84 Résumé The task of criminal law in every democratic state is to protect society against criminality. In order to perform this task criminal law has at its disposal resources which represent criminal sanctions. Amongst these sanctions a unique place is occupied by the unconditional imprisonment, which is what this thesis is concerned with. Ever increasing criminality, which is affecting most states, is provoking discussions on the effectiveness of punishment, its methods, and the commensurateness of punishments. The Czech Republic is far from being the only country forced to resolve problems associated with a growing prison population and the increased costs of the prison system. Unconditional imprisonment is a universal and basic punishment in the Czech Republic. It has a long tradition and a fixed place in the legal awareness of society. It is the strictest punishment and represents an extraordinarily serious intervention into the sphere of the human rights and freedoms of the individual. The enforcement of unconditional imprisonment is accompanied by a host of negative consequences, such as the interruption of social links, adaptation to prison culture and a problematic return of a convicted person into society. Post-penitentiary treatment and the prevention of recidivism

POSTPENITENCIARY CARE AND PREVENTION OF RECIDIVISM The purpose of my thesis is to analyse current form of postpenitenciary care in Czech Republic and to think about recidivism and the way how to prevent it. The reason for my research dissertation is to show that every one of us have to get the second chance despite of our life mistakes. The thesis is composed of eight chapters. Chapter One is introductory and defines basic questions which are solved in following parts of the paper. Second Chapter concentrates on the problem of recidivism. The chapter is subdivided into six parts which are focused on different points of recidivism (concept, causes and prevention of recidivism). Part three is subdivided into five subparts. It examines alternatives to the criminal punishment of imprisonment in Czech Republic. Chapter Four concentrates on the criminal punishment of imprisonment and the penitenciary care. It describes Prison service, education or employment of prisoners. Chapter Five deals with history of the postpenitenciary care in the world and in the Czech Republic. Part Six focuses on the postpenitenciary care in the Czech Republic. 91 Zusammenfassung Die Autorin widmet sich in der Einführung der Diplomarbeit der Stellung der Viktimologie in den Wissenzweigen, grenzt die grundlegende Begriffe wie Viktismus, Viktimisierung und Reviktimisierung ab. Im folgenden Kapitel fasst sie in der Kürze den Inhalt der internationalen Dokumente über Opfer der Straftaten zusammen, damit sie in den nächsten Kapiteln in Betracht ziehen und analysieren kann. Den einzelnen Typen von Hilfe der Opfer der Straftaten sind die nächsten Kapitel der Diplomarbeit gewidmet. Die Autorin spricht über die Beratungshilfe, Sozialhilfe, therapeutische Hilfe (die die Krisenintervention, psychologische Hilfe und Rechtshilfe umfasst), die Hilfe mit strafrechtlichen Mitteln und über die Geldhilfe. Im Kapitel über Beratungshilfe ist die Aufmerksamkeit auf die Zulänglichkeit der Beratungshilfe gerichtet, im Kapitel über Sozialhilfe legt die Autorin Augenmerk auf Deklaration der Sozialrechte von Opfern der Straftaten und ob die Rechte in der Tschechischen Republik eingehalten sind.
