The current development of copyright law in the digital environment with the emphasis on the legislation of the EU Abstract This rigorous thesis follows up on the thesis from 2018 titled "Internet and Copyright", which generally dealt with the scope of copyright law in the internet environment and was concluded by a basic presentation of the forthcoming copyright reform in the Digital Single Market in the European Union. The goal of this thesis is therefore to reflect and analyze not only the result of this reform, which was completed in the meantime at the EU level and moved to the implementation phase at the level of the member states, but also other related developments that have taken place in the field of copyright in recent years, with relevance for the digital environment and information society in general. The thesis is systematically divided into two parts. The first, more general part creates the theoretical and legal basis of the thesis, in which the following interpretation is embedded. Current development of the European legislation regarding copyright

This thesis "Current development of the European legislation regarding copyright" deals with the current EU proposals on the modernization of copyright. For the purposes of this work, I have determined as "current" the proposals and documents published between 2015 and 2017 due to the consistency of the pursued objectives and the close interrelation between relevant EU documents. The main target of this work is to present key documents, whether accepted or proposed, to update European copyright for the needs of the digital world. This work is divided into eight chapters representing not only the proposals but also the environment into which they will be incorporated. For this reason, the first three chapters briefly address the introduction of the basic concept of copyright, as well as the harmonization of rights in the EU and the existing legislative framework in Europe (including international treaties and EU measures). In the following chapter, I introduce digitization and the internet as important factors, which affected copyright to such an extent that it appears in some ways to be completely incompatible with modern age. The thesis deals with conditions of the emergence, extent, limitation and exclusion of the responsibility of the hosting type information society providers (ISP) for the foreign content, within the context of the communication to the public of the copyrighted work. The relevant provisions of national law are specified and critically analysed in the thesis. The thesis focuses on the legal construct of the safe harbour and impacts on the information society providers, considering the effective laws and the case law of the courts.

Exceptions for Cultural Heritage Institutions under the Copyright Directive in the Digital Single Market

On the 17th of April 2019, the EU Directive 2019/760 on copyright in the digital single market entered into force. The directive responds to the development of digital technology that enabled new uses of copyrighted works. The paper focuses on the exception for making copies of works by cultural heritage institutions (introduced it the Art. 6) and rules for using available out-of-commerce works (described in the Art. 8). The two legal concepts described above are selected for further analysis due to their relevance for the day-to-day operation of every library, archive or repository.

Impact of the Directive on Copyright in the Digital Single Market on Libraries and Repositories

For libraries and repositories, the articles regulating new exceptions and limitations are the most relevant in the newly adopted Directive on Copyright in the Digital Single Market. This contribution however will focus on other provisions (in particular measures to achieve a well-functioning market for copyright, i.e. Article 17, concerning the use of protected content by online content-sharing service providers and Article 15 on protection of press publications). The paper gives an overview and a critical analysis of the potential impact of these provisions and explores the possibilities of the Czech legislator in their implementation.

Consumer protection in the European Union

This thesis is focused on consumer protection in the European Union with a special emphasis on online shopping. The first section defines the term 'consumer protection', its development, institutional support, instruments and financing. Also, this part describes the digital market of the European Union, hindrances to the growth of online shopping as well as strategies which are created in order to form a digital single market in the European Union. The second section focuses on protection of personal data, alternative dispute resolutions, current legislation regarding consumers rights on internet and new proposals from the European Commission. The new proposals dominate the second part of this thesis and are discussed with an expert. A survey has been conducted to find out more about the Czech experience with problem solving when shopping online. Moreover, this thesis does not leave out court orders from the European Union´s Court of Justice which have led to the uniform application and interpretation of the consumer protection in the European Union.
