Disguised employment relationship in transport of passengers and goods Abstract This master's thesis focuses on the issue of disguised employment relationship in the transportation industry, where the work of self-employed individuals is often used for the transportation of people and goods. This raises questions as to whether the nature of the work of a courier does not exhibit the characteristics of dependent work, which must be performed in a basic employment relationship. The thesis examines the nature of the relationship between companies operating in the transportation of people and goods and their contractual partners (couriers), particularly in terms of the possible fulfillment of the characteristics of dependent work. For this purpose, the issues of disguised employment relationship, including its consequences and the motivation of entities to engage in it, are clarified. Related concepts such as illegal work, outsourcing, and dependent activity are explained. Furthermore, attention is also given to the historical development of disguised employment relationship and its prohibition in legal regulations. 92 Abstract: Social protection of families experiencing the death of their child before and after birth The thesis analyses the issue of social protection of families who are facing the loss of their infant. This includes stillborn children, children who died immediately or shortly after birth, fetuses after miscarriage and after artificial termination of pregnancy. The thesis is divided into three main parts. The first chapter places the whole issue in the context of the present time. It discusses the terminology closely related to the topic, including its development over time. At the same time, this part also mentions the directions taken by foreign legislation and, last but not least, the scope of the cases analysed is defined. The second part, the core of the text, contains a detailed analysis of the applicable institutes that can be applied in the framework of social security law in the defined cases. Taking inspiration from the social system of the Czech Republic itself, this chapter is also divided according to the first and second pillar: into social insurance benefits and state social support benefits. 1 Consequences of legal defects in labour relations Abstract This diploma thesis deals with the issue of the consequences of defects of legal acts in labour law relations with a focus on the evaluation of the impact of the recodification of private law on labour law relations after almost ten years since its effectiveness. Legal acts occupy a central position in private law relations. Legal entities can shape their own legal relations through their legal acts and at the same time bear responsibility for the consequences caused by it. I have chosen this topic because of the approaching round anniversary of the adoption of the current Civil Code, which has significantly influenced the labour law sector. Even after almost ten years, the issue of defects in legal or labour law acts, including their consequences, does not remain unambiguously agreed upon by the general professional public. Yet the consequences of a given defective legal act are crucial for the assessment of any further procedural course of action in a potential dispute. Legal status of professional football players according to the labor law

In this thesis, I deal with the legal status of professional football players according to the labour law. The thesis is divided into three parts. The aim of the first part of the thesis was to analyze whether the performance of professional football is dependent work that must be therefore performed in a basic employment relationship. Furthermore, in this part I dealt with the possible forms of cooperation between players and clubs according to the current legislation in the light of the judgments of the Supreme Administrative Court, which I am analyzing. The aim of the second part of the thesis was to analyze the practical applicability of the Labor Code to the performance of a professional football. I also looked at the consequences for the players of the fact that they do not perform their activity in an employment relationship. The aim of the third part of this thesis was to consider whether a legislative change is needed to solve the problem of the uncertain status of professional football players. In this part, I draw attention to the risks associated with possible regulation, but I primarily propose, in my opinion, the best solution to the given situation. 54 Equal remuneration of employees Abstract This thesis in detail describes the Czech legislation in the field of equal remuneration of employees, which forms an essential part of labor law. The principle of equal remuneration is one of the key concepts in the pursuit of social justice and equality in the workplace and is also closely related to the prevention of discrimination. Considering the scope, this thesis cannot be completely exhaustive and is focused only on selected aspects of unequal remuneration. The aim of this diploma thesis is mainly to provide a comprehensive interpretation in relation to the provisions of equal wage, salary or remuneration for equal (same) work or work of the same value, to identify weak areas in the legislation and to outline possible direction for the future legislation. Employment of persons with disabilities Abstract The aim of this thesis was to present the issue of employment of persons with disabilities in the Czech legal system as comprehensively as possible. Thanks to the fact that persons with disabilities constitute, according to the Czech Statistical Office, more than 10% of the population and their number is increasing, the Czech Republic has this issue quite comprehensive. Apart from the Czech legal system, this thesis also approaches the most important regulations for defining persons with disabilities in international regulation. The content of this thesis is arranged in five chapters. The first chapter introduces the basic concepts without which it is impossible to deal with this issue, namely the concept of employment and disability. The second chapter defines the category of persons with disabilities in the Czech legal system into two categories, namely disabled persons and persons with disabilities. The third chapter presents the basic definition of persons with disabilities in the most important regulations of the International Organisations. Comparison of the old-age pension insurance legislation in the Czech Republic and the Slovak Republic Abstract The main aim of this thesis is to compare the old-age pension insurance legislation in the Czech Republic and the Slovak Republic, to point out their differences and similarities, and to evaluate their significance. To a lesser extent, the thesis also deals with the theoretical foundations of pension insurance and the historical basis of social security law, which is common to both countries. The thesis is divided into seven parts. The first part introduces social security law as a legal branch and pension insurance as its subsystem. The second part concentrates on the historical development of pension insurance from prehistoric times to the end of the twentieth century. The following three parts of the thesis are focused on the pension insurance system from a point of view of legal theory. They primarily examine relevant legal principles and sources of law, but also individual social events and pension insurance benefits. Employer's obligations in health/social and pension insurance Abstract This master thesis is diving in the problematics of obligations of employer with focus at obligations in health and retirement/social insurance. As it is important and wide topic, frequently discussed lately as for obligations of employer during pandemic times, when more and more obligations and requirements are imposed on employer's shoulders. In the first and second part thesis is more focused on background of those obligations and historical development. Third part is designated to health insurance and differentiation of particular obligations of employer, start and end of those, and splitting them according to scheme of Ministry of Social security to groups of obligations: related to registering of employees to all necessary registers, cooperation with local authorities on field of social security, recording all necessary information, archiving reports for legal period, obligations in connection to application for benefits. 1 The pension insurance system and aspects affecting its development with an emphasis on demographic changes Abstract The diploma thesis deals with the description of the current pension insurance system in the Czech Republic and aims to evaluate the pension system on the basis of aspects that affect its development. Demographic development is a key factor influencing the system. The author describes the relevant demographic indicators and their development and presents conclusions resulting from the forecast of population development. In 2021, expenditures on social benefits accounted for 37% of all state budget expenditures, ie CZK 697 billion, of which almost 77% were expenditures on pension insurance benefits in the amount of CZK 536 billion. State budget revenues from compulsory social security premiums represent 41%, ie CZK 562 billion. As these data show, the Czech Republic will face a lack of funds in the future due to the expected aging population, and therefore the author presents possible scenarios in the diploma thesis, where the pension insurance system could develop in the future. Price and reimbursement regulation of medicinal products in the Czech Republic Price and reimbursement regulation of medicinal products is an integral and important part of the public health insurance system. The aim of the thesis is to describe the methods of regulation in the Czech Republic, to evaluate some of its elements and to give real examples or experiences that are known to the author of the thesis from his work experience at the State Institute for Drug Control. Apart from outlining the issues in the introduction and evaluating them in the conclusion, the thesis is divided into five chapters. The first chapter defines the basic concepts that are necessary for understanding the mechanisms of price and reimbursement regulation of medicinal products. The second chapter focuses on the historical development of price and reimbursement regulation, or the situation before and after 2008, which can undoubtedly be considered the most important milestone so far, marking the transition to the current legislation, where the maximum price and the level of reimbursement conditions are set in an administrative procedure.
