Domestic violence by the criminal law and by the criminological aspects

The rigorous thesis summarizes "Domestic violence by the criminal law and by the criminological aspects". The phenomenon of domestic violence is a part of the society since the beginning of time. However, the wider approach has been registered a few decades ago due to the feminist's activism. The comprehension of domestic violence in society has changed and it is considered as a common problem that inquires a complex interdisciplinary cooperation, an intervention and state assistance. This rigorous thesis consists of six chapters. In the introduction (introductory chapter), there is a description of domestic violence - definition, indications and dynamics. This part explains the general theoretical information about domestic violence that is necessary for understanding the phenomenon, the history of domestic violence and pathway to the adoption of the law that would regulate this problem. Furthermore, I introduce different types of the domestic violence, comparison of domestic violence with so-called stalking. The criminological part focuses on a violent person and a victim with typology of perpetrator/offender and victim. I specify possible causes that might influence the origin of domestic violence. Accessability of Social Services in the Issue of Domestic Violence Against Women from the Perspective of Social Workers.

Domestic violence in Czech Republic has been for a long time and unnamed taboo. In the 1990's it came to legislative changes, none-profit organizations interested in this phenomenon were established and they started to promote this issue among the general public. Nowadays there is growing an intensive need that forces us to explore domestic violence in our country. The aim of the study was to ascertain the availability of social services for victims of domestic violence according to the opinion of social workers. There was used a qualitative research strategy. Data collection was conducted through semi-structured interviews with six social workers, who were selected by an intentional (purposeful) choice, and who all work in the field of assistance to victims of domestic violence. The theoretical part introduces the basic concepts related to domestic violence, its character, forms, reasons, the course of domestic violence, the typical profile of the offender and the victim. In the next section I focused on the legal framework, which is valid for the Czech Republic. One chapter is devoted to social services providing their assistance to victims of domestic violence. In the last chapter there are social services concretized to those, operating in České Budějovice. The practical part describes the results of qualitative research, based on individual case studies located in the appendix of work. Thanks to compiled research results there was an opportunity to look into the issue of assistance provided to victims of domestic violence in the regional capital city of České Budějovice, and find out whether this service offer meets the demand of the clients who use them. The results show what kind of various services organizations offer to its clients, in which catchment area, in what form and how many clients are they able to take. Research also showed that the offer of social services for the city of České Budějovice is sufficient, but according to respondents, there are still things to be improved. There is an option to contact a number of organizations providing assistance to victims of domestic violence. However, this situation is not as positive in the smaller towns of the South Bohemian Region. The work could, in my opinion, contribute to greater public awareness about service provided for victims of domestic violence.
Child as a victim of domestic violence

Domestic violence is currently seen as a significant social problem; it is a form of violence that is widespread throughout the world, in all cultures and all social strata. Domestic violence is usually directed against women, to a lesser extent also against men or senior citizens. Children living in families at risk of domestic violence should be seen as indirect victims of domestic violence too. Domestic violence does not threaten the victims only, but also children who are present in violent incidents between the parents. This thesis, which is focused on children as victims of domestic violence, is divided into a theoretical part and a practical part. The theoretical part explained the basic concepts in this field. In the beginning, it was important to highlight the importance of family, its essential functions and vital role in meeting the needs of all its members. Another section explains the definitions of domestic violence, the key features of family violence, its types and forms, as well as victims of domestic violence are dealt with. In connection with the focus on the child as a victim of domestic violence, the CAN syndrome is explained as an issue of maltreated, neglected and abused children. Finally, is described the possible impact of the presence of domestic violence in the family on the development and psychology of the child. The thesis also summarizes the possibility of legal protection for persons at risk of domestic violence, including interventions and assistance to victims. The practical part of the thesis processes the results obtained by quantitative research, both from the statistics of the Intervention Centre for Help to the Victims of Domestic Violence at the Diocesan Charity in České Budějovice and the data obtained from a questionnaire sent to institutions, at municipal authorities of municipalities with extended powers, for the social and legal protection of children. The objective was to find out whether domestic violence occurs mainly in families with children and what the effect of domestic violence in the family is on the child?s mental development. The region concerned was South Bohemia. Based on the data obtained, the following information was found: the total number of households with domestic violence in which minors were present, the total number of threatened children, and the impact of violence among adult household members present on the psyche of children.
