Legal regime of mining - related land

The topic of my work is assigned outstandingly broadly and provides many possible directions of where to aim the work. During my research I focused on aspects that are usually handled mainly by private constructors, during constructions of smaller extends. In first chapter I tried to define the terms, which I was going to be working with further in my thesis, primarily from the reason that their usage in Czech law is unsystematic and sometimes even confusing. In second chapter I characterised private law entitlement to build with the focus on the ownership of the land and old-new institute of emphyteusis, which was reinstated into Czech law by the Civil Code form 2012. The third chapter deals with the regulation of construction lands in public law beginning with the land use planning up to the verification of basic conditions after completion. Fourth chapter focuses on the cadastre, about the principles used on its operation and on proceedings related to it. Last, fifth chapter briefly describes taxation of the lands especially targeting the property tax.
Entries of a title to land into the Land Register

Following re-codification of private law in 2014 ownership right entries in cadastral register have changed substantially. New ways of ownership establishment have been enacted (rebuilt, alluvium, ravine...), certain unused private law principles have been renewed (for example the superficial principle) and principles of land registry functioning have been laid down. Also the system of land register entries has been changed by abandoning the two methods of ownership right entry according to the type of acquisition (by record or by entry). These substantial changes however often lack support in land registry regulations which makes land register entries problematic. The thesis is focused on the theme, which is current almost every time, even in every state, and that is the protection of the nature. We all are a part of the nature, which is all around us. It must be protected, so as future generations can experience its beauty. The interest in the theme results from the author's job that is why the author decided to discuss the theme and outline its difficulties. The work itself is divided into three parts. Most of the first part focuses on the specific territorial nature and landscape protection, which consist in announcing various categories of specially protected areas; it also focuses on the providing tools for their protection and care. In the thesis, general territorial nature and landscape protection are not omitted, because they, using certain institutes, provide significant protection to the fragments of nature or territories, which do not attain such values to be declared as protected. Legal regulation of treatment of wild animals

The diploma thesis deals with the legal regulation of the treatment with wild animals. It compares different terms used in legal regulation of protection of animals. It specified differences between concept of an animal in private law and public law. The diploma thesis is focused on possibilities of gaining ownership to the wild animals, proving origin of animals bred in human care. It concerns with legal regulation of treatment with handicap animals. The diploma thesis analyzes preparation and realization of Action and Management Plans and is also concerned about protection of wild animals against cruelty.
Legal regime of free-time activities in wild nature

The diploma thesis "Legal regime of free-time activities in wild nature" deals with the legal regulation of individual behavior in the wild nature with respect to the protection of nature. It is based on legislation in force in the territory of the Czech Republic, mainly on the laws and implementing regulations relating to environmental protection. The diploma reflects the creation of new forms of recreation or entertainment in nature, which results in a higher burden on the environment; therefore there is a need for consistent application of legal rules. A fundamental aspect of this thesis is a summary of legal regulations of the execution of leisure activities in the wild nature followed by the review of the legislation including other possible future solutions.

Transfer of ownership right to land The thesis describes the property law transfer process and provides its clear and comprehensive explanation. The thesis compares the new legislation which came into effect on 1st January 2014 with the previous one. Further, the thesis describes the criticized parts of the prior legislation and how legislators dealt with the problematic and criticized parts in the new legislation. The thesis is divided into three main chapters. The first chapter defines the nature of land law and describes its basic concepts. The second and the third chapter focus on two phases of transfer of ownership right to land. The first phase means the legal title to transfer of ownership right to land. This phase is defined and described in the second chapter. The whole transfer process of ownership right to land is completed by a deposit of right in the Land Registry.

Legal regime of protected areas and protective zones to protect water

This diploma thesis deals with the legal regime of protected areas and protective zones used to protect water. The diploma thesis is composed of four chapters. Chapter one defines basic terms, a protected area and protective zone, in general. This chapter also contains a comparison of both institutes and their application in environmental protection. The second chapter deals with the sources of relevant legislation protected areas and protective zones to protect water. Chapters three and four are central of the thesis as they contain an interpretation of legislation of each types of protected areas and protective zones to protect water. For individual institutes is analyzed their concept, function, form and method of their determination and especially their special legal regime based namely on bans and restrictions regarding certain activities in the given area. Attention is also paid to various limitations of property rights to real estate in the protected areas and protective zones and to possible compensations for such limitations.
The alterations in the attitude of UN conferences towards environmental protection from the perspective of international law

The thesis examines the alterations in the attitude of the UN conferences towards the environmental protection from the perspective of international law. It presents developments and changes in international environment protection in articulation with its fundamental milestones being the UN conferences in 1972 in Stockholm, in 1992 in Rio de Janeiro and in 2002 in Johannesburg. These and other conferences, adopted international documents and treaties that comprise the contemporary framework of the protection of the environment. The thesis explicates the key concepts of the environmental law, describes the role of the UN and other international organizations and summarizes the most significant conferences, events and documents. It concludes with prospects of the future development of the international environmental protection.
Rights and duties of a forest owner

Rights and duties of the owner of the forest This diploma thesis deals with the legal regulation of rights and duties of forest owner and defines the basic terms related to this topic. The thesis consists of seven parts, whereas chapter one is introductory and chapter nine is conclusion. Chapter Two deals with the basic information of the history of the forest legislation. Chapter Three pays attention on the forest in the Czech republic and provides a describtion of different forest types located in our territory. Chapter Four provides legal definitions of basic terminology. Chapter Five mentions the ownership of forest owners and restrictions of their property rights. The main attention is paid to chapter Six and Seven, which include a summary of the most important rights and duties with which the forest ownership is undoubtedly associated. Chapter Eight deals with the liability of forest owner and sanctions, that may be required. The aim of my thesis is to focuse on rights and duties of forest owner within forest inventory etc. The main source of this work is the Forest Act.
