The status of persons placing public contracts in specific sectors Abstract The topic of the thesis is the position of the utilities contracting authority. Although the new regulation, ie Act No. 134/2016 Coll., On Public Procurement, as amended (the "Act") does not explicitly include the term "utilities contracting authority", the concept of public procurement regarding utilities has remained de facto preserved. To emphasize not only this but also some other vital facts, the thesis compares the contemporary legislation with the previous legal regulation of the matter. At the same time, the thesis attempts to take a comprehensive approach to the area of public sector (utilities) procurement and its specifics, in particular through comparisons of legislation affecting the award of utilities public procurement and oteher public procurement in general. In the first part of the thesis I define concepts that are fundamental to the subject of this thesis, ie terms such as "contracting authority", "public contract", "dominant influence", "special or exclusive rights"or "relevant activity. Other parts of the thesis are devoted mainly to utilitis specifics and "reliefs". Resumé Problems associated with awarding of public procurement by sector contracting entities The topic of this Dissertation is presentation of certain problems associated with awarding of public procurement by sector contracting entities. To begin with, basic issues of tenders and public procurement procedures are presented in a legal framework, referring not only to the Laws of the Czech Republic but also to the Laws of the European Union. This part includes definitions of basic terms, especially the public procurement concept and principles of applicable legislation. A short historical context concerning development of the legal norm after 1989 is provided. In the actual text, appropriate attention is paid to differentiation of public contracting entities with an emphasis on the content and development of the term "sector contracting entity". The definition of sector contracting entities is a key term of this Dissertation. The process of awarding of public procurement by a sector contracting entity is subject to numerous legal exemptions, as well as some specific law regulations. These exemptions and law regulations are described and thoroughly analysed in the Dissertation. The analysis of a relationship between the level of public ownnership and the procurement effectiveness in utilities sector

This master thesis is focused on the public procurement in the utilities sector. The main objective is to analyze the influence of the level of the public sector ownership on the public procurement effectiveness. To give the complex view of the problem, the study also determines the final impact of the public procurement effectiveness on the global operational effectiveness. The theoretical part starts with the analysis of the legal directives and the environment in the relevant sectors. The analytical part uses the econometrics methods for the data file of utilities sector procurement from the period of 2006-2011 based on the information from ISVZ and Creditinfo-Albertina systems. When the conclusions are made, the public sector ownership has the positive impact on the public procurement effectiveness but the contrary effect on the global operational effectiveness.
Coverage of sectoral ordering parties with Public Contracting Institute

The main object of my diploma thesis is to quantify an amount of costs invested in contracts awarded in conformity with rules stated in the act on public contracts. Theoretical part dwells on contents of directives whereas practical part uses data comparison -- amount of public contracts obtained from Information System and accounting statements obtained from the Creditinfo -- Albertina and Report database accessible from VŠE local network. Commented conclusions of analysis -- determined ratios are low and mostly do not exceeds 50 %. Simultaneously is not possible to determine a rule which could be broadly utilized on specified types of public contracts.
Aplikace zákona o veřejných zakázkách v praxi

Diplomová práce se zabývá tématem veřejných zakázek, především aplikací zákona v praxi. Teoretická část vysvětluje pojmy používané v zákoně. V analytické části jsem se věnovala problematickým místům zákona, jako např. zjednodušené podlimitní řízení, čtení nabídkových cen při otevírání nabídek, podání více nabídek, prokázání kvalifikace prostřednictvím subdodavatele a dalším.
