Legal regulation of trading in financial derivatives

1 Abstract This thesis is focused on the financial derivatives. The main goal of this paper is to analyse legal nature of financial derivatives and to present universal definition, general characteristics or utilization of financial derivatives. The other goal of this paper is to describe the development of supervision and regulation before and after The Global Financial Crisis. The thesis is composed of three main chapters. Chapter One is focused on a definition of the financial derivatives as well as the development of derivatives in the fields of history. Chapter Two is dedicated to brief description and explanation of important derivatives types such as forwards, futures, swaps, options and credit derivatives. Chapter Three of this thesis deals with the problems of supervision and regulation of financial derivatives based on American and European law. In response to the causes and effects of The Global Financial Crisis the regulation increased. There were introduced new regulatory legislations which require for example deep transparency of OTC derivatives or settlement of OTC trades through a central counterparty. Analyses of impacts of the new Civil Code on banking transactions

This thesis analyses impacts, which brought recent recodification of private law, on issues of bank transactions through comparison current effective legislative of banking transactions, which is contained in a new Civil Code no. 89/2012 Coll., with previous treatment when most of banking transactions were part of Commercial Code no. 513/1991 Coll. The work describes individual kinds of banking transactions, but it also includes topics as a consumer protection or regulation of business conditions. The goal of this work is try to valorize benefit of these changes and analyze their impacts on banks activity and on their clients.
Social security for women in pregnancy and maternity and their labor-law protection in the Czech Republic and selected European states

The birth of a child brings significant changes into a family life and especially into a life of a woman. One of the accompanying element of this time period is a decrease in family income. Therefore, if the government is interested in fighting the issue of aging population or a low birth-rate, its support and protection is absolutely essential during this period of time. This work describes current shape of the social security system and labor-law protection for women during pregnancy and maternity in the Czech Republic and introduces in detail every single social benefit that is provided by the system in case of legal foreseeing of such a social occurence. Simultaneously, it has been done a comparison of our system with the systems of selected European states.
