Reorganization as an insolvency method in the Czech law with focus on a prepacked reorganization Abstract This thesis deals with one of the insolvency methods in the Czech Republic, a reorganization. Proper definition of a bankruptcy is the crucial and initiatory point of Czech insolvency proceedings. Bankruptcy is defined not only by the introductory provisions of the Insolvency Act, but also by the conclusions of Czech higher courts which are analysed in this thesis. In case that debtor's economic situation overreaches an imaginary bound of bankruptcy the author of this thesis proposes to solve this situation by way of reorganization as a suitable insolvency method. However, not all debtors are eligible to be subject of reorganization. The debtor must be an entrepreneur with an annual net turnover for the last financial year prior to filing for insolvency in the amount of at least CZK 50,000,000 or must have at least 50 employees. The debtor who does not fulfil these criteria may be subject to reorganization at all. The Insolvency Act offers a solution by mean of the prepacked reorganization approved by at least half of all debtor's secured and unsecured creditors. Criminal Warrant

Criminal warrant represents a decision in criminal matters which is also special manner of criminal procedure. A single judge is empowered to issue a criminal warrant without trying the matter in the main trial if the facts are reliably proved by evidences. It is regulated by the section 314e and following of the Criminal Procedure Code. It diverse from regular criminal proceeding, because it is in fact a way of simplified and written procedure. These characteristics are also the reasons why criminal warrant is criticized by professionals. Such a diversion from regular criminal proceeding is being called as a violation of right to a fair trial by many authors. Considering such institute from the point of view of basic principles of criminal proceeding, including right to fair trial, emerge in each of six chapters of this thesis, while it forms a crucial and final part of this thesis. At the beginning is a criminal warrant introduced as a decision in a criminal matters, a special manner in criminal proceeding and diversion of criminal procedure. Children in risk in the Scout centre. Course proposal completing a training system of Junák - association of Scouts and guides of the Czech Republic

In my thesis I deal with problematic behaviour of children which scout leaders face in Liberec region and their ability to solve these problems. Theoretical part is followed by a combination of quantitative and qualitative research. In my theoretical part I described Junak organization - Association of Scouts and Guides of the Czech Republic, its training system. I also concentrated on what causes problematic children behaviour, competencies of a leader, danger for a child when there is a lack of competencies and methodology of work with children in Junak. My aim in empirical part was to understand what problems scout leaders face, if they are able to solve them, and what is their idea of an educational seminar which could help them when working with children in risk. I obtained data from 68 leaders in Liberec region by a questionnaire with open and closed questions. Then I used a method of semi-structured interview and obtained information from 10 centre leaders Retez Ceska Lipa. In interviews I focused on: problems which scout leaders have experienced, how they solved them, if this solution was successful and concrete ideas of a course. Social services for families at risk in Česká Lípa district

Tato bakalářská práce se zabývá problematikou ohrožených rodin, popisuje některé problémy, se kterými se tyto rodiny mohou potýkat a službami, které jsou jim v České republice nabízeny. Dále se zaměřuje na služby rodinám nabízené v okrese Česká Lípa a navrhuje další, které by v okrese mohly najít své uplatnění, což je též cílem mé bakalářské práce. Tato práce je rozdělena na teoretickou a praktickou část a na čtyři kapitoly. Do teoretické části je zahrnuta kapitola první a druhá, do praktické části kapitoly zbývající. V první kapitole se věnuji popisu orgánu sociálněprávní ochrany dětí, jeho funkcím a kompetencím. Také vymezení okresu Česká Lípa a představuji místní OSPOD. V kapitole druhé se věnuji problematice ohrožených rodin v ČR, problémům, se kterými se setkávají a sítí služeb, které jsou jim nabízeny. Třetí kapitola je věnována podrobné analýze spisů OSPOD Česká Lípa, zabývá se problematikou ve spisech uvedenou, též uvádí početní vyjádření zastoupení jednotlivých problémů. Dále je zde uvedena práce s dotazníkem, který byl vytvořen speciálně pro zjištění 55 problematiky služeb pro ohrožené rodiny v okrese a rozbor odpovědí na jednotlivé otázky.
