Euro and the Czech Republic - the benefits and pitfalls of the euro currency Abstract The thesis focuses on possible benefits, hazards and costs which could rise up from the entrance of Czech Republic to the Euro Zone and implementation of euro currency. The aims of the thesis are as follows: to acquaint the reader with the history of the monetary and economical integration in the Europe after the second world war to the present time; present the criteria of the nominal and real convergence used to determinate the level of convergence between states, assess the level of convergence reached by the Czech Republic in relation to the Euro Zone; and present the possible benefits hazards and costs of the introduction of the euro. To achieve the abovementioned aims, the method of analysis, synthesis, comparison and description was used. The content of the thesis is divided to five major chapters. Economic and legal aspects of foreign direct investment in the Czech Republic Abstract The thesis deals with the issue of foreign direct investment and investment incentives in the Czech Republic from an economic and legal point of view. The thesis defines the term FDI in the legislative framework and analyses from the available literature its positive and negative impacts on the host country and economic growth. Within the work, the genesis and development of the key Act No. 72/2000 is analysed in detail. The work aims to confirm the impact of changes in investment incentives on the inflow of FDI in the Czech Republic in the last two decades. The institutional role of CzechInvest and the procedure for approving investment incentives is also part of this work. Based on several studies, the thesis presents a dissenting opinion on the impact of investment incentives on the inflow of new investments and the overall economic advantage of these subsidies. In terms of statistical data, the work analyses both data on investment incentives and the inflow of FDI into the Czech Republic, both from a territorial and sectoral point of view. Legal and economic aspects of the institute of the lender of last resort Abstract The master thesis deals with the legal and economic aspects of the institute of the lender of last resort, as a key institute that helps ensure the stability of financial markets. The thesis is divided into four parts. The first part is focused on the economic aspects of this institute, especially deals with the general definition of the term lender of last resort and its historical genesis, as well as the principles and forms of assistance of the lender of last resort. The key knowledge of this part is the Thornton-Bagehot doctrine of the lender of last resort. The second part of the thesis deals with the legal regulation of the lender of last resort in the Czech Republic. The third part is aimed at relevant European legislation and provides a summary of the relevant case law of the Court of Justice of the European Union, namely the cases Pringle, Gauweiler and Weiss. The fourth and final part of the thesis outlines the legal framework of this institute in the USA. Central securities depository Abstract The topic of this diploma thesis is the person of a central securities depository, with a specific focus on its legal regulation. In relation to this topic, two main areas are accentuated - on the one hand, the authorisation procedure of a central securities depository and, on the other hand, its subsequent functioning. The aim of the paper is to comprehensively cover all relevant aspects of the legislation, to reflect on its suitability, assess its necessity, analyse its current issues, and also present its potential future direction. The thesis contains an introduction, five systematically segmented chapters and a conclusion. The first chapter serves as an obligatory introduction to the subject and at first deals with the definition of the financial and capital market. In the second subchapter of this chapter, a brief introduction to the central securities depository and a description of its position within the latter mentioned market takes place. Use of the monetary instruments of the Czech National Bank Abstract The aim of the thesis is to chronologically analyze the use of the monetary instruments of the Czech National Bank with emphasis on the issue of changing the primary objective of our central bank in the legislation order and answer the question whether there was a change in the use of the monetary instruments of the CNB or not. The thesis uses mainly descriptive method, analytical method, and comparative method. The sources of this thesis are mainly professional economic publications (professional articles, textbooks), legal regulations, including the case law of the Constitutional Court, and freely available data listed on the website of the CNB or the website of the Czech Statistical Office. 1 Company financing analysis Abstract The aim of this thesis is to analyse the forms of financing a company, describe it, not only from a theoretical economic and legal point of view but also from a practical point of view, compare the advantages and disadvantages of various forms of financing and describe the economic and legal context and consequences of using different methods of financing. To fulfil this goal, the author used methods of analysis, comparison, induction and synthesis. The first chapter deals with the various ways of dividing the forms of financing the company, where the various types of capital are defined, which are concepts that are subsequently worked with in the following chapters. The second part of the first chapter then deals with a general description of the company's capital structure and then the basis for setting the optimal capital structure so as to achieve an ideal composition of debt and equity, especially in terms of minimizing the cost of capital and minimizing the risk resulting from the use of different types of capital. Financial policy in times of crises until the 19th century Abstract This thesis focuses on financial policy during crises of the Bohemian Duchy, Kingdom of Bohemia, and Lands of the Bohemian Crown within The Austrian Empire until the 19th century. I will compare monetary and fiscal approaches to tackle the gravest crises caused by war, instability, or a financial breakdown. Therefore, in this thesis, I will analyse selected crises that took place in the Bohemian Duchy located in the Bohemian Kingdom at the end of the 13th century. I will focus on the Hussite wars, the great calada during the Thirty Years War, Napoleonic Wars, the Seven Years War, the Revolution of 1848, and the Long Depression, which started in 1873. The used methods are mainly comparison, analysis, and analogy. Results of the research indicate that an improper financial policy caused the majority of crises. Governmental approaches to solving fiscal, monetary and taxation problems were worsening the situation. Financial policy concerning monetary, fiscal, and tax policy until the end of the 19th century was procyclical. 1 ABSTRACT STATUS AND ROLE OF CENTRAL BANKS IN HISTORY This diploma thesis describes and compares the regulation and status of two central banks in our history, the central bank of the independent Czechoslovak Republic and the central bank of the Czech Republic. The aim of this thesis is to present and compare selected aspects of both central banks through the method of analysis and comparison. The hypothesis is that both banks, as central banks of democratic states, are similar in their regulation and status. The intention is to verify this hypothesis and find out whether the Czechoslovak Republic legislation was a source of inspiration for the creation of central banking legislation when the Czech Republic was established. The first part of the thesis describes the banking system, the characteristics and origin of central banking in the world and the Czech region. Subsequently, the circumstances of the establishment of the National Bank of Czechoslovakia and the Czech National Bank are presented. The second part deals with the constitutional and legal regulations of both central bank and the objectives of their activities. The main aim of this work is to describe and explain the capital requirements of the banking sector. Both economically and legally. The thesis is divided into five main parts. First, I deal with the theoretical description and reasoning behind the banking sector regulation. This part of the work emphasized the relation between financial and business cycle, I illustrate their close relation and mutual interaction. Furthermore, the thesis defines capital adequacy in general, its importance and its most important elements and features. Subsequently, the development of the Basel regulation is described in detail, which despite its legal non-binding nature represents the basic rules for capital adequacy. The main emphasis is put on Basel II and Basel III and its implementation in European and Czech law, where the most important concepts are elaborated in detail to analyze and evaluate them. The main topics I deal with are the structure of capital and measurement of market, credit and operational risk. Particular emphasis is placed on the pro-cyclicality of capital requirements, the implications of this pro-cyclicality, and the tools in Basel III to mitigate this feature.
