Regulation of Depository-Refund System for Beverage Containers

Regulation of Depository-Refund System for Beverage Containers Abstract This thesis focuses on depository-refund systems for beverage containers as an instrument to improve sorting of the plastic waste. In broader perspective, the plastic waste is nowadays a serious issue, not only in the Czech Republic, but also globally. Depository-refund system is an effective economic tool for environmental protection and its implementation for plastic bottles can help to tackle the increasing amount of the plastic waste. It is analyzed whether the depository-refund system for one-way beverage containers complies with principles of the circular economy and the principles of the environmental protection. The thesis describes the current status of the legislation in the Czech Republic which concerns the depository-refund system of reusable glass beverage containers. Most importantly, the thesis proposes to implement a similar regulation for one-way beverage containers (plastic and metal) in order to protect the environment from the plastic waste and to comply with goals for waste sorting set out by the European Union. Legislation of waste management Abstract This thesis deals with the legal regulation of municipal waste management in the Czech Republic. The aim of the thesis is to analyze the changes related to the adoption of new legislation related to waste management and to assess whether the available instruments are sufficient to achieve the objectives set by both national and EU legislation. The thesis is devoted to presenting the state of waste management with an emphasis on municipal waste in the Czech Republic using available data. Furthermore, the thesis focuses on the sources of legislation, with an emphasis on EU legislation and on the legislation that was the basis for the currently applicable legislation. It also includes definitions of basic terms and individual entities, which may include the waste producer, facility operator, waste dealer, or waste broker. The main part of the work is devoted to the position of the municipality and its relationship with natural persons, legal entities, and waste collection companies. It also addresses the methods of municipal waste management that are heavily used in the Czech Republic, which include recycling and landfilling. Liability for environmental damage

This diploma thesis aims to analyze the legal regulation of liability for environmental damage in the Czech legal order. Given that the regulation of legal liability for environmental damage in Czech law is highly fragmented, this thesis attempts to give a more comprehensive view of the whole issue. By dividing it into individual chapters, the thesis presents individual aspects of legal liability for environmental damage and systematically offers insight into its issues. In its first part, the thesis focuses on legal liability in environmental protection and compares the individual components of legal environmental liability. In particular, it focuses on legal liability for damage under the Civil Code, where, on the basis of a detailed analysis, it defines the main characteristics that distinguish it from legal liability for environmental damage. The second part of the thesis already deals with the legal regulation of environmental damage. Binding opinions as an instrument of environmental protection Abstract The whole concept of binding opinions is undergoing major changes nowadays, mainly due to an ongoing recodification of construction law. The transformation is the final part of a long process of sharp criticism that binding opinions have already been subject to. The important instrument for protecting public interests is criticized for its complicated and fragmented legislation, an ambiguity of its form and a division of competences between state agencies. However, is the critique legitimate? What is the current state of binding opinions? What role do they play in an environmental protection? What are the procedural and substantive aspects of the matter? The first part of the thesis describes a current state of a global and local environment, a state of its parts, important factors, trends, and prospects, with a closer look to different approaches to understanding the environment. The second part describes an effective regulation of the environment in the Czech legal framework. Environmental charges Abstract The aim of the diploma thesis is the introduction of environmental charges in the Czech legal system, their classification, analysis and evaluation in terms of their effectiveness. Environmental charges are among the most important economic instruments of environmental protection in the Czech legal system. Charges differ from taxes mainly in that there is some consideration associated with the charges. Environmental charges can be broken down according to various criteria. In the professional literature, the most common breakdown of environmental charges is the nature of their consideration, namely charges for pollution and other environmental burdens, charges for the use of natural resources and user charges. The diploma thesis examines the question of the extent to which environmental charges fulfill their functions, especially the most important function, namely the motivational function. 85 11 Abstract Deep Seabed Mining in the Area: Environmental Aspects of the Legal Framework The thesis focuses on the environmental aspects of regulation of deep-seabed mining in areas outside national jurisdictions, collectively referred to as the Area. Deep Seabed Mining (DSBM) is a potential future method of commercial extraction of non-renewable resources, metals and rare earths, collectively referred to as Minerals, conducted at depths between one and six kilometres below the ocean surface. Like all other mining operations, these activities would affect the surrounding ecosystems and the ocean environment as a whole, which is already under considerable pressure from other human activities. Effective protection of the marine environment therefore requires sophisticated legislative and policy framework to avoid irreversible and unacceptable consequences, including loss of genetic resources, biodiversity and deepening threats to climate stability. The diverse set of rules that govern the DBSM has been shaped over the last 50 years by various interest groups and under the influence of the latest scientific knowledge and technological developments. Legal regulation of municipal waste management in the context of the circular economy

V ANGLICKÉM JAZYCE The thesis deals with the legal regulation of municipal waste management in the Czech Republic in the context of circular economy. The aim of the thesis is to determine whether the current legislation provides sufficient instruments for the transition to a circular economy in the field of municipal waste management or whether the Czech legislation is insufficient in this respect; and to suggest areas that could be supported by appropriate legal instruments. The starting point for this examination are EU Directives (in particular the Waste Framework Directive, the Landfill Directive and the Packaging and Packaging Waste Directive). The legal sources examined from the Czech environment are mainly a couple of new waste management laws from 2020: the Waste Act, the amended Packaging Act, the End-of-Life Products Act and the amendment to the Local Fees Act. The thesis further deals with the so-called recycling targets, which in terms of current municipal waste management methods represent rather ambitious targets for the level of preparation for reuse and recycling of municipal waste. Ecodesign of products from an environmental law perspective This thesis discusses ecodesign as an approach to design that aims to reduce the amount of negative environmental impacts of products throughout their life cycle. Over the past few years, ecodesign has increasingly come to the forefront of debates at European level, particularly in relation to the goals and principles of sustainability and circularity. The importance of this concept lies primarily in the possibility of preventing undesirable environmental impacts at the very beginning of a product's life, i.e. at the design stage. The main goal of this thesis is to analyse the legislation in the field of ecodesign in order to assess whether the current legislation is able to achieve its objectives or whether a change is desirable. For this reason, the proposal for a new European regulation, which aims to create a new framework for ecodesign, is also discussed in detail. Due to the fact that, in the author's opinion, the concept of ecodesign is not given enough space in the Czech literature, a partial aim of this thesis is also to bring this issue closer to the readers, as one of the basic prerequisites for more sustainable decisions of the subjects is their awareness. Mitigation of Climate Change in the Energy Sector from the European Union Law Perspective Abstract Climate change is a global problem that can only be prevented through a systematic change in a number of areas of human activity. The key element in climate change mitigation is the measures taken in the energy sector, as the energy sector produces the largest amount of greenhouse gas emissions compared to other economic sectors. Therefore, the EU pays considerable attention to mitigation measures in the energy sector in its climate policy. The 2030 Climate & Energy Framework not only outlines the objective of reducing greenhouse gas emissions, but also prescribes binding targets on increasing the share of renewable energy in the final energy consumption in the EU and on improving energy efficiency. The aim of this master's thesis is to explain the complex climate change mitigation system in the energy sector as regulated by the EU law. Legal regulation of construction waste management in the context of the circular economy

The thesis deals with the legal regulation of construction and demolition waste as a specific group of waste, especially with regard to its placement in the context of the concept of circular economy. In addition to the current state of this topic, the historical development of the legislation is presented, as well as the individual methods of construction waste management and related institutes and entities governed by this legislation are defined. The thesis has an introduction, four chapters, each of which presents the individual topics in detail, and a conclusion. The first chapter introduces the concept of circular economy, its development and legal anchorage, as well as its basic principles. The chapter also defines the concept of waste management, going beyond this to present its hierarchy and basic objectives. The second chapter analyses the development of waste legislation with a focus on construction and demolition waste and in addition presents the strategic documents of waste management, which are the Waste Management Plans.
