Beneš-decrees and the accession of the Czech Republic to the European Union

The thesis called Beneš-decrees and the accession of the Czech Republic to the European Union focuses on the Beneš-decrees as a restriction of the accession to the EU. The thesis aims at verification of hypothesis which says that the Beneš-decrees could not be in contrary to EU law (acquis communautaire). Methodology used in my thesis are analysis of law documents, ten Beneš-decrees, Amnesty act and comparison of law opinions. The first chapter defines the concept of the Beneš-Decrees eleminating the number of decrees only to ten, which are relevant for my thesis. The second chapter summarizes the period of time after Beneš-decrees were published and deals with the Sudeten German question . The third chapter focuses on the role of the Beneš-decrees in the current legal order of the Czech Republic. The last chapter defines conditions needed for joining the EU, how the Czech Republic fulfilled these conditions and compares four legal opinions, which were expressing compatibility of Beneš-decrees and Amnesty act with acquis communautaire. In the end, I summarize the most relevant arguments mentioned in legal opinions and answer the scientific question and hypothesis I set in the begining.

The thesis examines the Benes decrees and the accession of the Czech Republic to the European Union. The paper focuses on legal issues concerning compatibility of the legal order of the Czech Republic, having the Benes decrees as its integral part, with so called acquis communautaire -- legal order of the European Union. The thesis aims to answer the question of what legal issues challenged the readiness of the Czech republic to join the European Union. The first chapter explaines the term Benes decrees and defines which decrees are relevant to the accession to the EU. The following chapter focuses on the role of the Benes decrees in the Czech legal order as well as on the conditions for EU membership. The last chapter compares four legal opinions concerning the Benes decrees and their compatibility with acquis communautaire. In conclusion, the thesis provides an answer to the research question as set down in the introduction.
