Changes in canon law from the Second Vatican Council to the present Abstract This thesis deals with the development of the canon law of the Catholic Church from the beginning of the Second Vatican Council to the present day, that is, from 1962. The aim of the thesis is to give an overview of the most significant amendments in the field of canon law in the period covered. During this period, six popes (including John Paul I, whose pontificate lasted only thirty-three days) succeeded at the head of the Catholic Church. The first chapter of the thesis studies canon law as a legal discipline in the context of secular law. The second chapter deals with the period of the Second Vatican Council, its convocation, and its successive four sessions. During the Council, the death of Pope John XXIII occurred. He was succeeded by Pope Paul VI, who immediately expressed his willingness to proceed with the Council and presided over the Council from the second session onwards. In particular, the individual subchapters analyse the sixteen documents issued by the Council during the sessions, which became the ideological basis for the subsequent changes in canon law. Basic principles of the law of religious institutes of the Latin church Abstract The diploma thesis deals with the basic principles of valid law of religious institutes according to the 1983 Code of Canon Law. It also describes the legal-historical development of the basic communities of the evangelical orders. Emphasis is placed on the organizational structure, the activity in society and the most important monasteries in which the community operates. In the general part, the ecclesiastical and special sources of the legal regulation of religious life are discussed. The general part also includes an account of the formation of religious men and women, public vows and institutes related to the communities of the Gospel Councils (e.g. personal prelature, hermitage life, the state of consecrated virgins). In a special section, the individual groups of male and female communities of evangelical orders and their legal-historical development in the Czech lands are discussed. Legislation of the provision of spiritual care in the armed forces of the Czech Republic The thesis deals with the legislation of the provision of spiritual care in the armed forces of the Czech Republic, a subject of the field of religion law. Spiritual care in the armed forces is a manifestation of religious freedom provided in the Czech Republic by a system of legal sources of various legal powers. The aim of this thesis is to analyse all these sources, describe their relationship and evaluate the way in which they ensure the exercise of religious freedom in the structures of the armed forces of the Czech Republic. The work is divided into ten chapters. The first chapter explains basic terminology. It explains the concept of spiritual care and the concept of the armed forces of the Czech Republic. The second chapter is devoted to the content of spiritual care in the armed forces and the reasons for its existence. Its subject is therefore a description of the activities by which spiritual care is carried out in the environment of the armed forces. This thesis is about the legal position and administration of the elementary institutions of three churches in the Czech Republic. These churches are significant in the Czech Christian churches and they are based on other system of administration. The aim of this thesis is to make comparison of this three systems. The thesis is composed of five chapters, each of them dealing with different church. Chapter one introduced to the problem and it presents all churches. Chapter two is about parishes of Catholic Church, which is controled by a episcopal papal system of administration. In the Czech Republic is the most dominant Roman branch of church. The thesis react with this fact and the first part is mostly about this branch, only one chapter is about the other branches of this church. This chapter consists of eight parts. The first part is about the legal position of parishes, second part is about establishment, termination and change of parishes. The third and fourth parts are about the position of priests (third part is about parish priests, fourth part is about other priests in the parish) and the fifth part is about councils in the parish. The relationship between the state and religious communities in the USA Abstract The purpose of this thesis is to introduce the relevant aspects of the relationship between the state and religious communities in the United States of America. The focus of the thesis lies in the introduction of the development of interpretation of both religious clauses of the First Amendment to the U.S. Constitution by the Supreme Court, especially in the 20th century. This thesis aims to show, how both religious clauses, even though they were created to serve the same purpose, are in some cases interpreted in a contradicting way. The thesis also elaborates on religious freedom in the sensitive environment of armed forces, as the soldiers depend totally on services provided to them by the government. In the final part, the thesis introduces certain exceptions from the generally applicable legal provisions for the churches and religious legal entities, as well as recent development from the perspective of admitting religious freedom to business corporations. Resume The goal of this paper is to describe the situation of churches and religious societies with respect to the legal system, through the changes that affected the Czech legal systém throughout the recent half of the century. Because it is impossible to fully deal with the entirety of the history of state and law over the century, it will focus on the developments during the totalitarian regime of the Communist party and on the results thereof. The main goal is therefore to make a comparison, this will be a comparativistic endeavor, and there will not only statutes and legal documents be described, but also the practical applications of these statutes and documents, and there will be focus on theoretical and constitutional basis behind the laws. Unfortunately, with the constrains of the current format, it is impossible to fully describe even one era of Czech statehood, therefore there will be an arbitrary selection of topics on which the facts will be demonstrated and from which they will be extrapolated. The other topics will only be adressed to in a general manner. Also, it is not possible to include in full the divergent approaches of law towards the various individual churches. The author deals with the question of the church legal regulation of membership of every Church registered in the Czech Republic under current law by the end of the year 2007. The author used current church legal regulations and abstracted the membership from given angles such as the conditions necessary to become a Church member, the rights and obligations of the Church members in particular in the area of the Church self-government, belonging to a congregation, membership with full rights and without full rights, the church surveillence, and anticipated modalities of the membership termination throughout the members live. The outcome of the work generally summarizes membership criterias common to all Churches registered in the Czech Republic and lists potentiallities of every examined aspect of the church memberhip. Funding of Churces in the Czech Lands in 20th Century The aim of my Master's degrese thesis is to describe the evolution of the system of financing of churches and religious societies in the Czech lands during the 20th century. I have also focused on future possibilities for church financing with regard to the foreign regulation. The thesis is composed of ten chapters. The first chapter deals with various models of the relationship between state and church existing in the world and their implications for raising funds for church activities. The following six chapters focus on the financing of churches in different historical periods. The second chapter concentrates on the situation in the Czech lands as part of the Austrian monarchy. There is described the formation and function of religious funds and the introduction of state subsidies to clergy. The third chapter deals with the First Republic, and mainly land reform and its implications for church finances. The fourth chapter deals with the position of the Church during the Second Republic and the Nazi occupation.
