Domain names as trademarks and their protection Martin Pultzner Importance of the internet is rising year to year and the virtual presence on the world- wide-web is absolutely essential for companies trying to succeed in such a competitive and dynamic environment as we see it in the modern world of 21st century. Due to the architecture of an internet as such, only one particular domain name can be registered at the given time and no other domain name with the exactly same wording can be registered anywhere in the world at the same time. There is a strict "first-come-first served" policy, which, on the one side, grants equal and fair access to any domain name, but on the other hand creates significant room for domain speculators and other persons who intend to register domain names in a bad faith and/or only for the profit therefrom. We mainly recognize behavior called cybersquatting or typosquatting, but also others subtypes and similar types of such behavior do exist under different names. These are problematic because of the conflict of a domain name (registered by the speculator) and rights to the trademark, business name or other rights of a different person, mostly a company. Patentability of biotechnological inventions according to European patent convention

Title: Patentability of biotechnological inventions under European Patent Convention The topic of thesis is the patentability of biotechnological inventions under the European Patent Convention (Munich, 1973) (hereinafter the "EPC") with special emphasis on decision making practices of the European Patent Office. At the beginning, the author deals with general patent law, in particular with fundamental substantive conditions of patentability of inventions, both positive and negative. A brief explanation is then devoted to the definition of biotechnological science and biotechnological invention. In the subsequent part of the thesis, the author discusses the sources of patent law in general and in relation to biotechnological inventions. The chapter is divided into three parts - international, European and national sources. Discussion regarding European sources is split into two subsections dealing with EPC and EU law. The author examines in particular the complicated legislative procedure for the adoption of the Directive 98/44/EC of the European Parliament and of the Council dated 6th July 1998 on the legal protection of biotechnological inventions and its impact on European patent law. The Abstract Protection of the results of creative work from the view of theory and practice The purpose of my thesis is to analyze the protection of results of creative work, when I try to find the purpose of this protection and take a look at theoretical and practical parts of this sort of law. The thesis is composed of nine chapters, each of them dealing with an autonomous area of protection or with other actual topics. Chapter One is introductory and defines key terms used in the thesis and their systematics. Chapter Two examines with the historical evolution. The chapter consists of three parts. Each part deals with different category. First is general, second is international and third is focused at Czech evolution of legislation. Chapter Three is subdivided into nine parts and provides the main topic of inventions and patents granted to them. Chapter Four concentrates on differences between rules for patent and utility model protection. Chapter Five discuss about the marginal theme of topographies of the semiconductor products. The purpose of this thesis is to explore the differences between the conceptions of registrability of the Community trademark on one hand and the trademark of the US on the other hand, and how the legislators formulate and apply the bars to registration. The thesis explains whether and what issues are treated differently in the European Community and the US or whether applicants may expect uniform results in the interest of smoothness of international trade in both jurisdictions.

The rigorous work is focused on the relationship between trademarks and geographical indications in the framework of the dispute relating to the designation "Budweiser" between Czech brewery Budějovický Budvar and American brewery Anheuser- Busch. It describes in detail the legal regulation of the protection of geographical indications and trademarks with dividing into the international, European and national level and the history of the designation Budweiser in the Czech Republic and USA. It dedicates to the litigations relating to the designation "Budweiser" in selected countries - Great Britain, Finland, Austria and Portugal, regarding specifics of their course and/or specifics of judicial decisions. Last but not least it concerns the dispute relating to the designation "Budweiser" in the framework of European Union and World Trade Organization.
Comunity trade mark and its relation to a national trade mark

Resumé Le but de ce mémoire était en particulier de dépeindre la coéxistence de la marque nationale - tchèque et de la marque communautaire et de comparer la reglémentation pertinente. Il sagit de sujet actuel car la quantité de marques déposées enregistrées au niveau européen aussi bien que dans la République tchèque augmente grandement en même façon que de litiges connexes. Avec la coéxistence de ces deux types de marques sur le territoire de la République tchèque il apparaît quelques problémes particuliérs. Le mémoire essaie d'identifier ces problémes et différences de vue de la législation, mais aussi de vue de l'approche pratique. Le mémoire a été divisé en sept chapitres. L'introduction est suivi par les deux chapitres qui parlent des questions générales des marques nationales et aprés des marques communautaires - de la réglementation, l'histoire et l'enregistrement de ces marques. Le troisième chapitre est consacré aux marques en général et les autres signes distinctifs. Le cœur de ce memoire se trouve dans les chapitres quatre et cinq. Legal regulation of financial markets under the influence of the recent financial crisis

The thesis deals with proposed modifications of legal regulation of the financial sector that are currently discussed in the context of the recent financial crisis. It explores both newly proposed procedures and new measures which should ensure a strong and resilient financial sector. It analyzes possibilities and issues connected with implementation of these procedures in practice and also in relation to the Czech financial market. It also evaluates these proposals from the perspective of their applicability and benefit for functioning of financial markets in accordance with intentions to find and implement legislation which prevents future financial crises and their spread to other entities.
