The development of legal regulation of foster care benefits since 1995 up to the present

My work is focused on a topic: The trend of foster care benefits since 1995 to the present. Foster care is one of the forms of alternate family care in the Czech Republic, in case of parents´ disability or unwillingness to care about their child. Government provides creature comforts for a child resigned to foster care by foster care benefits. The foster care benefits have changed a lot since 1995 up to now. By the year 2012 foster care benefits were governed by law n. 117/1995, code about state social support. The amendment of act n. 401/2012 c. has classified the foster care benefits as a part of a law n.359/1999 code about social-legal protection. At the same time changes have happened in a foster care professionalization and claim conditions of the benefits. The mere foster care was regulated by the law n. 94/1963 code about family until 2013, after that it has become a part of the law n. 89/2012 of Civil Code. The aim of my baccalaureate work is to find how foster care benefits legislature influences the care of foster parents in a view of social-legal children protection´s ("OSPOD") workers of a council with extended force in South Bohemian region. In an empirical part is described qualitative research. For the research proposals was chosen 5 communication partners by an intentional choice method, they are social-legal children protection´s workers. It was chosen an interview method for receiving required files. A semi structured interview was chosen from these types of interviews. Particular questions were selected in order to be able to find out three main and three partial questions: Main research questions: 1. How has foster care spread in the particular time? 2. What is the point of view of social-legal children protection´s workers (advantages, disadvantages) of revised statutes and their possible changes of the legislature. 3. What are the differences in opinions in various councils with an extended force? Partial research questions: 1. What is better for a child foster care or a stay in an institutional facility? 2. What is the cooperation or communication among "OSPOD", foster parents and employment office like? 3. What do social-legal children protection workers think about foster care agenda? The evaluation of received files was done with a comparative method. From the research arises that legislature dealing with legal arrangement of foster care benefits since 1995 to the present, influences care of foster parents in a view of "OSPOD" workers of employment office with an extended force in South Bohemian region, leading to faster and more efficient placing of vulnerable children to foster families. Foster parents have more jurisdiction as child educators. Financial estimation plays a fairly big role in an increasing number of foster parents as well. According to the research results, children placed in foster families feel better there than in institutional facilities. The main fact is that a child in a foster family feels family belonging more and creates new emotional relationships to their foster parents, gets more love and understanding. Foster parents have more time for solving children´s problems and they create required background for a child personality forming. This baccalaureate work can be used as a supporting material for students of social branches or for "OSPOD" workers. The work can help foster parents for getting more information about foster care and foster care benefits as well.
