Banking contracts

This diploma thesis deals with the topic of banking contracts. Banking contracts can be specified as contracts typically closed by the bank, along its business activity. The aim of this thesis is an analysis of an effective legal regulation of banking contracts. As from the point of common features of banking contracts, then also from the point of view of individual contract types. Although the diploma thesis is elaborated based on effective legal regulation of the Act No. 89/2012 Coll., the Civil code. The author tries, within the frame of each section, bring attention to the most important changes in comparison with the present legal regulation. The thesis is divided into two parts. The first one is dealing with common characteristic of banking contracts. The author defines the idea of bank contracts, summarizes relevant legal regulations and defines contracting parties. Intensified attention is given to a bank as to a typical subject, closing banking contracts on the side of the service provider on one side and to a consumer as a receiver of these services, based on his better protection on the other side. Analyses of impacts of the new Civil Code on banking transactions

This thesis analyses impacts, which brought recent recodification of private law, on issues of bank transactions through comparison current effective legislative of banking transactions, which is contained in a new Civil Code no. 89/2012 Coll., with previous treatment when most of banking transactions were part of Commercial Code no. 513/1991 Coll. The work describes individual kinds of banking transactions, but it also includes topics as a consumer protection or regulation of business conditions. The goal of this work is try to valorize benefit of these changes and analyze their impacts on banks activity and on their clients.
Legal form of checkable deposit and time deposit

The thesis deals with legal form of checkable deposit and time deposit in the Czech Republic. The study primarily describes formation, alteration and discharge of contractual relationship, which is formated between the bank and the bank customer in terms of contract of checkable deposit or contract of time deposit. The thesis primarily deals with the position of retail bank customer, which is not a business entity. From the standpoint of theory, the text focuses on mutual rights and obligations of both contractors. The analytical part compares the offer of checkable deposits for students in two Czech banks (Komerční banka and Česká spořitelna) with a view to legal terms.
