Liquidator's Possition in a Liquidation Process

The aim of this thesis is to analyse the process of a company's liquidation and most importantly the analysis of the position of the liquidator in this process. Based on an undertaken analysis, a model of the process of liquidation was created and is filed into the analytical part of the thesis. The thesis contains the detailed account of particular liabilities, rights and liquidator steps in the process of liquidation. It answers the questions of the responsibility of the liquidator in the process of the liquidation, the justice of the procedure, the fulfilling of the tax liability, the fulfilling of the liability resulting from running the accountancy connected with the financial reporting, the publishing information and specifications concerning the liquidated company. Last but not least, this thesis finds the answers to discharge creditors' claims, pay the remaining assets, and file a proposal and erase the company from the trade register. There is also a part, which concerns the analysis of the company's period before entering the liquidation and reasons for its entry to liquidation. The important part of the theses is the elaboration of this issue within trade companies, such as investment companies, investment funds, share funds, pension funds, insurance companies, the securities dealers and the others carrying the business in accordance with law of capital market.
Comparison of corporate bankruptcy solutions

The aim of this bachelor thesis is to compare solutions of corporate bankruptcy in the Czech republic and Poland. The content of this thesis are described insolvency proceedings in both countries and their following comparison based on international statistics. A benefit of this thesis is a different view on insolvency environment by help of comparison with Poland. The comparison criterions are the main indicators for evaluation of effectiveness of insolvency proceedings in both countries. The reasons for values of the criterions of time, cost and recovery rate of insolvency proceedings are stated with most imported causes for those values.

The Current State of Destruction of Chemical Weapons in the World

The subject of this thesis is a description, mapping and assessment of the present situation concerning the destruction of chemical weapons in the world. This thesis also attempts to predict the future development in this area. The introductory part presents the meaning of essential terms, the characteristics of chemical weapons, the classification of chemical warfare agents, the history of the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction, the description of this document and the subsequent formation and work of the Organisation for the Prohibition of Chemi-cal Weapons, its relations with the United Nations and an overview of the countries which stay outside the commitments of chemical disarmament. The goal of this work was to explore and evaluate the present situation concerning the destruction of chemical weapons in the world and to try to predict further develop-ment in this area. The methods used to map this problematic situation were to gather information from professional sources and involved organizations, then to compare the results of each country during their chemical weapons destruction in relation to their obligations to complete the liquidation. The outcome of this work was the confirmation of the hypothesis that despite the great efforts of the international society, despite the great efforts of general public and each country{\crq}s involved subjects at the national chemical weapons destruction in the world, this work has been succeeding very slowly and with great difficulties. To achieve complete disarmament will lie on the condition that countries will be subjected to effec-tive international control and that negotiations with countries which still stay outside the process of chemical disarmament will be hold even after the final deadline for disarma-ment in 2012.
Illegal dumping sites of hazardous waste.

This thesis deals with the issue of illegal dumping of hazardous substances and waste in the Czech Republic. It is mainly focused on a possible emergency incident and the subsequent management of an emergency situation. The objective of the thesis is specification of these dumping sites, a concept of the methodical procedure for the components involved in emergency management, and also to identify possibilities of hazardous substances and waste disposal, or to find other alternatives. To evaluate possibilities of illegal dumping sites detection by state administration bodies. To meet these objectives it was necessary to study available resources, including legislation. And then to carry out a detailed analysis of illegal dumping sites of hazardous substances and waste detected in the past, with respect to the type and quantity of substances deposited. The analysis also comprised participation of the components involved in the case of an emergency and the procedure of emergency management after the case discovery by the authorities. The intention is to provide enough information for a safe emergency management in the event of further revelations of illegal dumping sites of hazardous substances and waste. The outcomes of this thesis may be used in training of the components involved and as a basis for model activities of the Integrated Rescue System components. The thesis was elaborated on the basis of a research and case studies with experts involved in comprehensive handling of the issue. The outcome of the thesis is a proposal of a methodological procedure for components intervening in an emergency incident, possibilities of illegal dumping sites detection and findings in the field of hazardous substances and waste disposal. Restriction of the impact of these emergency incidents consists in prevention of other illegal dumping sites occurrence. It is necessary to monitor dangerous substances and waste movement, to pursue inspection activities through authorized bodies and to update certain laws, such as the law on insolvency.
Bankruptcy in the Czech Republic and in the European Union

In economic and legal practice situations often occur when infringement of rights or neglect of duty can{\crq}t be sanctioned by common means of procedural law. The most typical example of this is when the debtor has liabilities towards a number of creditors and it isn{\crq}t within his power to fulfill them all. Such a situation is usually described as bankruptcy and it is solved in accordance with the Bankruptcy Act. Bankruptcy is considered to be the last resort of settlement of unfavourable financial and economic relations between the creditor and the debtor and it leads to the settlement of their property relations. The purpose and the aim of this procedure is to settle the liabilities towards the aggrieved parties, so that all creditors of one debtor which is in bankruptcy get as equal and just satisfaction as possible. Liquidation or reorganization of multinational companies which are in bankruptcy causes a whole range of legal complications. The expansion of multinational companies and also the considerable number of great bankruptcies with international effects has triggered a debate about the need of creating a system which would involve solving such situations in transnational context.
Liquidation as a Form of Decline on The Example of Cooperative

The diploma thesis deals with the topic of liquidation as a form of economic decline of companies. In the theoretical part of the thesis economic decline is outlined and the legal regulations related to the process of liquidation are elaborated. The practical part of the thesis provides the reader with the analysis of statistical data regarding the insolvency and liquidation processes in the Czech Republic and with the further description of the particular case of liquidation on the example of Cooperative G 19.
Liquidation insured accident

This Bachelor's thesis deal with the process of liquidation insured accident with externalization to motor-powered vehicle. The thesis is focused on procedure, practice and phase by which the insured accident passes by the liquidation. There are charted the process and the work load of the insurance surveyor. At first there are theoretically delimited individual sorts of automobile insurance, in fact accident insurance and the damage liability, their construction and the creation of reserves. Other part is focused on the process of liquidation of insured accident which is composed of the damage reports, after that the registration of insured accident, liquidation, payment of insurance benefit and the archiving. There is also mentioned the problem of insurance default.
