Rights to sign in Czech positive law

and keywords The purpose of the thesis is to analyse the legal regulation and the system of registration of rights to signs, which are most commonly used on national as well as international markets, i.e. rights to a trademark, appellation of origin and a geographical indication. The aim of this thesis therefore includs definition of the registration system of the mentioned rights to sign with reference to their specifications, the registration ability conditions (taking into consideration the decision practise of the Industrial Property Office), as well as the different character of protection of their owners. Significant attention is also paid to the system of legal protection of the rights to sign with respect to the fact, that there exists the national, international and Communitary system of protection of these rights. The beginning of the thesis describes the structure of rights to sign, the corresponding specification of concept of intellectual and industrial property rights and it characterises the subject of industrial property rights with respect to the legal regulation, the conception of legal protection of industrial property rights and conditions of grant of protection. The relationship of trademarks and geographical indications - The dispute relating to the designation Budweiser

The rigorous work is focused on the relationship between trademarks and geographical indications in the framework of the dispute relating to the designation "Budweiser" between Czech brewery Budějovický Budvar and American brewery Anheuser- Busch. It describes in detail the legal regulation of the protection of geographical indications and trademarks with dividing into the international, European and national level and the history of the designation Budweiser in the Czech Republic and USA. It dedicates to the litigations relating to the designation "Budweiser" in selected countries - Great Britain, Finland, Austria and Portugal, regarding specifics of their course and/or specifics of judicial decisions. Last but not least it concerns the dispute relating to the designation "Budweiser" in the framework of European Union and World Trade Organization.

Tomšů,J. Protective signs - trademarks, designation of origin and their relationship to consumer protection. Bachelor thesis. Brno: Mendel University in Brno, 2015. This thesis deals with the problems of protective marking, respectively registered trademarks, designations of origin of products and the relationship of these legal protections to consumers. In the theoretical section cardinal areas of this issue are described. Attention is paid to the legal treatment of this issue in the Czech Republic. In the practical part is in the model situation demonstrates the process of application of law in the process of registration of the trade mark. The conclusion of the work includes the assessment of the situation in the areas of the protection and valorization of applied marking procedure.

Diploma thesis deals with protected designation of origin and protected geographical indication. Theoretical part concentrates on national and community legislation of geographical indication, especially addressing differences in definitions, rights, and registration processes. Practical part deals with the economical influences of geographical indication for producers who use this indication for their products. Influences are re-searched especially with the help of variable cost, purchase price, and price elasticity. These variables are compared between producers who use geographical indication and producers who do not.

This bachelor thesis deals with designations of origin and geographical indications of products and determines the benefits and risks to Czech entrepreneurs and consumers. The first part deals with modification of labels in the European Union and national markings called quality marks. Explains the basic differences between trademarks and protected indications and focuses on solved disputes between them. The main part provides view on the impact of indication on sale of products. It deals with their importance and points to propagation of labels. The last part is focused on disputes concerning the designations of origin or geographical indications of Czech and foreign products.
