System of Financial Market Guarantee Funds in the Czech Republic

This bachelor thesis examines the Financial Market Guarantee System in the Czech Republic and its funds. It aims to describe and analyse how the system works, describe its history and development as well as its legislative establishment in the Czech Republic. The thesis is divided into theoretical and practical part. Theoretical part describes both funds - Deposit Insurance fund and Resolution fund. Description contains competence and relevance of those funds, European regulation and system of contributing. Practical part calculates contributions of two Czech different sized banks to the Deposit Insurance fund and to the Resolution fund. Those illustrative contributions seem to be quite realistic. The thesis also deals with the ability of the system to help banks or other institutions in financial problems, this ability is very limited. Practical analysis also mentions the possibility of reducing the contribution.

The investor compensation schemes are special compensation mechanisms financed by investment firms (securities broker dealers) whose main purpose is a protection of retail investors, customers of securities brokers dealers, against a default of securities broker dealers (investment firms) resulting in their inability to meet their obligations against their clients and to return to the clients their assets which were entrusted to these firms in connection with investment business. In the case of such failure the compensation schemes will compensate the loss to the clients (in a specified amount and under given conditions). The investor compensation schemes therefore substantially strengthen the confidence of investors in the capital market which is absolutely necessary not only for their smooth operation but also for the smooth operation of the whole economy. Financial Market Guarantee System

This bachelor thesis follows up the Financial Market Guarantee System in Czech republic and aims to describe its establishment based on the regulation of the European Union, its competence and relevance in Czech republic. The Thesis is divided into theoretical and practical part. Theoretical part describes the development of the Deposit Insurance Fund, new legislation of the European Union and Czech law, which is based on European Union legislation. Practical part mostly examines newly established Resolution fund. On the sample of three different sized banks is shown the impact on the profit as a consequence of the contribution to the Resolution fund. The second part also focuses on ability of the system to help banks in financial problems, which was proven as very limited. Practical part in addition provides estimate of the annual contribution to the Resolution fund, which turned out to be quite accurate.
Analysis of Guarantee Schemes

This bachelor thesis is dealing with a consumer property protection on the financial market. The consumer protection in the European Union has a huge attention; the measures for the improvement were taken under the influence of the financial crisis. The thesis focuses on the development of the European legal regulations, which determinates the problems. The single chapters of the thesis aim particularly on Deposit Guarantee Schemes and Investor Compensation Schemes. A special attention is dedicated to a function of Guarantee Schemes in the Czech Republic. The cases, which the Deposit Insurance Fund and the Securities Dealers Guarantee Fund had to deal with, were analyzes. As well as the methods of funding of compensation payments to eligible persons were analyzed.
Consumer protection on financial markets

This thesis focuses on the description of the main principles and instruments of the consumer protection concept on the financial market of the Czech Republic. It aims to justify the legitimacy, assess the efficiency of the concept and evaluate the extent to which consumer protection is provided. An extensive part of the text is devoted to a detailed specification of the legal term "consumer". Czech legal framework is the primary source for the text. Applied methods are interpretation of Czech legal standards and a description of specific selected instruments that are followed by general deductive implications. The conclusions of this paper are suggestions concerning the efficiency of certain instruments and the determination of a sphere, where consumer protection should be strengthened.
The Significance of the Deposit Guarantee Schemes in Different Countries

The aim of this thesis is to compare DGS European Union member states before the unification of law and analyze the current situation and developments in this area in the European Union with a more detailed focus on the Czech Republic. Another objective is to evaluate the significance of the Deposit Insurance Fund in the Czech Republic and its ability to meet its obligations. At first are given the fundamental characteristics of the elements of context and parameters of deposit insurance. Then it is made a legal analysis of important directives on deposit insurance, which determine the current situation and developments in this area in the European Union. On the basis of events caused by the financial crisis, a single fixed level of insurance coverage had been introduced in the European Union. The thesis contains a comparison of deposit insurance systems of the Member States prior to the unification of this law. Attention is paid to deposit insurance in the Czech Republic. A determined importance of the Deposit Insurance Fund and the characteristics of its activity are also described. Finally, the thesis contains an example describing the Deposit Insurance Fund meeting its commitments to Volksbank CZ, illustrated by the situation where this bank is unable to meet its obligations to beneficiaries.
