Awarding of public contracts in the decisions of the Office for the Protection of Competition and the Court of Justice of the EU Abstract This diploma thesis, structured into an introduction, four main parts and a conclusion, deals with the issue of public procurement in the decision-making practice of the Office for the Protection of Competition and the Court of Justice of the European Union. Public procurement is a key factor affecting the management of public sector entities, with a significant impact on the state finances and citizens' quality of life. The current problem lies in frequent occurrences of corruption and lack of transparency in public procurement, leading to ineffective use of public funds. The aim of this thesis is to identify typical breaches by contracting authorities in the light of decision-making practices and to provide them with guidelines on how to set appropriate procurement conditions and avoid mistakes, thereby increasing the efficiency of procurement procedures and minimizing the risks of legal challenges to the procurement process. The secondary objective is to examine the evolution of legal opinions of the decision- making bodies regarding identified violations of the law by contracting authorities. Offer of the Construction Company to Public Tender

The thesis addresses the process of assigning construction contracts and its acquisition from the perspective of the construction company. The task is focused on creating public tender`s price propositions by the contender. These findings are from my own personal experience as I was involved in the creation of this particular price proposition. At the time of publication of this tender I worked in a construction company INSKY spol. s r.o. which is mentioned in this thesis. I described the terms which you may encounter during assignment, the progress and the finalization of the contract of the public tender.

In the master thesis are explained terms related to public contract. The greatest attention is devoted the various types of qualification assumptions. The main objective is to compare qualification requirements of public works contracts in the field of water management structures. The analysis was performed on four specific public contracts, with an analysis of the differences between them were found. Public contract, open procedure, simplified sub-limit management, qualification, qualification requirements, the sponsor, the expected value, the law on public contracts.

Construction Order Preparation and Management from Aspect of Investor

The thesis statement is focused on construction order planning and management from investor point of view. The theoretical part consists of particular project phases including financing and public orders problematics. The theoretical knowledge is applied on specific public order. The town Nové Město na Moravě was asked for cooperation as an investor and the town provided the project Community retirement home for this thesis purposes. Whole practical part is focused on this public order preparation and management. All documentation related to this topic is contained in the thesis and the investor can use this documentation as a background for further projects. Last part of the practical part concerns the order funding, the financial plan is attached.

This Master´s Thesis deals with the issue describing preparatory work for a construction contract submitted for a public tender. Its main objective is to demonstrate the negotiation procedure with sub-suppliers the purpose of which is to obtain more advantageous offer and the assignment of a contract. Last but not least, the thesis analyses appropriate steps leading to financial savings. The theoretical part is dedicated to the explanation of basic terms and definitions circumscribing public contracts, their contracting authorities, types of public contracts and the tendering procedure and its actions. The practical part then analyses and demonstrates on the specific example preparatory work of the contract for a public tender, its assessment and potential ways of financial savings.

This thesis deals with the financing contract from a practical point of view. The aim of this work is to describe the possibilities of financial security building contracts from the perspective of the supplier. In the theoretical part are characterized by basic concepts related to the topic and a practical part of the thesis describes the public works. The practical part of the procurement documents to obtain the tender and subsequent recording contract for work. The example of the practice was described the process of financing construction of the contractor. The work shows a significant difference between planned and actual funding process.
