was not only of great philosophical importance and it not only changed the way western societies perceived crime and punishment, but it also served as a concrete guideline for various penal law reformers. It is therefore by no means an overstatement to say that it caused a true paradigm shift in both legal and moral philosophy. The main aim of the thesis is to give a legal-philosophical account of Beccaria's thoughts on crime and punishment, to examine their historical as well as moral background and show the actual impact they had on the legislation of many different, mainly European states. A Reconstruction of the Crucifixion of Jesus of Nazareth from the Archeological Evidence and Ancient Literary Sources

The thesis A Reconstruction of the Crucifixion of Jesus of Nazareth from the Archeological Evidence and Ancient Literary Sources deals in nine chapters with the crucifixion phenomenon. Due to its dual approach it is divided into two major parts - general and specific. General part firstly presents the latest scientific treatises dedicated to this phenomenon (1), afterwards introduces the only archaeological evidence of crucifixion (2), analyzes semantical span of terms related to crucifixion (3) and ultimately defines the crucifion penalty (4). Specific part deals with the events of Jesus of Nazareth's case following the pronouncement of judgement. Attention is firstly paid to the flogging penalty (5) and afterwards to the analysis of the royal mockery game (6). Further it focuses on the transition scene, mainly on search for topography of the Way of the Cross (7). The Golgota chapters initially pay attention to the psychological abuse, perception of the crucifixion punishment, resemblance of Jesus' cross (8) and afterwards to the physical abuse and the search for causes of Jesus' death from the medical point of view (9).
