Protection of personal rights in continental system and common law

With the increased global infringement of personal rights, it is necessary to be aware of the protection in the different legal systems, especially Anglo-American. Even if the consequences are to be felt in the domestic legal order, the enforceability is recognized under the foreign legal order. The protection is worldwide and through the case law from the European Court of Human Rights the two legal systems - Common law and the Civil Law are penetrating the legislation and the case law in respect of the institute of the protection of personal rights. The doctorate thesis presents the complex introduction to the area of protection of personal rights in the Common law, especially in English law, Commonwealth countries and USA that has not been presented yet for the Czech legal professionals. The thesis explains theoretical concept of the Common law and its background for the purpose of explanation of differences of examined legal orders. The institute is explained on the key historical case law that led to establish the Common law principles. The thesis uses the current and topical legal cases and problems that the orders face in the 21st Century.

Protection of personality in advertising

English resumé The subject of my thesis is Protection of personality in advertising. The aim was to describe in basic points of view the legal protection of personality rights in a specific area -advertising. The problem lies in the situation if someone uses other's name or photograps, likeness or descriptive attributes of personality without permission and for an exploitative purpose. The thesis is divided into two parts. The first general part starts with the description of the origin of the advertising and its development during the last two centuries. As the main idea of the whole thesis - advertising, it was necessary to present a legal definition of this term. The general part explains the bases of the legal protection of personality rights: 1) the main principles - property law concept or human dignity concept, 2) the statutory provisions in specific codes, 3) who is able to sue, 4) limitations on liability for news and commentary, creative works and administrative purpose, 5) protection of fundamental rights such as the right to one' name, likeness, the right to protect one's honour, good name, privacy etc. 6) the legal means of protection and compensation under the Civil code. Legal regulation of advertisement and its harmonization with EU law

Téma regulace reklamy lze jen stěží označit za oblast, kterou by se odborná literatura nezabývala. Právě naopak. Už sama o sobě reklama vzbuzuje v lidech zájem a stala se atraktivním tématem pro mnoho vědních oborů, které tento fenomén nezkoumají odděleně, jako samostatný jev, nýbrž jej zasazují do širšího kontextu. Takto jsem pojala i tuto práci. Reklamu, v této práci především rozpracovanou klamavou reklamu, lze považovat za průnik oblasti nekalé soutěže, reklamy a ochrany spotřebitele. Cílem této práce je vytvořit stručný a ucelený náhled na úpravu reklamy napříč právním řádem a na harmonizaci této oblasti s právem komunitárním. Reklama jako projev nekalé soutěže je po dlouhé době předmětem národní úpravy, nicméně při budoucím společném trhu je třeba k odstranění různých forem překážek jisté harmonizace předpisů v této oblasti, protože reklama je přeshraniční záležitost způsobem svého šíření a omezující právní předpisy v jednotlivých státech by mohly bránit volnému pohybu zboží. Vzhledem k tomu, že jde o problematiku dvojího druhu, nebyla volena úprava přímo platným právním předpisem, nýbrž úprava směrnicová, která zajišťuje harmonizaci, která na druhé straně ovšem reklamu, která se týká určitých škodlivých látek a je předmětem zákazu, směřuje do oblasti práva veřejného, které lze tímto způsobem nejlépe...
