Detention Proceedings in the Czech Republic Abstract The thesis Detention Proceedings in the Czech Republic is focused on the effective substantial and procedural legal regulation of the proceedings held to assess the legality of patient's admission to the health-care institution without its consent, which is summarily called the detention proceedings. The thesis therefore concentrates mainly on the proceedings held about individuals hospitalized without their consent and also about the proceedings held to assess the legality of restrains on liberty of the patient hospitalized with granted consent. The thesis is divided into two main parts and contains also the third part with de lege ferenda thoughts. The first part is focused on the bases of detention proceedings contained in international covenants or treaties and in the constitutional order of the Czech Republic, further it is concerned with de lege lata legal regulation in the Civil Code, in the Act on Healthcare Services and in the Act on Special Court Procedures. The thesis closely analyses the different types and phases of the detention proceedings, theoretically as well as practically, as it reflects practical experience of an assistant of a judge involved in the proceedings.
